HomeMy WebLinkAbout1947-04-09 464 Bozeman, Mon tana April 9th, 1947 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, April 9th, 1947, at l:OO o'clock P.M. Those being present were Mayor Healy, Commissioner Sorenson, Commissioner Lowe; City Manager Quinnell, City Attorney Aitken, and the Clerk, when the following proceedings were had to-wit: The minu tes of the la s t regular s ess ion were read, and it was moved by Commi ssioner Sorenson, seconded by Commissioner Lowe that the minutes be approved as read, and the mo- tion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Alley In Block A; Black's Addition Mr. Ray Anderson, W. H. Lovelace, Phil Dodson and W. H. Lovelace, Jr., were present and stated that the alley in Block A, Black's Addition was in an impassable condition, and as this alley is in the Business District it should be graveled and graded. They were in- formed that the alley would be maintained by the City, but that any permanent paving im- provement should and would have to be in all probability paid for by the abutting property owners. They were also informed that as soon as the weather permitts, the alley will be graded to fill the ruts and cut down the high center caused by heavy traffic and an exces- siva amount of storm water. Sewer Connection for House on S. Tracy Mr. Phil Dodson also reported that in the same Block, i.e. Block A, Black's Addition on South Tracy, a family is living in one of the samll houses without, sanitary facilities, tha t are being buil tat the carpenter shop in said block. The gentlemen were aksed to re- port the matter to the City-County Health Office. Loading Zone - l27 W. Mendenhall Mr. C. A. Clark, of the Mountain Maid Candies, was present regarding a loading zone at their shop, at 127 West Mendenhall Street. Mr. Clark was informed that a driveway entered this property on the west side and that cars could be prohibited from parking in this driveway so that it could be used for loading and unloading merchandise at this address. Courtesy Tags for Out-of-Town Cars Mr. D. J. DeCosse, H. N. Wheat and Eldon Dahl of the Trade Promotion Committee of the Jr. Chamber of Commerce were present to ask that courtesy tags be given out-of-state and O1Jt-of-county cars in place of over-time parking tags that require them to file a cash bond or report to the Police Court for traffic violations. It was thoul2:ht that in this way the tourist and out-of-town trader would leave Bozeman with a better feeling. It was sug- gested that records could be kept and out-d-town persons who over-park more than a certain number of times fined as local people are fined for over-time parking. Chief of Police Haas explained that courtesy cards were placed on cars for over-night parking and tha t records kept showed tha t many C8rs were repea ters as many as five times. It was also pointed out that local persons objected to being fined for over-time parking when others were not fined for the same Offense. The committee also stated that the Senior Chamber of Commerce favored some plan of welcoming tourists to Bozeman. After considerable discussion, the committee was informed that the matter would be taken under advisement and given attention by the Commission. 1 .1 '. 1- 1 -I .1.' " 4 {' r:~ ,O~) Application for City License The application of the Mountain Maid Candies for a City License was presented and read. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the application be approved and the license issued and the motion was carried by the following ~ye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those vo ting No, none. The applications of the Elks Lodge # 463 for beer and liquor licenses were presented. It was pointed out that the fee for clubs under the new state law is the same as that for retail establishments, and that th:Ls amount should be submitted with the application. Additional Liquor Licenses A communication from Paul W. Smith, Attorney for the State Liquor Control Board, was read, stating that it was his opinion that had the Liquor Contol Board refused to issue t state beer and state liquor licenses to Nybo Realty Company and to E. B. Griffin, the court would have issued a writ of mandate and required the Board to issue them, because of the way courts were deciding these cases. Discussion of the issuing of the city licenses to Nybo Realty Company and to E. B. Griffin followed and the Commission was in doubt as to its authority to issue these licenses as the City has already issued more licenses than are authorized by the present law. The Ci ty Attorney said tha t an a dvanc e 8 ta tameD t of the law could be oba tined through the Declaratory Judgment Act, 80 the City would know their position and would not do anything that they C01Jld not legally do. The City Attorney also advised that the applications now on file were incomplete, and that in his opinion the applicants should be notified to file new and more complete applications before the City Commission acts on the applications. It was thereupon, moved by Commis sioner Sorenson, seconded by CommiSSioner Lowe tha t as advised by the City Attorney, E. B. Griffin and Nybo Realty Company be notified to file new applications for City Beer and Liquor Licenses as their first applications now on file, are not legally sufficient, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Purchase of Jeeps The City Manager reported that as ins truc ted he had made careful inquiry a tall available sources, and that the lowest and best bid obtainable for the purchase of two Jeeps for use by the Street and Cemetery Departments and as snow plows, was $l350.00 each. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson tha t the Ci ty Manager be au thorized to purcha se two Jeeps a t the above price and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Kalman & Company to Buy Revenue Bonds The City Manager read a comnrnnication from Kalman & Company of Minneapolis stating tbat they would purchase $250,000.00 of Sewer Revenue bonds from The City of Bozeman at the price formerly ~uoted, to be used in the financing of a sewage disposal plant. Commissioner ~owe asked to be excused and permission was granted Reports The following reports for the month of March, 1947 were presented aDd read: Engineer . Director of Finance Cemetery Board Cashier 466 It waS moved by Commissioner Sorenson, seconded by Mayor Healy that the reports be ac- cepted and ordered filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Quit-Claim Deed to Vacated Strip on 8th Ave. The Manager reported that Ordinance No. 648, adopted April 27th, 1934, provided for the vacation of a six-foot strip of ground adjoing all property on ~ighth Avenue from Main Street to Harrison Street. He presented a quit-claim deed from The City of Bo?eman to T. B. and Katharine F. Story of this six-foot strip adjoining Lots 8 &: 19; BlockF; Story's Addition, to clear the title to this property, already vacated by said Ordinance. It was moved by Commissioner Sorenson, seconded by Mayor Healy that the Mayor and the Clerk of the Commission be authorized to sign the quit claim deed for The City of Bozeman and the motion was carried b~' the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson; those voting No, none. Street Markers The Manager presented sample sign to be used at corners for marking street names in the City. He stated that the signs could be made in the city shops and one sign would be placed at a busy, prominent corner for public approval before the signs are made. Carnival for Jaycee Roundup It was reported that the Jounior Chamber of Commerce had made inquiry regarding the waiving of the license fee for a carnival to show during the annual Roundup, August lst, 2nd, and 3rd. The Clerk was instructed to write the Jr. Chamber of Commerce advising them that the City Commission had decided not to waive the license fee for any future carnivals, and also that the City should be advised of the name of the carnival and be furnished with all data necessary to help city officials check on the carnival organization. Ad j ournmen t There being no further business to come before the Commission at this time, it was moved by Commissioner Sorenson, seconded by Commissioner Healy that the meeting adjourn and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none.
