August 7th, 1946
The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Wednesday afternoon, Augus t 7th, 1946, at 1:00 o'clock P.M. Those
being present were Mayor Healy, Commissioner Sorenson and Commiss1.oner Lowe, Ci ty Manager
Quinnell, Ci ty A ttorney Aitken, Direc,tor of Finance Walter Davis and the Clerk, when the
following proceedings were had to-wit: I
The minutes of the last regular session were read, and it was moved by Commissioner
Sorenson, seconded by Commissioner Lowe that the minutes be approved as read, and the mo-
tion was carri ed by the followinp: Aye and No vote; those voting Aye being Mayor Healy,
Commissioner Sorenson and Commissioner Lowe; tho se voting No, none.
Garbage Collection -- 626 East Peach
Mrs. Vesta Balbi, 626 East Peach, was present and reported that the garbage was not
being hauled from her property; that she has set it out, after talking to the Commissi on in
May, but the garbage is not collected. Mrs. Balbi was informed that the matter would be
investigated and talked over with the new contractor to see what can be worked out.
Claims for the Month
Claims Nos. 10683 to 10885 inclusive were presented on the various funds as follows:

The Manager stated that he has audited these claims and finds them to be true and
lawful claims against The City of Bozeman and recommends that warrants be drawn for their
paymen t. After examination of the claims in detail by the City Commission, it was moved
by Commissioner Lowe, seconded by Commissioner Sorenson that the claims be approved and
warrants be drawn for their payment and the motion was carried by the following Aye and
No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe,
those voting No, none.
Reports
The following reports for the month of July, 1046 were prefented and read

be accepted and ordered filed and the motion was carried by the following Aye and No vote;

Request to Move Grocery store I-
A written communication from Garvan L.Wiman, 702 W. Babcock was presented and read,
which said communication asked if the moving of his present grocery store located at 702
West Babcock to 622 West Babcock would be in violation of the Zoning Ordinance, s ta ting
that his store as at present 10c8ted was established before the adoption of the present
Zoning Ordinance. Mr. Wiman who was present explained tha t he wanted to move his business
across the street, and that he would like a ruling from the City Commission as to his

right to do so under the provisions of the Zoning Ordinance, before trying to move. City
Attorney Ai,tken stated he had investigated the matter, and in his opinion, the store having
been established in that zone, before the adoption of the Zoning Ordinance was adopted is
not operated in violation to the Zoning Ordinance; and that moving this grocery business
to some other location within the same zone would not constitute a violation of the Zoning
I Ordinance. The City Manager stated that in his opinion, a license granted to operate the
said grocery business at its present address was granted for the conduct of a business that
had been established at a specific location prior to the passage of the Zoning Ordinance,
and tha t the moving of this grocery s tore to a new loca tlon even in the same "B" Residence
District would be a violation of that Ordinance. After further discussion, the matter was
referred to the City Attorney for a written opinion.
Ordinance No. 740 -- Appropriation Orrtinance
The City Manager presented and read the appropriation Ordinance for the fiscal year
ending June 30th, 1947, and presented said Appropriation Ordinance No. 740, entitled:
AN ORDINANCE APPROPRIATING MONIES FOR THE SUPPORT AND MAINTEN~NCE, ETC., OF
THE MUNICIPAL GOVf~RNMENT OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING
JUNE 30th, 1947.
It was moved by Commissioner Sorenson, seconded by Commi~sioner Lowe that the Ordi-
nance be provisionally passed and August 14th, 1946 be set as the date for public hearing,
and August 21st, 1946 be set as the date for final passage, and the motion was carried
by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Lowe,
and Commissioner Sorenson; those voting No, none.
I Salary Ordinance No. 741
The Manager a ta ted tha t the Sala ry Ordinance for the fiscal year ending June 30th, 1946

had been prepared setting forth the salaries of the heads of the departments and the em-
ployees of the City Commission. He presented and read Ordinance No. 741, entitled:
AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA FIXING THE ~ONTHLY SALARY
AND OFFICIAL BOND OF THE CITY MANAGER, THE HEADS OF DEPARTMENTS, AND THE
EMPLOYEES OF THE CITY COMMISSION AS REQUIRED BY LAW.
It was moved by Commi?sioner Sorenson, seconded by Commissioner Lowe that the Ordi-
nance be passed and adopted and the motion was carried by the follow ing Aye and No vote;
those voting Aye being Mayor Healy, Commiss1 oner Sorenson and Commissioner Lowe; those vot-
ing No, none.

Resolution No. 582 -- Tax Levy
The Manager stated that the resoluti.on setting the tax levy for the year 1946 had
been prepared with the total number of mills the same as last year, i.e. 28 mills. He
presented and read Resolution No. 582, en ti tIed:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DETERMINING THE AMOUNT
OF CITY TAXES FOR ALL PURPOSES, GENERAL AND SPECIAL TO BE LEVIED AND ASSESSED
ON TAXABLE PROPERTY IN THE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE FISCAL

Resolution No. 583 -- Intent~on to Join State Employees Retirement Plan
The City Manager stated that a resolution of intention for the City of Bozeman to
set-up a RetIrement Plan for its employees in accordance with, and upon the terms and con-

ditions provided by, the Public Employees Retirement Act of 1945, had been prepared. He
presented and read Resolution No. 583, en ti tIed:
RESOLUTION OF INTENTIO:r;' TO ESTABLISH THE RETIREMENT PLAN FOR THE MUNICIPAL
EMPLOYEES OF THE CITY OF BOZEMAN, MONTANA.
It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that Resolution
No. 583 be passed and adopted and that August 20th, 1946 be set as the date of the election I
called for in the said Resolu tion and the motion was carried by the following Aye and No
vo te ; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe;
those voting No, none.
Communication -- Garbage on Perkins Place
A communication from residents of Perkins Place asking about the garbage and weeds
from the Churcn Street residents being placed out on Perkins Place, was presented and read.
The communication also asked that the Church Street residents keep their garbage on their
own property. The matter was referred to the Chi ef of Police and the Ci ty Manager for
inves tiga tion.
Parking Lot
A proposed lease from Robert I. Diefenderfer for the leasing of the vacant property
at the corner of South Bozeman and Babcock Street was presented and read, s ta ting the t the
property could be leased to The City of Bozemc,n for parking lot purposes at the rate of
$100 per month, with the exception of a strip 40xlOO in the southwest corner of the vacant
lot. City Attorney Aitken was asked to talk with Mr. Diefenderfer relative to leasing a
smaller portion of the lot at a different rate per month. I
American Legion Victory Day Pro~ram
A communication from the American Legion stating their plans for their First Annual
Vic tory Day Program was presen ted a nd read. The Communication asked for the followin~:
A parade on Main Street from 6 to 7 P.M. on August 14th, 1946
Use of Lindley Park for a musical and speaking program from 7 to 8 P.M.
A Band Concert on Main Street from 8 to 9 P.M.
The use of Main Street betwen Bozeman And Rouse from 9 to 11 P.M. for a street
dance, to take place in front of the Leglon Hall.
Mr. N. F. Nelson, of the American Legion and the Fire Department was present and stated
that all of Main Street between Rouse and Bozeman would not be needed but that traffic
should be kept off all this block and only a small portlon of the street in front of the
American Legion Hall at 225 East Main would be needed for street dancing, and that in his
opinion, this would not interfer with the movement of fire fighting equipment golng'on a call.
After discussion, it was moved by Commissioner Lowe, seconded by Commissioner Sorenson
that the requests of the American Legion be granted and the motion was carried by the follow-
ing Aye and No vote; those votins- Aye being Mayor Healy, Commissioner Sorenson and Commis~
sloner Lowe; those voting No, none.
Special Privilege for Parking I
Chief of Police Haas was present and read telegrams from various cities where parking
meters are installed and stating that none of these cities grant any special privileges to
any group for parking purposes.
Salaries of Police & Firemen
Chief of Police Haas and Fire Chief McCrosson appeared before the Commission to discuss
the salaries of the men in their departments. After discussion by the Commission, the basic
,rate for policemen- and firemen was set at $200 per month with $1.00 per month added for

moved by Commissioner Lowe, seconded by Commissioner Sorenson that the meeting adjourn and
