The Commission of The Ci ty of Bozeman met in rogular session in the Comrr.isf:'ion Room,
City Hall Builcling, Friday evening, August 9, 1940, at 7:30 o'clock P.I,,:. Those being
present Mayor Hoey, Commissioner Busch, Commissioner Lake, City Attorney Aitken, Acting
City !v:anager Davis, and the Clerk when the following proceedings were had to-wit:
The minutes of the last rec;ular session were read and it was moved by CornmisEioner
Lake, seconded b:' Commissioner Busch tha t the minutes be approved as read and the motion
was carried by the ibllowing Aye and No vo te; those vo ting Aye be ing Mayor Roey, Conunis-
s ioner Busch and Commis sioner .Lake; those voting No, nono.
Dids for Misc. W & C. 1040
The Acting Manager stated that this was the time and place set for the opening of
bids for the construction of Misc. W & C for 1940. He presented affidavit of publication
of the Notice to Bidders, whereupon, it was moved by COrrL'Ylissioner Lake, seconded by Com-
missioner Busch that the bids be opened and the !"lotion was carried by tho following .t~ye
and No vote; those voting Aye being Mayor Hoey, Co:r.rmisE:ionor Lalre and Commis~lioner Busch;
those voting No, none.

City EnGineer, L. S. Thorpe, was present and stated that the unit prices bid were
in line with the contract prices of previous years. It was moved by Commissioner BUSCh,
seconded by Commis s loner Lake that tce bid be accep ted and the motion was carried by the
following Aye and :No vote; those voting Aye being Iv:ayor I{oe':r, Commissioner Busch and
Commissioner Lal{e; those voting No, none.
Sewer ,~': Water
South Church
Mr. George Stucky was present to inquire about sewer and water on South Church. Mr.
Stu cky was informed to present a pe ti tion signed by the property O\'ffiers reques tine; a
sewer and present it and it would be given consideration.

Resolution No. 477 -- Tax Levy 1940

Sewer Connections Ordered
The matter of maintaining and using an outside toilet or pri~~ vault at 12ll
Sou th Willson and l212 South Grand where sani tar~r sewers have been available for more
than one year was brought up for discussion. It was pointed out that this was in
viola tion of Ordinance No. 479, and a nuisance by the provi s ions 0 f tha t ordinance.
After further discussion, it was moved by COID.'11issioner BUSCh, seconded by C0nrr.11ssioner
Lake that ~;r. D. Jeffers, 1212 South Grand Avenue, and IiIr. Mark G. Swingle, 1211 South
Willson Avenue be ordered to discontinue the use of their outside toilets and to con-
nect wi th the sanl tary sewer wi thin thirty days and the motion was carried by the fol-
lowing Aye and No vote; t..hose voting Aye being Mayor Hoe:r, Gommissioner Busch and
Commissioner Lake; those voting No, none.
