Black Olive is now a lawsuit. The city will be spending out tax dollars to defend a lawsuit that could have been
avoided. There is a compromise available between the developer and interested groups. As proposed the project is
too tall and too imposing on the street and to its south side neighbors creating one side of a canyon effect that is
the hallmark of impersonal towns and dwarfing the apartment building across the street.. Setting back the top two
floors so they do not overhang the street or the south side is a simple solution that enables a more sensitive
project. This solution is likely to be acceptable to local citizens and create valuable penthouse space for the
developer.
