The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Wednesday afternoon, May 28th, 1947, at 1:00 o'clock P.M. Those beIng
present were Mayor Healy, Commissioner Sorenson, Commissioner Lowe, City Attorney Aitken,
and the Clerk, when the followin~ proceedings were had to-wit:
The minutes of the last re~llar session were read, and it was moved by Commissioner
Sorenson, seconded by Commissioner Lowe that the minutes be approved as read, and the motion
was carried by the following rlye and No vote; those voting Aye being Mayor Healy, Commis-
sioner Sorenson and Commissioner Lowe; those voting No, none.
Reports
The following reports for the month of April, 1947 were presented and read:

It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the reports
be accepted and ordered filed and the motion was carried by the following Aye and No vote;
those voting Aye being Ma~Tor Healy, Commissioner Sorenson and Commis"'ioner Lowe; those
voting No, none.
Applications for City Licenses
The following applications for City Licenses were presented and read:

It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the appli-
cations be approved and the licenses issued and the motion was carried by the following
Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner
Lowe; those voting No, none.
Resolution No. 602 Intention to Create S.I.D. No. 346
The City Attorney ae instructed presented and read, the reso lution of intention to
create Special Improvement District No. 346, for the purpose of installing a sanitary sewer
to service Blocks Nos. 5, ll, l2 and the North one-half of Block 6; Springbrook Addition,

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING
IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DIS-
TRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT
NUMBER 346 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING OF A SANITARY SEWER
ON WEST LAMME STREET, IN SAID CITY, FROM THE CENTER OF NINTH AVENUE, NORTH,
WESTWARD TO THE CENTER OF THE ALLEY BETWEEN TENTH AND ELEVENTH A VENUES, NORTH,
THENCE SOUTH ALONG SAID ALLEY TO THE CENTER OF MENDENHALL STREET, AND TO
SPECIALLY ASSESS THE COST THEREOF AGAINST THE PROPERTY WITHIN THE BOUNDARIES OF
SAID SPECIAL IMPROVEMENT DISTRICT, ON THE AREA BASIS, EXCLUSIVE OF STREETS,
AVENUES, ALLEYS AND PUBLIC PLACES, PURSUANT TO 'IRE STATUTES IN SUCH CASE MADE
AND PROVIDED
It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the Resolu-
tion be passed and adopted and June 25th, 1947 be set as the date for the hearing of pro-
tests and the motion was carried by the following Aye and No vote; those voting Aye being
Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none.
Lease of Gravel Pit
An Agreement by and between Helen Doran and The City of Bozeman to lease a gravel pit
for a period of five years, from May 20th, 1947 was presented and read. The amount of the
cons idera ti on of the lease belng $75 ~ 00 and the sale of the gravel from the pit to be 2tJi'
per cubic yard.
After consideration of the lease as presented, it was moved by Commissioner Lowe,
seconded by Commissioner Sorenson that the Mayor and the Clerk be authorized to sign the

the Agreement for The City of Bozeman, and the motion was carried by the following Aye and
No vote; those voting Aye being Mayor Healy, Commissioner ~orenson and Commissioner Lowe;
those voting No, none.
Reauest of Montana Power Company for Ground-bed
A written request from the Montana Power Company signed by Mr. C. R. Davis, Cathodic
Protection Engineer, requesting permission from The City of Bozeman to make installations
of groundbeds within the City for the protection of their gas distribution mains was pre-
sented and read. Mr. Murdock and Mr. Davis of the Montana Power Company were present
and explained that it was the desire of the Montana Power Company to install one ground-bed
in the parking strip in Eighth Avenue from Koch Street to College Street, and to install
another groundbed on West Peach Street, otherwise known as Durston Road, between Third
Avenue and Seventh Avenue.
After consideration, it was moved and seconded that the request be granted subject to
a letter from the Montana Power Company signed by someone wi th the authori ty to bind the
Company, agreeing that in consideration of such permission the Company will hold and save
the City harmless from any and all loss or damage arising from said installation, and that
those in charge of the opera tions will consul t wi th the Ci ty Engineer so tha t the ins tal-
lation may be made in so far as possible without interference with present or contemplated
sewer or water lines within the City, and the motion was carried by the following Aye and
No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe;
those voting No, none.
Use of Armory Building by National Guard
Communications from the Chairman of the Montana Armory Board to Col. W. R. Rankin of
the local Na tiona 1 Guard wa s read au thoriz ing him to occupy certain quarters in the Armory
Building and to erect and occupy offices in the Drill Hall; and a communication to the
City Manager advising that no charge is to be made the National Guard for the use of the
building was also read.
A copy of a letter from the Gity Attorney to the Montana Armory Board stating that he
has advised the City Manager that the action of the Armory Board is in violation of the
terms of our lease wi th the Board, and amounts to an ous ter of the City was also read.
The communications were ordered filed, and no action was taken by the City Commission.
Reques t for Light a t Housing Uni t
A request for a light in the middle of the block located on North Tracy at the Veteran's
Housing unit was reported, and the Commission stated that the lighting of the housing unit
was not required by the City in their contract.
Resignation of Cit:"y Attorney Aitken
The written resignation of Walter Aitken, as City Attorney, to be effective June 30th,
1947, was presented and read. MajOr Healy expressed the regret of the City Commission in
losing the services and wisdom of Ci ty A ttorney Aitken, and s ta ted tha t the Ci ty of Bozeman
had been fortunate in havlng his services for so long a period.
Appointment of Judges for Special Election
The City Commission announced the appointment of the following Judges, who will act
as their own clerks, for the Special City Election to be held, June 24th, 1947:
