The Commission of The Gity of Bozeman met in regular session in the Commission
Room, City Hall Building, r'riday evening August 30, 1940, at 7:30 o'clock P.M. 'l'hose
being present were Mayor HOBJ, Commissioner Busch and Commissioner Lake, City Attorney
Aitken, City Manager Henderson, Director of Pinance Davis and the Clerk, when the fol-
lowing proceedings were had to-wit:

Lake, seconded b::T Commissioner Busch that the m.'Lnutes be approved as read and the mo-
tion was carried by the following Aye and No vote; those vo ting Aye being Mayor Hoey,
Commis sioner Busch and Commissioner Lake; those vo t:Lng No, none.
Zoning Ordinance -- Violation
Mr. D. J. Ple tsch, 1022 South I-'if th, appeared before the Commis s ion to ask whether
or not the Commission 0Bd plans or intentions of ordering paving installed on Ar~1ur
Street, between Pourth and :f;'ifth Street and also to enter a protest againe,t the opera-
tion of a concrete mixing plant by the Standard Construction Company on a vacant lot
at the corner of Third Avenue and Arthur Street.
Mr. Pletsch was informed that the COr.1..'Ylission had no intention of ordering pave-
ment installed on Arthur Streot until such time as property owners on that street show
a need for such pavement and the desire to have it installed.
In the matter of the concrete mixing plant. Mr. l:letsch was informed that this was
a temporary installation and' to be used only for necessar;y work in connection wi th
paving being installed in Special Improvement Jistrict No. 333 and that it would be
removed as soon as that work is completed. Mr. Pletsch insisted that hIs protest be
entered in these minutes, calling attention to the fact tllat, in his opinion, regard-
less of whethor this plant was a temporar:r installation or not, it is a "technical"
viola tion of the Zoning Oru.lnance. The LIanager requested that the minutes also show
that Mr. Pletsch had recently erected a sii.;n on his premises at 1022 South .l.'lfth with-
out first having secured a permit for the same, and that the erection of such sign
is also a violation of the Zoning Ordinance.
Vaca tioD - - Poli ce Jl1dr~e
A request from Lloyd Jobnson,.Police Judge, for a vacation with pay from October
5th to 19th, was presen ted and road. It was moved b:T Commis sioner Busch, seconded by
Commissioner Lalce that the request be gran ted and the motion was carried by the fol-
lowing Aye and No vote; those vo tlng Aye being Mayor IIoey, Conunls 'co loner Busch and
Commissioner Lake; those voting No, none.
30nds for Policemen
The following bonds for policemen in the amount of $lOOO.OJ each were presented:

The bonds were approved as to form by the City Attorney, whereupon, it was moved
by Conrnis Gioner Lal{e, seconded by Commins loner Dusch tha t the bonds be approved and

The bonds of Ed Mellon as a Gas Fitter and as a Master Plumber were presented. The
bonds were approved as to form by the Ci ty Attorney, whereupon, it was moved b~' Commis-
sioner Busch, seconded by Commissioner Lake that the bonds be accepted and approved and
thc motion was carried by the following Aye and No vo te; those voting Aye being Iv;ayor

A communication from the Board of Trustees of the Christian Church requesting tbat
the building fees for their proposed improvement on the present church be waived, was
presen ted and read. After d.iscus sion, it was moved by Com:'1is sioner Busch, seconded b~y
Comnllssioner Lake that the fees be waived provided the permit is approved by the Board
of Adjustment and thc motion was carried by thc following Aye and No vote; those voting

The Mana[er read a letter which he had written to R. ..:~. BedinGer, Regional Manager
Ci vil Aoronau tics Authori ty, asking defini to infor::lla tion and au tJiori ty for the C:L ty to
do work on the Belgrade Airport to make it acceptable as a ficld for currying on a
Civilian Pilot training program at Montana State Collcge. TIlis was to vcrify the action
of the COffi.-rnission on August 23, 1940, when they offercd the co-operation of the Cit:7 in
furthering this program and to show that no further action can be taken until information
and aut~,-ority is rece:'Lved from the Civil Aeronautics Authority.
Adjournment
There beinG no further business to come before the Conmission at this time, it was
moved by CommissionerLake, seconded by Commissioner i3usch that the meeting adjourn and
