HomeMy WebLinkAbout1940-04-19 174 Boz eman, Mon tana April 19, 1940 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall building, Friday evening, April 19, 1940, at 7:30 o'clock P.M. Those bei.ng present were Mayor Hoey, Commissioner Busch, Commissionor Lake, City Attorney Aitken, City Manager Henderson, Director of Finance Walter Davis and the Clerk when the following proceedings were had to-wit: The minutes of the last regular session were read, and it was moved by Commissioner Lake, seconded by Commissioner Busch that the minutes be approved as read and the mo- tion was carried by the following Aye and No vote; those voting A';:l6 being I\layor Roey, Commissioner Busch and Commissioner Lake; those voting No, none. Public Hearing -- SID No. 331 set The Manager s ta ted tha t this was the time and pla eel for the hearing of protes ts against tho creation of Special Improvement District No. 331, sanitary sewer on East Main Street from Broadway to Cypress Street. He presented affidavit of publication of the Notice and the Clerk's Mailing Certifics te th'l t all property owners had been notified. The written protest of 5.8% of the property owners was presented and read. It was moved by Commissioner Lake, seconded by Commissioner Busch that the pro- tests be overruled as insufficient and the City Attorney be instructed to prepare the Resolution creating the dis trict and the motion was carried b7l the following aye and No vote; those voting Aye being Mayor Hoey, CornmiscLmer Busch, and Conunissioner Lake; those voting No, none. Street Light -- Broadway and li1ain Mrs. Joseph Russell, of the Russell Oil Company, appeared before the Commission to request that the street light pole at the corner of Main and Broadway, in front of her service station, be removed. She also requested that ornamental street lights be installed along the east end of Main Street. It was explained to Mrs. HusBell that the present street light pole cOllld only be removed if ornamental lights are installed, and ~~at tile creation of a Special Lighting District was normally done only on petition from property owners in the district. She was assured that, if a petition for such a district from a representative number of property owners 1s presented, the Commission will be glad to take the necessary action to crea te such a di stric t and to contribute to i ts c 0 st. Resolution No. 465 Creating SID No. 331 The Manager stated that tl~ City Attorney as instructed had prepared a resolution creating Special Improvement District No. 331, sanitary sewer on East Main Street from Broadway to Cypress. He presented Resolution No. 465, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, STA'I'8 OF MONTANA, CREATING A SPECIAl, nr.PHOV:C~:;ENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAl" rvTPROVEMENT DISl1fl.ICT NUMB,m 331ft OP SAID CITY FOR THE FURfOSE OI~' INSTALLING A SAInTARY SE\VER ON EAST MAIN STREET FROM TIlE MAI''iIIOLE AT THE INTERSECTION OF EAST li~IN STRS:.';T AND BROA:OWAY TO A POINT 150 FEET EAST OF THE EAST LINE OF CYPRESS AVENUE, IN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AID EXPENSE OF CONSTRUCTDJG SAID SAXITARY SEWER AGAINST 'THE PROPERTY VHTHIN SAID DISTRICT IDmER A1:D BY VIRTUE OF THE PROVISIONS OP SECTIONS 5225 TO 5277, INCLUSIVE, REVISED CODES OF MONTPJ~A, 1935, AND ANY A},1ENDMlmTS THERETO. It was moved by Commissionor Busch, seconded by Co:mm.ission'er Lake that the RAso- lution be passed and adopted and May 10, 1940, be set as the dc.te for opening bids I I I I I I for the construction and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Hoey, Commissioner Busch, and Commissioner Lalce; those votlng No, none. Petition for Paving District Mr. J. R. Parker, H. IT. Jeter, David DeLap, F. E. Butler, Frank Swanson and others appeared before the CO!iIDlission and presented a peti tion of proportyowners requesting that the following streets be paved: Grand Avenue from Arthur to Garfield, Sixth Avenue from Garfield to Lincoln Street, Garfield Street from Sixth to Willson Avenue, Harrison Street from Tracy to Eighth Avenue, except paved portion, Tracy Avenue from College to Harrison Street, Seventh Avenue from College to Harrison, Fifth Avenue from College to Garfield, and Arthur Street from Fifth to Sixth Avenue. The matter was discussed by those present and the Com~isslon, and it was moved by Commissioner Bus ch, seconded by Commi ssioner Lalm that the City Attorney be ins tructed to prepare a resolu tion of in ten tion to create the distric t and the mo tion was carried by the following Aye and No vote; those voting Aye being Mayor Hoey, Commissioner Lake and Commissioner Busch; those voting No, none. Renewal of Lease on Water Shed The Manager rend a communication from the Nortllern Pacific Land Agent stating tr:et the lease on the I'J. P. see tions on the wa ter shed had expired. An extension of this lease untll July 1, 1941 was presented. It was moved by CoTIlr1issioner Lake, seconded by Commissioner Busch that the Mayor and Clerk be authorized to sign the extension of the lease for The Ci ty of Bozeman and the motion was carried by the followlng Aye and No vote; those voting Aye being Mayor Hoey, Commissioner Busch and Commissioner Lake; those voting No, none. Right-of-Way Easement for REA The Manager presented a right-of-way easement for the Rural Electrification Adminis- tration to extend electric lines across the Huff and Williams Ranches, City owned land south of Bozeman. After discussion, it was moved by Commissioner BUSCh, seconded by Commissioner Lake, tha t the Mayor and Clerk be au throized to sign this easement on condi tion that a clause be added to the effect thr;,t the rights be granted under the easement will only apply if used wi thin three ~rears from the da te of the easemen t and the motion was carried by the following Aye and No vote; those voting Aye being },iaJor Boey, Commissioner Busch and Commissioner Lake; those voting No, none. Continuation Certificates Continuation certificates on the bonds of Franl{ Trunk and Louis Krueger as Master Plumbers and of Frank Trunk as a Gas Fitter were presented. The certificates were approved as to form by the Ci ty Attorne~T, whereupon it was moved b:y Commissioner Lake, seconded by Commissioner Busch tha t the certifica tes be approved and accepted and the motion was carried by the following Aye and No vote; those voting k;le being Mayor IIoe-:T, Commissioner Lake, and Commissioner Busch; those voting No, none. Anderson It was moved by Commis sioner Lake, seconded by Commi ssloner Busch tha t the applica- tions be approved and the licenses issued and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Hoey, Commissioner Lake and Commissioner Busch; those voting No, none. Petition -- Extension of "Aft Residence Zone A peti tion' from interested property owners was presented, requestlng that the Zoning Ordinance be amended to extend the It A" Residence zone to take in a 11 property si tua ted wi thin one and one-half blocks north and two and one -half blocks south 0 l' Cleveland Street. The petition was referred to the City Attorney for an opinion on the special procedure set up by the Zoning Ordinance for its amendment. Renewal of WPA Park Improvement Project The Manager presented an amended application for the continuation of the WPA Park Improvoment Project. After discussion, it was moved by Conu:nissioncr Busch, seconded by Conrrnissioner Lake that the City Manager and Clerl{ be authorized to sign the application for The C1 t:y of Bozeman and the motion was carried by the fa llowi ne Aye and No vo te; those vo ting Aye being Majror IIoey, Commissioner Bus cll and Connnissioner Lake; tho~~e voting No, none. Cost of Widening Mendenhall at 7th Ave. The Manager presented plans for the widening of Mendenhall at Seventh Avenue. After examina tion of the plans, the Ci ty Manager was ins truc ted to ge t further de ta iled COB ts on the widening of the Street.
