HomeMy WebLinkAbout1947-01-15 4,a4 Bozeman, Montana January 15. 1947 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, January 15, 1947, at 1:00 o'clock F. M. Those beinG present were Mayor Healy, Commissioner Sorenson, Comndssioner Lowe, City Manager Quimlell, City Attorney Aitken, Street Superintendent Springer and the acting clerk. The following proceedings were had to-wit: The minutes of the last regular session were read and on motion made by Commissioner Sorenson and seconded by Connniss ioner Lowe were approved as read. Bids Considered City Manager Quinnell presented a tabulation of the bids received January 8th for a street flusher and truck, and the matter of awarding; a contract for the purchase of this equipment was care- fully discussed end considered. RepresentativeG of the bidding; firms being fresent, they were invited to make any further statements relative to the equipment they proposed to furnish, as might be of interest. Guaranteed deliveries for flusher and t ruck were as follows: Industrial Equipment Co., May 1st; Western Construction Equipment Co., March 15th; and the Hall-Perry Machinery Co., April 15th. Mayor Healy asked Street Superintendent Willis Springer what he thought of the various pieces of equipment offered; he replied that he preferred Lhe truck with the most rubber under it. Manager Quinnell said to consider the tangent d rive. The Ford Truxmore chassis with a clipper flusher tank was aFferent ly the best buy for the city because of the guaranteed delivery date, the comparatively low price and the fact that the truck could be purchased with eight rear tires support:ing the load. This in spite of the fact that it costs considerably more to get eight wheels under the back and. Mayor Healy pointed out that early delivery was an important factor in favor of the Ford-Western Construction Co. bid. Attorney Aitken remarked that the best is usually the cheapest in the long run. Willis Springer pointed out that driving the flusher out from the factory would be equal to two years work, with no guarantee that there would not be a wreck on the road. Commissioner Lowe stated that he thought Standard Steel is just as good as any of the rest and chearer. Thinks International truck is most rugged but we need a cabover job with more rubber under the load. Conunissioner Sorenson I-'refers an International truck other things being equal. It was finally agreed that we accept the bid of Western Construction Company of Billings for the flusher for $3,150.00 F.O.B. Bozeman, with painting and lettering; included; and also the low bid of ~2, 287.57 on the truck provided that a Truxmore eight-wheel rear end be purchased for the truck, at an additional cost of $1,600.00 and that the following additional equipment be i'urchased for the flusher: Fire l<ighting; ~143.00; Sewering Cleaning & Tree Spraying i,2S.00; and Srrinkling ~1l4.00. And upon motion by Commissioner Sorenson, seconded ty Conunissioner Lowe this agreement was approved by the following aye and nay vote; Mayor Healy, aye; Commissioner Lowe, aye; Cormnissioner Sorenson. aye; and it was so ordered. Mr. Ring representing the Western Construction Co. was then c~led in and notified that his bid had been accepted. Mayor Healy made it plain that we wanted the equipment here just as soon as possible and Mr. Ring promised that it would be done. Hotel Bozeman Application was made by the Hotel Bozeman for a City Beer License and for a Retail Liquor License. Ibe applications were accompanied by a payment of $375.00 as required by Ordinance. Upon motion by Commissioner Lowe, seconded by Commissioner Sorenson, all license applications were approved and the clerk was instructed to issue the licenses. Reports The following reports were read and approved: Annual Report of the Bozeman Cemetery Board for the year 1946. Water Collector's Annual ReF ort for 1946. Director of Finance Walter Davis' Statement of Appropriations & Expenditures for December 31, 1946. Bozeman Free Library, 51st Annual Report. Engineer's Report of Labor and Equipment for December, 1946. Mr. Quinnell reported on the proceedings of the Montana Municipal League at Helena, January 10, 1947. Engineering Loan for Sewage Treatment Flant City Manager Quinnell read a communication from the Bureau of Community Facilities, Seattle, Washington, stating that the City Commission should pass a Resolution accepting the proffered loan, and . the. t copies of the same should be sent to them immediately together with an additional copy of the preliminary Sewage Treatment Refort by Burns and McDonnell. Resolution of acceftance No. 598, frepared by City Attorney Aitken, was then presented and read. end it was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the said Resolution be adopted, the motion carried unanimously and it was so ordered. The understanding being that if it should so happen that the treatment plant could not be built the contemplated loan will not have to be repaid, and that the loan will not draw interest. Training Sohool a~ Airport Commissioner Sorenson said he understood that there is a new training school at the Airport and wondered if they should pay a license. City Manager Quinnell explained that these matters were handled by the City-County Board. S.J.D. No. 343 Bonds The City Manager read a letter from Grande & Co. of Seattle relative to their offer to purchase these bonds as issued. City Attorney Aitken stated that this company required a notice of assessment covering the amount of these bonds, which is something that cannot be ftlrnished at this time, as the exact amount cannot be determined until the work is completed and the final estimate passed and approved. Mayor Healy stated that he thought we had better accept the bid of the Commercial Bank and avoid the time and expense necessary to assemble and furnish the exacting detail required to satisfy outside bond attorneys. He therefore suggested that we have a letter of explanation from the City Attorney and that the same be forwarded to Grande & Co. It was agreed that the amount involved is comparatively so small that a great amount of painfully detailed and relatively expensive legal and clerical work Vlould not be justified unless absolutely essential. In view of the foregoing it was moved by Cornrrdssioner Lowe, seconded by Commissioner Sorenson that the bid of the Commercial National Bank for par and six per cent interest be accepted, and the motion carried unanimously. ~L~ . / ..a.J Acting C er of the ity Conunisslon 486 Bozeman Creek and Chronicle Basement. City Manager Quinnell stated that he had received complaints about flood waters from Bozeman Creek seeping into the basement of Chronicle offices. Mr. Waite. owner of the premises, being particularly anxious that something be done to remedy the situation. After considerable discussion it was decided the. t the city could not assume liability for damaEe in ca.ses of this kind, as Bozeman Creek flows in its natural channel without interference or obstructions of any kind caused by the city. It was eXf:1eined that owners and tenants of the Bozeman Chronicle building have the same rights as other riparian owners and must protect themselves accordingly. Under the circumstances it was deemed inadvisable for the city to spend public funds in an attempt to divert the water from its natural channel as had been suggested. Attorney Aitken called attention to the fact that the stream was there before any buildings were constructed. on what is now Main street. Adjournment There being no further business to come before the Commission, on motion by Commissioner Lowe, seconded by Commissioner Sorenson the meeting adjourned. Attest; Mayor I I- I
