HomeMy WebLinkAbout1946-07-12 a-iO Boz emen, Montana Jul y 12 th, 1946 The Commission of 1he City of Bozeman met in regular session in the Commission Room, City Hall Building, Friday evening, .July 12th, 1946, at 7:30 o'clock P.M. Those being present were Mayor Healy, Commissioner ~orenson, Commissioner Lowe, Ci ty Manager <itJinell, City Attorney Aitken, Director of Finance Walter Daivs, City En~ineer Thorpe and the Clerk, when the following proceedings were had to-wit: The minutes of the last regular session were read, and it was moved by Commissi oner I Lowe, seconded by Commissioner Sorenson that the minutes be approved as read, and the mo- tion was carried b~T the followin'7Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. City Rent Control ~r. Dan Lovelace and J. P. Campbell representing the American Legion appeared to in- quire if anything could be done by the City regarding rent control, in the absence of any rent control by the Federal Government, or if the Commission would sponsor a meeting of the real estate men in the Ci ty to cons ider the problem of ren t con trol. It was thought that action on the OPA bill mow before the u. S. Congress would be taken within a week, and that this bill would contain some form of rent control. Mr. Leo Koopman of the Evergreen Apartments was present and s ta ted he favored- some form of rent control but thought the landlord should have some eviction privileges under any rent control law, so thst undesirable tenants could be made to move 01J t . Parking strip at Lyall Hotel Mr. Dan Lovelace stated tha t the parking strip for loadln~ and unloading at the Lyall Hotel was used by local persons most of the time, and the t the op!"ra tor of the Hotel could I not get taxi service because the unload:l.ng and loading zone was occupied. The Commission s ta ted that they felt the parking meters could help solve this parking problem. Application for City License The followirg applications for City Licenses were presented and read: Bon Ton Bakery Bon Ton Flour Mills It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the appli- cations be approved and the licenses issued and the motion was carried by the following Aye and No vo te; those voting Aye being Mayor Healy, Commissioner Soren~on and Commissioner Lowe; thos e voting No, none. Request for Grocery Store -- 4~9 N. Willson A written request from Raymond S. Whitmore to operate a grocery store at 409 North Willson, located in the "D" Residence Di8trict was presented and read. It was moved by Commissiorer Lowe, seconded by Commissioner Sorenson that the request be referred to the Board of Adlus tmen t and the motion was carried b'" the following nye and No vote; those voting Aye being Mayor Healy, Commi"sioner Sorenson snd Commissioner Lowe; those voting No, nonl Bid for Cast Iron Pipe The Manager stated that this was the time and place set for the opening of bids for a carlOad of cast iron pipe. He presented and read the affidavit of publication of the Notice to Bidders, whereupon, it was moved by Commissioner Sorenson, seconded b:,," Commis- sioner Lowe that the bids be opened and read, and the motion was carried by the following 'Aye and No vo te; tho~e voting Aye being Mayor Healy, Commissioner Lowe and Commissioner Sorenson; those voting No, none. 3'71 The bid of the Pacific States Cast Iron Pipe Company being the only bid received was opened and read and found to be as follows: 1850' 6"x18' pipe $ 1.24 per foot 20 611 Sleeves $ 6.45 each 615' 4"x18' pipe .83! per foot 15 4" Sleeves 3.66 each 10 6x4" Crosses 15.45 each 10 4" Plugs .83 each 6 611 Tees 13.90 each Shipment to be made within approximately 225 days, and the Company reserved the right to I adjust all prices of materials to prices in effect at the time of shIpmen t. The bid was taken under advisement. Resolu tion No. 577 -- Li~hting Assessment The Manager s ta ted tha t the resolu tion levying the lighting assessmen t for the year 1946, in the amount of $2,296.02 had been prepared. He presented and read Resolution No. 577, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZH~MAN, MON'l'ANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRSNT COSTS FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS NUYB~RS 100, 284, 288, 289, 290, 295 AND 300 OF THE CITY OF BOZRMAN, PURSUANT TO THE PROVISIONS OF SECTION 5266 R.CM. 1935 It was moved by Commissioner Sorenson, seconded by CommiSSioner Lowe that the Resolu- tion be provisionally passed and July 19th, 1946 be set as the date for hearing protests, and the wotion was carried by the following Aye and No vote; tho~e votIng Aye being Mayor Irea 1 y, Commissioner Sorenson and Commissioner Lowe; those vo ting No, none. Resolution No. 578 -- Sprinkling Rssess~ent The Manager stated that the resolution levyin~ the assessment for street sprinkling for the year 1946 had been prepared, in the amount of $756.03. He presented and read Reso- I lu tion No. 578, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZT<;MAN LEVYING AND ASSESSING A SPECIAL ASS~SSMRNT OF TAXES UPON ALL OF' THE PROPERTY IN STRRET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STliTE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF TIm COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YRAR 1946. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the resolu tion be provisionally passed and July 19th, 1946 be set as the date for hearing protests and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those v oting No, none. Reports The following rerorts for the mon th of ,Tune, 1946 were presented and read: Director of Finance Nursery School and the quarterly report of the Ci ty Mana ger for the ''JUarter ending June 30th, 1946. It was moved by Commissioner Lowe, seconded by Commis ooner Sorens on tha t the re por ts be accepted and ordered filed and the motion was carried by the following Xye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissior'er Lowe; those votlng "Po, none. I Petition For S.I.D A petition of property owners requesting sewer and water to serve all the property not now serviced sou th of Koch Street in the Wes t Side Addi tion was presen ted and read. It was decided that before a resolution of intention to create the district is ordered prepared and advertisements made that some assurance be obtained from Geo. B. Concs, who is thA owner of record of a lar~e percentage of the property, that he will not protest the creation of this district. Water Service to McFarland Pole Pla~~ 317~2 Wa tor Ser1rlce to McFarland Pole Plant A communication from P. ,J. Seifert, local srren t for the N. P. Railway Company was read s ta ting the N. P Railway did not wish to join wi th the Ci ty in the improvement dis- trict for a water line to service the McFarland Pole Plant located on the N. F. property. A communication from the City Manarrer to the City Attorney was read asking about the City's liability in CBse of damarre to railroad property that might be caused by the proposed I water line and the matter of using: public f'lmds for improvemen ts to private property. The ma tter was turned over to the City Attorney for further inquiry with N. P. authorities. Ordinance No. 739. Amending Zoning OrdInance ordinance No. 739, amendin g the Zoning Ordinance pursuant to the recommendations of the Board of Ad1ustment at their meeting of June 27th, 1946 which recommendations was that all property west of Eleventh Avenue be included in the "B" Residence District was presented and read. It was moved by Commissioner Sorenson, seconded by Commissioner Lowe tha t the Ordinance be conditionally approved subject to final approval on the 26 th da y of .July, 1946, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commis~ioner Lowe; those voting No, none. Misc. W & C 1946 The City Manager reported that Mr. D. s. W111iams, had protested the order for School DistrIct No.7 to constrllct a sidewalk abutting school property between Eighth and Ninth Avenues on Dickerson Street.
