') r-~f'" f"lat} Bozeman, Montana July 27th, 1945 The Commission of The City of Bozeman met in regular session in the Commis sion Room, City Hall Building, Friday evening, July 27th, 1945, at 7:30 o'clock P.M. Those being present were Mayor Healy, Commissioner Sorenson, Commissioner Busch, City Manager Quinnell, Director of Finance Walter Davis, City Engineer Thorpe and the Clerk, when the following proceedings were had to-wit: The minutes of the last regular session were read, and it was moved by Commissioner Busch, seconded by Commissioner Sorenson that the minutes be approved as read, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissiner Busch and Commissioner Sorenson; those voting No, none. Resignation of Commissioner Busch -- Reinstatement of Commissioner Lowe Thereisgna tion of A. G. Busch as Ci ty Comrnis sioner to be effec ti ve July 27 th, 1945 was presented and read. It was moved by Commissioner Healy, seconded by Commissioner Sorenson that the resignation be accepted and ordered filed and the motion was carried by the follow- ing Aye and No vote; those voting Aye being Mayor Healy and Commissioner Sorenson; those voting No, none. Commissioner Lowe, having been absent from his duties as City Commissioner as a result of his induction into the armed forces of the United States, and having been granted leave of absence from his duties as City Commissioner during the period of such service; and Such military service by Commissioner Lowe having been completed and he having been honorably discharged therefrom, as appears of record; and Commissioner Lowe having made application for restoration of his position as City Com- missioner in accordance with the provisions of Chapter 150 of the Laws of the 27th Legisla- tive Session of The State of Montana, 1941, and he being present in person; and it appearing that all of the provisions of said Chapter 150 of the laws of the 27th Legislative Assembly of The State of Montana, 1941 relative to such restoration have been fully complied with by Commis~ioner Lowe, it was thereupon, moved by Commissioner Sorenson, seconded by Commissioner Healy that Commissioner Lowe be restored to his duties as City Commissioner forthwith, and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Healy and Commissioner Sorenson; those voting No, none. Whereupon Commissioner Lowe resumed his seat and duties as City Commissioner as of this da te . Application for City Licenses The following applications for City Licenses were presented and read: Jones Fixit Shop Gallatin Roller Rink It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the applica- tions be approved and the licenses issued and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Reports The following reports were presented and read: Fire Chief's annual report Sanitary Inspector's report on milk samples It was moved by Commissioner Lowe, seconded by Commies ioner Sorenson tha t the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote; 2r-'4 .,.Itl those voting Aye being Mayor Healy, Commissioner Sorenson andCommlssioner Lowe; those voting No, none. Resolution No. 558 -- Creating SID No. 338 The Manager stated that the City Attorney as instructed had prepared the resolution creating Special Improvement District No. 338, for the construction of a sanitary sewer serving Block 1, 7, 8, 9, and 10 of the West Side Addition. He then presented and read Resolution No. 558, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NUMBER 338" OF SAID CITY FOR THE PURPOSE OFINSTALLING A SANITARY SEWER IN SAID DISTRICT IN CERTAIN STREETS AND AVENUES AS HEREINAFTER IN THIS RESOLUTION PARTICULARLY DESCRIBED AND DES- IGNATED, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF SUCH IN- STALLATION AND CONSTRUCTION AGAINST THE PROPERTY WITHIN SAID SPECIAL IM- PROVEMENT DISTRICT UNDER AND BY VIRTUE OF THE PROVISIONS OF SECTIONS 5225 TO 5277, INCLUSIVE, REVISED CODES OF MONTANA, 1935, AND ANY AMENDMENTS THEREOF OR THERE TO . It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the reso- lution be passed and adopted and August 17th, 1945 be Bet as the date for opening bids for construction of said sewer and the wotion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Lowe" and Commissioner Sorenson; those voting No, none. License Fee for Carnival during Jaycee Roundup A communication was read from the Junior Chamber of Commerce asking that the license fee for the carnival to show July 31 to Augus t 5th during their annual Roundup be waived; and stating that the proceeds from the carnival are used for civic welfare projects. City Manager Quinnell stated he thought the City should receive some revenue from the carnival as extra polic emeTI were needed during the carnival; tha t the streets had to be sprinkled, and that the extra expense to the City would be around $100.00 Chief of Police Haas was present and stated that they would need at least two extra men for policemen each day of the carnival; that durIng this time many calls come to he the police station regarding stolen articles expecially from clothes lines, and/ask that the people connected with the carnival be confined to the car~ival grounds. However, the Commtssion, after discussion did not feel that the persons connected with the carni- val could be confined to the show grounds. The Commission discussed the matter of waiving the license fee and after careful consideration it was thought that the waiving of license fees was not good policy, as the City would have much better control of such shows if a license fee was charged. However, the Commission felt in this in~tance, the Jaycees having made a contract with the carnival people and had promised them that no license fee would be charged the license fee should be waived, but only for this year. Rezoning South One-half Block F; Story's Addition A report of the decision of the Board of Adjustment reached at the publiC hearing of July 23rd, 1945, recommending to the City Commission that the south one-half of Block F; Story's AddItion be zoned as Business Residence District No.2, was presented. It was moved by Commis&oner Lowe, seconded by Commissioner Sorenson that the City Attorney be instructed to prepare the proper ordinance conforming with the recommenda- tions of the Board of Adjustment and the motion was carried by the following Aye and No vote; those voting Aye being M~yor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. I I I I f\""- "J1'...)..') 1-..1'_ t Budget Estimates -- Year ending June 30th, 1946 The Manager presented the preliminary budget for the fiscal year ending June 30th, 1946, which was read. It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the preliminary budget be tentatively approved and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Lowe" and Commissioner Sorenson; those voting No, none. Ordinance No. 733 -- Appropriation Ordinance The Manager stated that the apprqpriation Ordinance for the fiscal year ending June 30th, 1946 in accordance with the preliminary budget had been prepared. Ordinance No. 733, was then presented and read, entitled: AN ORDINANCE APPROPRIATING MONIES FOR THE SUPPORT AND MAINTENANCE, ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30th, 1946. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the Ordi- I nance be provisionally passed and August 3rd, 1945 be set as the date for public hearing and the motion was carried by the following Aye and No vote; those voting Aye being Mayor I I Healy, Commissioner Lowe and Commissioner Sorenson; those voting No, none. Ordinance No. 734 -- Salary Ordinance The Manager stated that in accordance with the provisions pf Chapter 99, Montana Laws of 1941, the Ordinance setting the salaries of the department heads and the employees of the City Commission for the fiscal year ending June 30th, 1946, had been prepared. He presented and read Ordinance No. 734, entitled: AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA FIXING THE MONTHLY SALARY c AND ORRICIAL BOND OF THE CITY MANAGER, THE HEADS OF DEPARTMENTS, AND THE EMPLOYEES OF THE CITY COMMISSION AS REQUIRED BY LAW. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the Ordi- nance be passed and adopted as read, a nd the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Lowe and Commissioner Sorenson; those voting No, none. Sprinkling Hours The Manager reported that because of a decrease in the water supply and the consequent low water pressure due in part to valve trouble at the Mystic Lake Reservoir, hours for sprinkling yards and gardens had been restricted, and tha t sprinkling would only be per- mitted from 5:00 A.M. to 9:00 A.M. and from 5:00 P.M. to 9:00 P.M. until such time as the city's water supply is substantially increased. Misc. W & C 1945 The City Commission set, Wednesday, August 1st, 1945, as the date for the annual inspection of sidewalks. Wading Pool The City Manager reported that the Jaycees had offered to build.a wading pool in one of the city parks and present it to the city for the use of small children, and that they would like suggestions from the Commission regarding a suitable location.
