Subchapter 4B Discussion Page 1 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Dennis Taylor, Interim City Manager Martin Matsen, Director of Community Development Greg Sullivan, City Attorney SUBJECT: Decision Regarding Initiation of Process to Affirm and Readopt the Inclusion of Subchapter 4B (Guidelines for the B3 Commercial Character Area) into the Design Guidelines for the Bozeman Neighborhood Conservation Overlay District (NCOD) MEETING DATE: August 14, 2017 AGENDA ITEM TYPE: Action RECOMMENDATION: Consider public comment and determine whether to instruct the Interim City Manager to commence a process that would affirm and readopt the inclusion of Subchapter 4B (Guidelines for the B3 Commercial Character Area) into the Design Guidelines for the Bozeman Neighborhood Conservation Overlay District (NCOD). RECOMMENDED MOTION: I hereby move to direct the City Manager to commence a process that will present the City Commission for its consideration a resolution or ordinance affirming and readopting the inclusion of Subchapter 4B (Guidelines for the B3 Commercial Character Area) into the Design Guidelines for the Bozeman Neighborhood Conservation Overlay District (NCOD). BACKGROUND: Recently, questions have arisen as to the process the City undertook to adopt Resolution 4598 (May 18, 2015) – a resolution that added Subchapter 4B (Guidelines for the B3 Commercial Character Area) into the Design Guidelines for the Neighborhood Conservation Overlay District (NCOD). The purpose of this meeting is to provide the City Commission an opportunity to initiate a process to legislatively reaffirm the action taken in adopting Resolution 4598 that the provisions of Subchapter 4B apply to all properties zoned B3 outside of the Main Street Historic District. In March of 2015, the City Commission requested the City initiate amendments to the NCOD Design Guidelines to address commercial development in the B3 zoning district outside of the Main Street corridor. On May 4, 2015 the City Commission held a public meeting on a report on recommended amendments to the NCOD Guidelines regarding commercial development in the B3 Zoning District. At that meeting, the City Commission made several motions and eventually 46 Page 2 voted to instruct city staff to a resolution to the Commission for formal adoption. See pgs. 7 – 10 of the City Commission Minutes May 4, 2017. Neither this action nor any other action implementing the recommended motion is to be construed as an admission or recognition by the City that it did not properly amend the NCOD Design Guidelines with its adoption of Resolution 4598.
