Those being present were Mayor Hoey, Commissioner Busch, Commissioner Lake, City Attorney Aitken, City Manager Henderson, Director of Finance Walter Davis and the Clerk when the follow- ing proceedIngs were had to-wit: The minutes of the 1a st regular session were read, and :t t was moved by Corrnnis sionEr Lake, seconded by Cormnissioner Busch that the m,inutes be approved as read and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Hoey, Com- missioner Busch and Commissioner Lake; those voting No, nona. Resolution No. 466 -- Intention to Create SID No. 333 The City Manager stated thqt the City Attorney, complying with instructions given him at the last regular meet:ng, had prepared a resolution of intention to create Special Improvement District No. 333, for paving certain streets in the south part of the City. Messers. E. R. Dye, A. J. M. Johnson, Mrs. H. S. Cannon, Mrs. J. C. Whitham, Mrs. C~ B. Swim, Mrs. Jas. Fitzgerald., Mr. .T. R. Jeffers, J. R. Parker, Geo. Gillette, M:. G. Swingle, H. A. Croonquist and others were present to discuss this paving proposal. Mr. Dye, Mr. Johnson and. Mrs. Carmon spoke at length to protest against certain streets in which they were interested being included_in the proposed district. Mr. J. R. Parker and Mr. Croonquist spoke in favor of the district as proposed. It was pointed out by the protestors that, in certain blocks in which they were particularly interested, most owners had already signed p3titions opposing the paving and that these blocks should not be included in the proposed district. Mr. Parker and Mr. Croonquist presented ar- gument,s that these certain blocks in question sho'IJld be included so that the district would not be left partially completecJ; that the dis trict proposed would be large enough so that lower bids should be received for its construction than if it were broken up into small districts; and that there were sufficient signers from every section of the proposed district, asking for its creation, to warrant passage of the resolution of intention so that the entire district would be given a chance to be created on its merits on the basis of the percentage of protests filed against it. It was moved. by Cormnissioner Lake, seconded by Commissior:er Busch thAt the Reso- lution be passed and adoptee} and May 17, 1940 be set as the date for hear:tng protests and May 16th. 1940 as the final date for filing protests and the motion vms carried by the following Aye and No vote; those voting Aye being Mayor Hocy, Commissionor L~(e and Commissioner Busch; those voting No, none. 1.78 Bond of Chief of Police The bond~ Roy C. Embry as Chief of Police in the amount of $2000.00 was presented together wi th a release of the present continuation bond. Petition Request:ing Amemdment to Zoning Ordinance petition for an amemdrnent to the Zoning Ordinance; that the request for an amendmmt to the Zoning Ordinance should come as a recommendation from the Zoning Board. Pet:\. tion for San:1.tary Se'wer The Marnger pre sented a pe ti ti on of 28.9% of the property owners between Larrnne street and Aspen Street on Rouse Avenue requesting that a Special Improvement District be created for the purpose of installing a sani tary sewer.
