We the undersigned, owners of the real property situated in
the County of Gallatin, State of Montana, and more particularly `
described as follows :
Lots 1, 2, 3 & 4, Block 2, Kable Subdivision
IN CONSIDERATION of receiving permission to connect with the
City of Bozeman 's sanitary sewerage and water systems and for
other and valuable consideration, the receipt of which is hereby
acknowledged, have waived and do hereby for ourselves, our heirs,
executors, administrators, personal representatives, successors
and assigns, waive our right to protest the annexation or to file
written disapproval in response to a duly passed resolution of
intention to annex the above-described property to the City of
Bozeman .
We Acknowledge that the above-described property is subject ti
to payback fees from the Daum Sewer and H . R.D .C . water and sewer
improvements . These fees are to be determined and paid prior to
connection to City of Bozeman Services .
This waiver shall be a covenant running with the land and
shall not expire at our death.
We warrant that we are lawfully seized and possessed of the
real property above and that we have a lawful right to convey the
property or an art of it .
