Allison Sub 3B Final Plat Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Rebecca Owens, Associate Planner SUBJECT: Final Plat for the Allison Phase 3B Major Subdivision MEETING DATE: July 24, 2017 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the City Commission approve the Final Plat for the Allison Phase 3B Major Subdivision, authorize the Director of Public Works to execute the same on behalf of the City of Bozeman, authorize the Director of Community Development to execute the improvements agreement on behalf of the City of Bozeman, and authorize the Interim City Manager to execute the warranty deed for parkland dedication on behalf of the City of Bozeman. BACKGROUND: The City Commission granted preliminary plat approval for the Allison Phase 3 Major Subdivision on April 27, 2015, by a 4-0 vote. §76-3-611(1), MCA, provides that the City Commission shall approve the plat only if: (a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of this chapter and regulations adopted pursuant to this chapter; and (b) the county treasurer has certified that all real property taxes and special assessments assessed and levied on the land to be subdivided have been paid. Attached is a memorandum from Rebecca Owens, Associate Planner, stating the staff has concluded that all terms and conditions of the preliminary plat approval have been met. One improvements agreement is required for final plat approval of this subdivision. The improvements agreement guarantees the installation of sidewalks. An irrevocable standby letter of credit in an amount not to exceed $18,784.50 has been provided for financial security. All other necessary infrastructure improvements are constructed or secured through the City’s West Graf street project. 12 Parkland requirements have been met and tracking is detailed on the final plat. The 0.24 acres of parkland required with Phase 3 were met through previously dedicated parkland provided in Allison Subdivision Phase 2. UNRESOLVED ISSUES: None identified. ALTERNATIVES: None suggested or proposed. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property. Report compiled on: July 3, 2017 Attachments: Final Plat Staff Memorandum 13 14 15 16 1 MEMORANDUM ------------------------------------------------------------------------------------------------------------ TO: GREG SULLIVAN, CITY ATTORNEY ROBIN CROUGH, CITY CLERK FROM: REBECCA OWENS, ASSOCIATE PLANNER RE: ALLISON MAJOR SUBDIVISON PHASE 3B FINAL PLAT, APPLICATION 17209 DATE: JULY 3, 2016 ------------------------------------------------------------------------------------------------------------ Madison Engineering, LLC, on behalf of Bon Ton Inc. of Billings, has made application to the City of Bozeman Department of Community Development for Final Plat review and approval for the Allison Subdivision Phase 3B, a four-lot major subdivision. The Allison Subdivision Phase 3B subdivision will subdivide 49.517 acres to create three single-household residential lots, one lot with restricted development and a short portion the adjacent Graf Street extension. Attached is a copy of the signed Findings of Fact and Order dated May 11, 2015. One Improvements Agreement is required for this subdivision for the installation of sidewalks on Graf Street. All other necessary infrastructure improvements are constructed. The City’s Department of Community Development and Engineering Division have reviewed the application for “closure” and against the conditions and cited code provisions of preliminary plat approval and found the application for the subject final plat to be in compliance. As a result and based on the summary review provided below, the final plat application may be considered for approval by the City Commission. Three (3) original mylars of the Final Plat, original Platting Certificate, copy of the property owners’ association (POA) documents with 1st amendment, copy of the improvements agreement with the approved engineer’s estimate, and a copy of the signed Findings of Fact and Order are attached for your review. The property owner’s association documents and other applicable documents will be recorded and filed with the final plat at the Clerk and Recorder’s Office. The Community Development staff respectfully requests that you prepare a City Attorney's Certificate using the attached original Platting Certificate; approve the Certificates of Director of Public Works and Certificate of Completion "as to 17 2 form". The final City signatures will be obtained once the City Commission has approved the final plat. An application was submitted to the Community Development Department on April 26, 2017, and amended on June 8 and June 30, 2017. Based on the applicant having provided a complete submittal the application was deemed adequate for continued review on June 30, 2017, the 45-day (working days) review period for this final plat would expire on September 4, 2017. The conditions of preliminary plat approval, which are pertinent to this major subdivision and how they have been met, are described in the submittal materials. One exception to this is that it was determined that a subdivision improvements agreements is required for uninstalled sidewalks. We have this agreement in hand and the financial guarantee was provided by a letter of credit from Stockman Bank to the City of Bozeman. The improvements agreement with be finalized upon review and approval by legal staff and the City Commission. The project is scheduled for consideration by the City Commission on July 24, 2017.
