HomeMy WebLinkAbout1946-07-26 37- Bozeman, Montana ' . ,t) July 26th, 1946 The Commission of The Ci ty of Bozeman met in regular session in the Commission Room, Friday evening, July 26th, 1946, ~t 7:30 o'clock P.M. Those being present were Mayor Healy, Commissioner Sorenson, Commissioner Lowe, City Manager Quinnell, City Attorney Aitken, Director of Finance Walter Davie, City Engineer Thrope and the Clerk, when the following I proceedings were had to wit: The minutes of the last regular session were read, and it was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the minutes be approved as read, and the mo- tion was carried by the following ~ye and No vote; those voting Aye being Mayor Healy, Commi8s!oner Sorenson and Commissioner Lowe; those voting No, none. Parking Meters Mr. Heber Porter, President of the Chamber of Commerce, was presen t and s to tad tha t the Board of Directors of his organization would like to suggest that an educational program be carried on thru the local newspapers, informing the publiC of the advantages of and the purpose of the parking meters now being installed; that parking lots be provided for the public and that as long as the installation of the meters is not a revenue measure, any revenue derived from the meters be spent on improving parking facilities with public rest rooms. Mr. Porter stated that in his opinion such a publicity program would lessen the grief and opposition to the installation of the parking meters now being voiced by people who are opposed to this method of traffic regulation and who, judging from street talk, seem to I have quite a following. The Commission stated they were agreeable to some advertising to inform the publiC as to the purpose of the meters, and Mr. L. Malone, of the Chronicle, stated he would prepare such an advertisement. The Commission stated that an effort had been made to lease some lots for off.street parking and that negotiations for this purpose would be pushed. Mr. M. P. Scheurer was present to ask about loading and unloading zones for business places that do not have a rear entrance. Mr. ~chaurer was informed that this policy had not been definitely determined but that the Commission was proceeding cautiously and that all necessary steps would be taken to protect the interests of all concerned. Mr. R. C. Daniels, of the Dual Parking Meter Company was present and told how other cities tha t have parking meters handle traffic and parking problems. Application for City License The application of the Lorraine Beauty Shop for a City License was presented and read. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that this application be approved and the license issued and the motion was carried by the following Aye and No vo te ; those v oting Aye being Mayor Healy, Commdssioner Sorenson and Commissioner Lowe; I those voting No, none. Reports The following reports were presented and read: Health Officer for June, 1946 Annual Report of the Fire Chief It was rn,oved by Commissioner Sorenson, seconded by Commissioner Lowe that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. 376 Communication -- G80. B. Cones A communication from Geo. B. Cones was read, stating that as he has sold all the prop- erty he owns in the West Side Addition either on contract or for cash, that he does not feel he has the right to protest the creation of any improvement district to be assessed against this property. The City Attorney stated that Mr. Cones as the legal owner was the only one who has the right to protest, and that he shou1d':make a statement that he will not protest I the creation of the improvement district for sewer and water extension in this district. Resolution No. 580. -- Creating S.I.D. No. 341 The Manager stated that the City Attorney as instructed had prepared the resolution creating Special Improvement District No. 341, for the installation for a water main and a sanitary s~wer to serve the properties from Grant to Lincoln Streets on Willson, Grand and Fourth Avenues, and on Third Avenue from Garfield to Lincoln and on Fifth Avenue from Hayes to Lincoln. He presented and read Resolution No. 580, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVE- MENT DISTRICT NUMBER 341" OF SAID CITY PURSUANT TO COMMISSION RESOLUTION NO. 574 OF SAID CITY DECLARING THE INTENTION OF SAID COMMISSION TO CREATE SAID SPECIAL I~PROVEMENT DISTRICT NO. 341 FOR THE USES AND PURPOSES SET FORTH AND DETAILED IN SAID COMMISSION RESOLUTION NO. 574 ON FILE IN TIm OFFICE OF THE CLERK OF SAID CITY COMMISSION AND OPEN TO PUBLIC INSPECTION. It was moved by Commissioner Lowe, seconded by Commis s1 oner Sorenson tha t the resolu- tion be passed and adopted and August 28th, 1946 be set as the date for the opening of bids and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Resolution No. 581 -- Creating SID No. 342 I The Manager stated that the City Attorney as instructed had prepared the Resolution creating Special Improvement District No. 342, for the installation of a sanitary sewer in the alley between 11th and 12th Avenues from Story to the east and west alley in Block 24 of the Glendale re-arrangement of the West Side Addition. He presented and read Resolution No. 581, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVE- MENT DISTRICT NUMBER 342" OF SAID CITY, PlffiSUANT TO COMMISSION RESOLUTION NO. 575 OF SAID CITY DECLARING THE INTENTION OF SAID COMMISSION TO CREATE SAID SPECIAL IMPROVEMENT DISTRICT NO. 342 FOR THE USES AND PURPOSES SET FORTH AND DETAILED IN SAID COMMISSION RESOLUTION NO. 575 ON FILE IN THE OFFICE OF THE CLERK OF SAID CITY COMMISSION AND OPEN TO PUBLIC INSPECTION. It was moved by Commis sioner Sorenson, seconded by Commissioner Lowe tha t the Resolu- tion be passed and adopted and August 28th, 1946 be setae the date for the opening of bids for the construction of said district and the motion was carried by the following Aye and q No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Ordinance No. 739 .- Amending Zoning Ordinance No. 711. The Manager stated that this was the time and place set by the City Commission at a ,I regular meeting July 12th, 1946, for the final passage of Ordinance No. 739, amending the Zoning Ordinance as recommended by the Board of Adjustment. He presented and read Ordi- nance No. 739, entitled: AN ORDINANCE AMENDING SECTIONS VII, VIII, IX AND XI OF ORDINANCE NUMBER 711 OF THE CITY OF BOZEMAN, THE SHORT TITLE OF WHICHIS "THE ZONING ORDINANCE," SO AS TO ALTER THE BOUNDARIES OF BUSINESS DISTRICT NO. "2", THE BOUNDARIES OF "B" RESIDENCE DISTRICT, THE BOUNDARIES OF "c" RESIDENCE DISTRICT AND THE BOUNDARIES OF "D" RESIDENCE DISTRICT AS DEFINED IN SAID "THE ZONING ORDINANCE", AS AMENDED BY ORDINANCE NUMBER 735 AND REPEALING SAID ORDINANCE NUMBER 735 OF THE CITY OF BOZEMAN, AND ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. 3'n It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the Ordinance be passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Public Hearing Resolution No. 579 I The Manager stated that this was the time and place set for the hearing of protests to the levying of the assessment for the maintenance of parkings for the year 1946. He presented the affidavit of publication of the Notice, and stated that no protests had been filed and no one was present to protest. He presented Resolution No. 579, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEY.AN, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, FOR THE MAINTENANCE OF PARKINGS TO DEFRAY THE COST OF MAINTAINING THE PARKINGS WITHIN SAID SPECIAL IMPROVEMENT DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1946 It was moved by Commissioner Sroenson, seconded by Commissioner Lowe that the Resolu- tion be finally passed and adopted and the motion was carried by the following Aye and No votej those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Employees Retirement The City Manager ,reported that a representative of the Montana Public Employees Retirement Association would appear at the next meeting of the Commission, July 31st, to explain the Montana Employees Retirement Act. Bulk StoraITe Tanks I Mr. A. W. Coleman, presented a sketch of the property owned by Pete Krudde, 302 N. 7th, showing proposed bulk storage tanks. He stated that Mr. Krudde would like permia- sion to place these tanks underground in part of the street area. After discussion, the Commission stated that a permit for this purpose should not be issued. Ad,journment There being no further business to come before the Commission at this time, it was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the meeting adjourn and the motion was carried by the following ~ye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none.
