July 26, 1940
The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Friday evening July 27, 1940, at 7::00 o'clock P. M. Those being
present were Mayor Roey, Commissioner Busch, Commissioner Lake, City Manager Henderson and
the Acting Clerk when the following proceedings were had to-wit:
The minutes of the last regular session were read and it was moved by Comnassioner
Busch, seconded by Commissioner Lake that the minutes be approved as read and the mo-
tion was carried by the following Aye and No vote; those voting Aye being Mayor Fbey,
Commissioner Busch and Commissioner Lake; those voting No, none.
Appointment - Acting City Manager
City Manager Henderson having been granted a leave of absence to attend National
Guard Encampment from August 4th to a4th, 1940, motion wa~ made by Commissioner Busch,
seconded by Commissioner Lake, that Walter Davis, Director of Finance, be appointed
Acting City Manager for that period, his duties as such to be combined Wi~l his regular duties
as Director of Finance, and the motion was carried by the following Aye and No votej those
voting Aye being Mayor Hoey, Commissioner Busch and Commissioner Lakej those voting No, none.
Band Concert - Rodeo
The Manager presented a request from "!the Junior Chamber of Commerce that the band be
permitted to play for the parade and rodeo on August 3rd, 1940, these services to be in lieu
of the regular concert which bas been scheduled for the Band to paly at Beall Park on July
30th, 1940. A motlon was w..ade by Commissioner Lake, seconded by Commissioner Busch that the
request be granted, the Band to receive the same pay from tile City for playing on August
3rd, 1940 as they would regularly recei ve for playing the concert on July 30, 1940, and t:w r.t
motion was carried by the following A~~ and No votej those votine Aye being Mayor Hoey,
Commissioner Busch and Commissioner Lake; those voting No, none.
Application for City Licenses
The follow1.ng applications for City Licenses were presented and read:
Daniel W. Herron
Tom McCusker
Gilke rson Dairy
Coffee Cottage
It was moved by Commissioner Lake, seconded by Commissioner Busch that the appli-
cations be approved and the licenses issued and the motion was carried by the follow-
ing Aye and No votej those voting Aye being Mayor Hoey, Commissioner Busch and Com-
missioner Lake; those voting No, none.
Tax Levy - 1940
Montana Stautes require that the resolution makine the annual tax levy must be adopted
before the second Monday in Aueust and the regular date for passing such resolution ~his
year would be a t the regular commission meeting to be held August 9th. Since the Manager
will be on leave on that date, the matter was brought up for discussion a t this time. The
Manager recommended a total levy of 27t mills, the distribution of which to different funds
will be covered by the resolution to be presented on August 9, 1940.
Delinquent SID Assessment - County Relief O:'ficer Building - 3rd & Ifendenhall.
The Manager informed the Commission that, after several conferences with the
County Commissioners and the County Attorney, the County Attorney has informed him that the
County Commissioners have set up a provisional amount in their budeet for 1940-41 to pay the
delinquent SID assessments against 8' of Lot 39 and Lots 40,41 and 42, Block D, Tracy's

Addition, which property has been taken over on tax deed by the County and used by them for
a number of years as the County Relief Office:.
Proposed Oiling - North Side streets;
The Manager reported on a conference which he had had during the week with Engineers::
of the State Highway Department relative to the possibility of renting equipment and secur-
ling ma terial from the IIic;hway Department to apply oil on the graveled portions of North
... grand, North Willson a nd North Tracy avenues as a dust pallative treatment.

Inquiry having been r ecei ved by the Building Inspec tor reearding a perm1 t for re...
modeling the residence at 427 E. Mendenhall to convert it into three apartments, and this
being the only private property left in the block accupied by the new Hawthorne school,
the matter was brought to the attention of the Commission. The Manager Vias instructed
that such permit should not be granted until detailed plans and specifications of the pro-
posed remodeling are furnished and such plans and specifications show that the remodeled
building will comply wi th the requirements for buildings in Fire Zone No.2'.
Adjournment
There being no further business to come before the Commission at this time, it
was moved by Commissioner Lake, seconded by Commissioner Busch that the meeting adjourn
and the motion was carried by the following Aye and No vote; those voting Aye being
Mayor Roey, Commissioner Lake and Commissioner Busch; those voting No, none.
