The CommisRlon of The City of Bozeman met in regular session i.n the Commission Room,
City Hall BuildIng, Wednesday afternoon, September 25th, 1946, at 1:00 o'clock P.M. Those
be!ng present were Mayor Healy, Commissioner Lowe, Commissioner Sorenson, City Manager
Quinnell, City Attorney Aitken, Director of Finance Walter Davis and the Clerk, when the
following proceedings were had to-wit: I
The minutes of the last regular session were read, and it was moved by Commissioner
Lowe, seconded by Commissioner Sorenson that the minutes be approved as read, and the mo-
tion was carried by the following Aye and No vote; those voting Aye beingMayor Healy,
Commissioner Sorenson and Commissioner Lowe; those vo ting No, none.
Application for City License
The applica tion of the Ark Second Hand Store :for a one-half year ci ty license was
presented and read. It was moved by Commissioner Sorenson, seconded by Commissioner
Lowe that the application be approved and the license issued and the motion was carried
by the following Aye and No vote; those voting Aye bel_ng Mayor Healy, Commissioner Lowe
and Commissioner 0orenson; those voting No, none.
Culvert Between Babcock & Olive on Ilth.
A communication to A. B. and Margaret Taylor and Hazel M. Hill owners of property
west of Eleventh Avenue and upon whose p~operty the Springbrook ditch runs was read, s ta ting
that after careful investigat10n by city officials, it had been determined that any res-
ponsibility and/or liability for damage which might be caused by this ditch would not be
that of the City of Bozeman, as the ditch is not in the city, and that therefore any such I
responsibility or liability must rest upon the owners and users of the ditch and the owners
of the property upon which it is located.
Sewa~e Treatment Plant
Communications to and from Burns and McDonnell were read relative to the sewage treat-
ment plant for Bozeman, the construction of a cut-off wall to lessen the underflow beneath
the city to relieve the present infiltration of water into the sanitary sewer system.
After discussion, Tuesday, Oc tober Is t, 1946 at 2:00 o'clock P.M. was set as the date
for another conference wi th ttle consul ting engineers and the Sta te Board of Heal th
authorities and discuss plans for a sewa~e trea tment plant and if possible to lower -the
construction and maintenance cost as first proposed in the report of Burns & McDonnell.
Communication - County Attorney
A communication was reed from E. A. Peterson, County Attorney stating that, in his
opinion, the Board of Trustees of School District & is not empowered to request boys and
girls under 16 years of age to serve as traffic patrolmen during school hours.
Pe ti tionf'or S. I. D.
A petition of property owners requesting that a special improvement district be cre- I .
ated for the construction of a sani tary sewer on West Lamme to the alley between lOth and
llth Avenues and thence south in said alley to Mendenhall Street was presented and read.
The matter of preparing the resolution of intention to create the district was held in
abeyance until the return of City Attorney Aitken who is on vacation.
