December 18th, 1946
The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Wednesday afternoon, December 18th, 1946, at 1:00 o'clock P.M. Those
being present were Mayor Healy, Commissioner Sorenson, Commissioner Lowe, City Manager
Quinnell, City Attorney Aitken, and the Clerk, when the following proceedings were had to-wit:
The minutes of the last regular session were read, and it was moved by Commissioner
I Sorenson, seconded by Mayor Healy that the minutes be approved as read, and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner
Sorenson and Commissioner Lowe; those voting No, none.
Appllc~tions for City Licenses
The following applications for City Licenses were presented and read:

and the following applications for City Beer & City Liquor Licenses were also presented & read:

It was moved by Commissioner Sorenson, seconded by Mayor Healy that the applications be
approved and the licenses issued and the motion was carried by the following A~ and No vote;
those vo ting Aye being Ma yor Healy, Commissioner Sorenson; those voting No, none.
Report
The report of the Plumbing Inspector for the month of November 1946 was presented and
read. It was moved by Commi ssi oner Sorenson, seconded by Commissioner Healy tha t the re-
ports be accepted and ordered filed and the motion was carried by the following ~ye and No
vo te ; those voting Aye b eing M~"or Healy and Commissioner Sorenson; those voting No, none.
I Skating Rink to Open
The Manager reported that weather permitting, the skating rink would open at 3:30 P.M,
December 20th, and that the hours and admission charges would be the same as last year.
S.I.D. 341 Water Mains
Mr. Roy Malsor, of the Standard Construction Company, Contractor fo~ the improvements
in S.I.D. No. 341, appeared before the Commission and explained that the cost of the
materials he had ordered for use in the construction of this improvement had risen to such
an extent tha t in some cases the manufacturer's prd.ceswere well above the price quoted
to the City, by the Contractor, in his bid. He asked if there was any way that the City
could protect him on this price raise, and that the District would receive the benefits of
any reduction in price. The matter was referred to the Ci ty Attorney, to see if anything
could be worked out whereby the city could finance all or any part of the increased cost
in addition to the prices quoted in the contract.
Commissioner Lowe entered and was noted present
Public Hearing -- Vacation of portion of Hayes Street
I The Manager stated that this was the time and place set for the hearing of protests
to the vacation of Hayes Street from Willson Avenue east to the East City Limits. The
Manager presented and read the affidavit of publication of the Notice and stated that the
abutting owners had been served with a notice of the, proposed vacation as required by law.

Mr. T. G. Ta te , George Gillette end T G. Taylor, owner of lots in the blocks adjoining
the proposed vacated street were present and protested said vacation of Hayes Street. They
stated that if the street was vacated there would be no means of entry to the rear of their
property, if' and when an alley could be provided, and that consequently garbage cans would

have to be placed on the street, which would be very unsightly and undesirable. The ma t ter
was taken under advisement.
Agreement -- Bozeman C8nning Co. Use of City Sewer
Mr. Roy Spain of the local pea cannery was present and ask that the agreement between .
The City of Bozeman and the Bozeman Canning Company for the cannery to use the ci ty sewer,
which expired July 16th, 1946, be extended until January 1948 so they would be assured of I
this service through next year's pack. As it has not been determined just what action will
be taken by The City of Bozeman in the matter of the construction of a Sewage Treatment
Plant during the coming year, it was thought that probably the present agreement could be
renewed for an indefinite period or until such time as City and State authorities arrive
a t a sa tis:fac tory solution of the Bozeman sewage treatment problem and to allow all of the
provisions of the former agreement to continue until that time. It was moved by Commis-
sioner Lowe, seconded by Commis sioner Sorenson the t the ms tter be referred to the Ci ty A t-
torney for advisement and the motion was carried by the following Aye and No vote; those
voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; thos e votlng
No, none.
Alr Mail Box at Bennett Agency
The matter of placing an Air Mail letter drop box in front of the Bennett Agency was
considered, and it was thought that the request could be granted provided it is made by
the Post Office Authorities.
Use of Rifle Range
The Manager reported tha t the Bozeman Rifle Club had requested use of the Rifle Range I
once or twice a week. After consideration, it was decided that the request be granted sub-
ject to the approval of the Chief of Police and the Custodian of the building and doesnot
interfer with the City's use, that it be used at the Bozeman:Rifle Club's own risk, and
provided further that the permission hereby granted may be withdrawn by the City Commission
at any time.
Bond & Contract SID No. 341.
The bond and contract of the Standard Construction Company for the construction of
water and sewer i~provements in S.T.D. No. 341 were presented. The bond and contract were
approved as to form by the City Attorney, whereupon, it was moved by Commissioner Lowe,
seconded by Commissioner Sorenson that the b0nd and contract be accepted and approved and
the motion was carried by the following Aye and No vote; those voting Ay"e be ing Mayor Healy,
Commissioner Sorenson and Commissioner Lowe; those votlng No, none.
Bond and Contract SID No. 342
The bond and contract of the Standard Construction Company for the construction of
sewer improvements in S.I.D. No. 342 were presented. The bond and contract having been
approved as to form by the Ci ty Attorney, it was moved by Commissioner Lowe, seconded by I
Commissioner Sorenson that the bond and contract be accepted and approved and the motion
was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commis-
sioner Sorenson and Commissioner Lowe; those vo ting No. none.
Bond & Contract SIn No. 344
The bond and contract of Edens and Lee for the construction of water main improvements
in Special Improvement District No. 344 were presented. The bond and contract were approved

as to form by the City Attorney, whereupon, it was moved by Commissioner Sorenson, seconded
by Commissioner Lowe that the bond and contract be accepted and approved and the motion was
carried by the following Aye and No vote; those voting Aye belng Mayor Healy, Commissioner
