The Commission of The Ci t~T of Bozeman met in regular session in the Commission Room,
Wednesday afternoon, March 5th, 1947, at 1:00 o'clock P.M. Those being present were Mayor
Healy, Commissioner Sorenson, Commissioner Lowe, City Manager Quinnell, City Attorney Aitken,
and the Clerk, when the fo llowing proceedings were had to-wi t:
The minutes of the last regular session were read, and it was moved by Commissioner
Sorenson, seconded by Commissioner Lowe that the minutes be approved as read, and the mo-
tion was carried by the following Aye and No vote; those voting Aye being Mayor Healy,
Commissioner Sorenson and Commissioner Lowe; those voting No, none.
Garb8~e Cans should Be Covered
Mrs. Ken Stimson, Mrs. Hugt Kerr, Mrs. Don Cobb and Mrs. L. Bratvold appeared before
the Commission and reported thAt residence properties near their homes on South Black and
South Seventh did not keep their garbage cans covered and in some cases tenants did not
have sufficient cans to take care of all the garbage from the apartments and consequently
it is scattered over the alleys, and carried onto lawns by dogs. The ladies were informed
that air-tight cans should be provided for garbage disposal and that owners anc tenants
would be notified that they are made liable, jointly and severally, by the proviSions of
the Ci ty' s 0;arbage ordinance for permi tting a nuisance of this kind to exis t.
Beer & Liquor Licenses
Mr. Carter Smyth appeared and ask if the Commission was going to take any action on
applications for additional beer and liquor licenses within the City. Mr. Smyth was in-
formed ths t until a certified copy of the new laws regarding the number of beer and liquor
licenses that can be issued 1n the City is received, no further action in the matter would
be taken by the City Commission.

~fr. .Tohn McCrosson, Fire Chief, appeared before the Commi~ sion in regard to cla lms for
overtime pay for firemen at the Montana Winter Fair and the basketball games at the ~SC
Gym. He stated that firemen had attended these places of public assembly before, but had
not filed claims for pay, but that now they felt that if the policemen were paid for doing
similar work they too should be paid.
Fire Chief ~cCrosson explained that he was of the opinion it was his duty to see that
the exits and doorways at public places of assembly are kept clear; thqt the buildings are
not overcrowded, and that tr:e crowd is kept under control in case of an emergency.
During the dlscuss:1.on that followed, it was br01.1ght out that while it was the duty of
the firemen to make such inspections, it is the duty of the policemen who are peace and law
enforcement officers to see that the City's ordinances are enforced.
City Attorney Aitken pointed out that it was also the duty of the owners of the blJild-
It was further supgested that before the Fire Chief assigns men in his department to
be present at large public gathprings, approval should first be secured from the Ci ty Manager
authorizing such assignments. The Commission, after due consider,gtion, decided that the

current claims of the firemen as presented to this mf'etlng be ordered paid.

The Manager stated that he has alJdited these claims and finds them to be true and
lawful claims against The City of Bozeman and recommends that warrants be drawn for their
payment. After examination of the claims in detail by the City Commission, it was moved
by Commissioner Lowe, seconded by Commissioner Sorenson that the claims be approved and
warrants drawn for their payment and the motion was carried by the following Aye and No
vote; those voting Aye being Mayor Healy, Commi~sioner Sorenson and Commissioner Lowe;
those voting No, non$.

It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the appli-
cations be approved and the licenses issued and the motion was carried by the followine
Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commiss1onor
Lowe; those voting No, none.

Parklnrr in front of Theatres
Chief of Police Haas brou~ht up the matter of restricted parking in front of theatres.
It was pointed Ol1t that in the past it has beer, the policy not to allow parking in front of
local thea tres dlJrtng show hours and to allow space needed for the accomoda tion of crowds,
but that the City is under no obligation to restrict parking for this purpose unles~ the
Department of Safety feels it to be in the uublic interest.
Letter from 0/. ~. Henderson
City Manager Quinnell presented and read a letter frc1'n Mr. M. E. Hender90n containing
the information that he would retllrn to Bozeman and assume his duties as City Manager
October 1, 1947.
