Those beine Connnissioner' elect Busch present were Mayor Lake, -';omissioner Chaffin, Commissioner Hoey,ftCity Attorne~r Aitken, Ci ty Manager Henderson, Director of Finance VIal ter Davis, and the Clerk, when the follow.. ing proceedings were had to..wit: The minutes of the last regular session were read and it was moved by Commissioner Chaffin, seconded by Commissioner IIDey that the minutes be approved as read and the motion was carried by the following Aye and No votej those voting Aye being Mayor Lake, Commissioner Chaffin and Commissioner lfueYj those voting No, none. Garba~e OrdInance Harry Beimstroh, L. G. Hines, and others appeared before the Commission to further discuss the proposed Garbage Ordinance. These men were informed that a public hearing on this ordinance had been held on December 30th, 1939, and that it was no t proposed to take defini te action on the ordinance until the new City Commissioner, Mr. A. O'Connell and Glen Thompson, appear" ed before the Commiss ion. Mr. Yillapp, as spokesman for the Commi ttee, explained tha t they were delegated by trill Bozeman Trades and Labor Council to present a request to the City Com.. mission that the wage scale for general laborers in City employ be raised from the presen t scale of 60t per hour to 75rj, per hour to conform to t he scale es tablis hed by Labor Unions in Bozeman. After the Committee had been given full hearing, Mayor Lake explained to them that this was a matter which could not be settled without full consideration. He explained further that the annual tax levy is set in August of each year, that the annual budget is made up in Januar~r on the basis of the levy set in the preceeding AuL,"Us t, and that such a change in wage scale would either necessitate curtailing the amount of City work done or would necessitate a raise in tax levy which could not be done until Au[iUs t, 1940. The Comrni ttee was further informed tha t the Commission would give their request full consideration but tha t no promise could be made to them as to wha taction might be taken in the matter. After examination of the claims in detail by the Commissioners, it was moved by Commissioner Uoey, seconded by 00nnnissioner Chaffin tha t the claims be approved and warrants drawn for their payment and the motion ViaS carried b~l the following Aye and No vote: those voting Awe being Mayor Lake, Commissioner Chaffin and Commiss j"oner Hoey,; those voting No, none. McCay, Cas Fitter's - A letter was presented from the II~nes Realty Company, agents for the Occidental Indenmi ty Co., reques ting tha t tl19. t Company be relieved from further liability under the bond of H. B. McCay, dated DEicember 18, 1936, covering the said H. B. McCay as a Gas Fi tter. Motion was made by Commissioner Chaffin, seconded by Commissioner lfuey, that the City Manager be authorized to \~ite a letter to the Occidental Indemnity Co., releasing them from liability under this bond and tllat the City Manager be instructed to write a letter to H. B. McCay to notify him thc'1 t such bond had been cancelled and that it would be necessary for him to furnish a new bond, as required by Ordinance No. 678A, before his firm could " make fur ther ins tal1a tions of gas appliances in the lii ty, and the motion was carried, Hoey, Lake, Chaffin voting Aye; those voting No, none. Annual l~lldl.i t - C. F . A. The matter of engaging a Certified Public Accountant to make the annual audit of the City's records was discussed. It was moved by Commissioner Chaffin, seconded by Commissioner Hoey, that J. M. Stotesbury be engaged to make the audit, the price for such service to be $265.00 the same a s in the 1939 agreement and the motion was carried,. Hosy, Lake Chaffin voting Xye; those voting No, none. ,:u.l.. l'roject - Te;y:porary Discontinuance and :'~eleDse fro::l Liability The Manager presented a notice from W.P.A. that work under the City sponsored, Park and Boulevard project had been temporarily discontinued and requesting that the City sign a release to 'N.P.A. to relieve them from any liability under the project until the same might be re-opened. Motion was made by Cormnissioner Chaffin, seconded by Com- missioner Roey, that such a release be approved and that the Mayor and the Clerk of the loJonnnission be au thoriz ed to sign such release for t he City and the motion was carried,. Ad ,j Qurnme n t I For the purpose of completing such business as might cone before this commission before the expiration of the terms of office of Mayor Lake and Commis~ioner Chaffin, it was moved by Commissioner Rocy, seconded by Commissioner Chaffin that this meeting be adjourned until 9:30 o'clock A. M. Monday, January 8, 1940, and the motion was carried, Chaffin, TIoey and Lake voting Aye; those voting No, none. Dozeraan, Montana January 8, 1940 9:30 o'clock A. M. The ~ommiasion met pursuant to adjournment. Present: Mayor Lake, Commissioner Commissioner elect Dusch Hoey, Commissioner Chaffin,~ Ci ty Manager Henderson, Gi ty Attorney Aitken. Absent:. Clerk Shadoan, on account of illness. It was moved by Commissioner Hoey, seconded by Commissioner Cr.lS.ffin, tha t during the illness of the regular clerk of the commission, Mr. Shadoan and lmtil further order of the Commission, Miss llachel i.i.urcott, stenographer in the office of the clerk of the commission be designated as acting clerk of the City vommission. The motion was ., carried, all of the comndssioners voting in the affirmative.
