The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Friday evening, August 31st, 1945, at 7:30 P.M. Those being present
were Mayor Healy, Commissioner Sorenson, Commissioner Lowe, City Manager Quinnell, City
Attorney Aitken, Director of Finance Walter Davis, City Engineer Thorpe and the Acting
Clerk, when the following proceedings were had to-wit:
The minutes of the last regular session were read, and on motion made by Commissioner
Lowe, seconded by Commissioner Sorenson, were unanimously approved.
Ordinance No. 735 - - Amending Zoning Ordinance No. 711
E. A. Rowe of 618 West Babcock appeared before the Commission again protesting the
passage of Ordinance No. 735 amending Ordinance No. 711, making the south half of Block F,
Story Addition a part of Business-Residence District No.2.
Mr. Rowe stated that he and his neighbors had built their homes in that vicinity, ex-
pecting the city to protect them from interferenoe by commercial or business enterprises
and that they would much rather see some new homes built, rather than to make the place
a business district.
Mrs. Alex Swanson of 608 West Babcock, who was present, stated that she had signed
two petitions protesting the proposed boundary change and nothing had been done about it.
Mayor Healy advised both Mrs. Swanson and Mr. Rowe, that the matter would be acted
on just as soon as possible after all interested parties had been given a fair hearing.
The Zoning Ordinance was presented and read by the City Manager, who stated that
final action would be taken on the proposed boundary change in the near future.
W. o. Bohart - Vacating two streets and alley
W. O. Bohart appeared before the Commission, stating that he would like to have Pear
Street from K to Land K Street from Pear to Cedar vacated and also the alley in Block 86.
The Commission informed him that he would have to have a petition in writing, describing
what is to be vacated so that it could be acted on at the next regular meeting of the
Commission. He was also advised that if these streets and alleys were to be vacated,
the adjacent and included lots and blocks should also be vacated.
Overtime Parking
Monte Shauer and M. P. Shauer appeared before the Commission regarding overtime park-
ing in the business district. Mr. Shauer stated that at different times it has been im-
possible for them to load or unload because cars have been parked in the yellow space and
allowed to remain longer than the 20 minutes parking time prOVided by ordinance and
several times such cars have been there all night. He also stated that the Police were
not tagging certain cars but were allowing them to over-park and that such privileges
were being given to certain people. He was informed by the City Manager that no privileges
were allowed anyone and Mayor Healy suggested that he get a "No Parking" sign and place
in front of his place of business, which he thought would probably take care of the situa~
ation. He was requested, however, to first submit any such sign to the City Manager for
approval before attempting to use it.

The following reports for the month of August, 1945 were presented and read:

It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the reports
be accepted and the motion was carried.
",.1. Contractor's Bond - Standard Construction Company
.J A contractor's bond for the Sta.ndard Cons truction Company of Bozeman, subml tted by the
Fidelity and
United State&1Guaranty Company, of Baltimore, Maryland, was presented and read by the City
Manager. Under the terms of this bond, the Standard Construction Company is to install a
new sanitary sewer in Special Improvement District No. 338 according to the City Engineer's
plans and specifications, and the provisions of Spec~al Improvement District Laws of Montana.
It was moved by Commissioner Lowe, seconded by Commissioner Sorenson, that the Contractor's
Bond be accepted and the contractor's certified check for $700.00 be returned to him, and
the motion was carried by the following Aye and No vote. Those voting Aye being Mayor Healy,

Notice of Sale of Bonds - Special Improvement District No. 338
Notice of Sale of Bonds of Special Improvement District No. 338 of the City of Bozeman,
Montana, was presented and read by the City Manager. It was moved by Commissioner Lowe,
seconded by Commissioner sorenson" that it be approved and ordered published. The motion
was carried by the following Aye arid No vote. Those voting Aye being Mayor Healy, Commis-
sioner Sorenson and Commissioner Lowe; those voting No, none.

Communications
A communication from D. S. Williams, city School Superintendent, regarding safety
zones around schools was referred to the City Attorney for reply.
A communication addressed to the City Commission from the Police Reserve Fund Board,
submitting the formal application for retirement of Alfred E. Anderson, a member of the
active Police Force of The C,1ty of Bozeman for more than 20 years, and over the retirement
age of 65 years, was presented and read. It was explained that Mr. Anderson was to be
transferred from the active list to the Police Reserve list and that his retirement pay,
would be $86.15 per month or one-half of his present $172.25 salary.
It was thereupon moved by Commissioner Lowe, seconded by Commissioner Sorenson, that
the application be approved and the motion wes carried by the following Aye and No vote;
those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those
voting No, none.

A communication addressed to the City Commission from William J. Kolokotrones of
Three Forks regarding the possibility of amending Ordinances No. 711 and No. 658 to permit
the establishment of a tavern and cocktail lounge on North Seventh. It was explained that
Ordinance No. 711 prohibits the operation of such an establishment in that zone, and that
Ordinance No 658 limits the number of beer and liquor licenses to eight for the entire
city. Therefore, the Commission felt that it would not be wise to amend the ordinances
as suggested by Mr. Kolokotrones.
A communication from Corwin and Company, Inc., Great Falls, regarding post war con-
struction, was presented and read by the City Manager.

Primary Nominating Election Results - August 28th, 1945
A summary of the Primary Election results compiled by Mr. Davis, was presented and
read by the City Manager as follows:

It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the summa-
tion be approved and that Don B. Bennett and Charles M. Sorenson having received the
highest number of votes, be declared nominated, and the motion was carried by the follow-
ing Aye and No vote; those voting Aye being Mayor Healy, Commissioner Lowe and Commissioner
Sorensonj those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was
moved by Commissioner Lowe, seconded by Commissioner Sorenson that the meeting adjourn
and the motion was carried.

Resolution No. 560A -- Intention to Vacate Alley in Block 2; Violett Addition
The Manager stated that the City Attorney as instructed had prepared the Resolution
of Intention to vacate the alley in Block 2; Violett Addition. Represented and read
Resolution No. 560A, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING
IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE THE ALLEY IN BLOCK TWO
(2) VIOLETT ADDITION TO BOZEMAN, PURSUANT TO TEE PROVISIONS OF SECTION 5494
OF THE REVISED CODES OF MONTANA, 1935, AND DIRECTING NOTICE TO BE GIVEN OF
SUCH INTENTION.
It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the
Resolution be passed and adopted and September 7th, 1945 be set as the date for the
hearing of protests to said vacation of said alley, and the motion was carried by
the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Lowe
and Commissioner Sorenson; those voting No, none.
