HomeMy WebLinkAbout1945-10-12 278 Bozeman, Montana October 12th, 1945 The Commis.sion of The Ci ty of Bozeman met in regular session in the Commission Room, City Hall Buildlng, Friday evening, October 12th, 1945, at 7:30 o'clock P.M. Those being present were Mayor Healy, Commissioner Sorenson, Commissioner Lowe, City Manager ~uinnell, City Attorney Aitken, Director of Finance Walter Davis, City Engineer Thorpe and the Clerk, when the following proceedings were had to-wit: The minutes of the last regular session were read, and it was moved by Commissioner Sorenson, seconded by Commis sioner Lowe tha t the minutes be approved as read, and the I motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Parking Meters Protested. A committee of business men consisting of K. J. Stimson, C. F. Angel, H. Hruska, Al Waldron and B. C. Schauer appeared before the Commission and presented a petition signed by several business men protesting the installation of parking meters in Bozeman. They questioned if there was a parking problem in Bozeman and asked if the installation of meters would solve it and stated further that during the months of September through Dec- ember is the only time tilere seems to be a parking problem. They suggested that a survey should be made of the business men and also inquiries should be made by sending a rep~esentative to cities the same size as Bozeman where park- ing meters are used and get the reaction of the business men and the people of those cities. The gentlemen were informed that the City Commission had only considered the instal- lation of parking meters on a six months trial basis and that definite action in the matter had not yet been decided upon. Mr. O'Bnen and Mr. Frick representing parking meter companies told of the experiences of other cities where parking meters have been installed and also demonstrated their I. parking meters to those present. Mr. C. E. Hall of the Railway Express Company stated that he would like to protest the parking of trucks in the alleys as this bloc~ the alleys and the trucks of the Ex- press Company can not get by. Mr. Hall sta ted further there was considerable speedIng and reckless driving near his home at 902 South Grand. A- resolution of the Board of Directors of the Chamber of Commerce was presented and read, asking that fines for overtime parking violations of cars outside of Gallatin County be remitted by the Police Judge. Application for City License The application of Hovde's Radio Service for a t-year city license was presented and read. It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the appli- cation be approved and the license issued and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Reports I Lowe; those voting No, none. The following reports were presented and read: Director of Finance for the month of September, 1945, Airport Board for the fiscal year ending June 30th, 1945, Audit of Airport Funds for the fisoal year ending June 30th, 1945. I .1 I 279 It was moved by Commissioner Sorenson, seconded by COmmissioner Lowe that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Resolution No. 563 -- Intention to Create SID No. 339 The Manager stated that the City Attorney as instructed had prepared the resolution of intention to create Special Improvement District No. 339, for the construction of a sanitary sewer in the alley between Tenth and Eleventh Avenues from Koch to College Street. He pre- sented and read Resolution No. 563, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DIS- TRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NUMBER 339 ,FOR THE PURPOSE OF INSTALLDW A SANITARY SEWER IN TIm ALLEY BETWEEN TENTH AND ELEVENTH AVENUES, SOUTH, IN SAID DISTRICT AS SO CREATED AND AS SUCH ALLEY IS HEREINAFTER SPECIFIED AND DESCRIBED, AND SPECIALLY TO ASSESS THE EN- TIRE COST AND EXPENSE OF SUCH INSTALLATION AGAINST THE PROPERTY WITHIN THE BOUNDARIES OF SAID SPECIAL IMPROVEMENT DISTRICT AS SAID BOUNDARIES ARE HERE- INAFTER SPECIFIED ON THE FRONTAGE BASIS; ALL UNDER AND BY VIRTUE OF THE PRO- VISIONS OF SECTIONS 5225 TO 5277, BOTH NUMBERS INCLUDED, REVISED CODES OF MONTANA 1935, AND ANY AMENDMENTS THEREOF OR THERETO. It Was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the Reso- lution be passed and adopted and November 2nd, 1945 be set as the date for the hearing of protests and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Resolution No. 564 -- Intention to Create SID No. 340 The Manager stated thst the City Attorney as instructed had prepared the Resolution of intention to create Special Improvement District No. 340, for the construction of a sanitary sewer on North Fifth Avenue from Peach Street to fifty feet south of Beall Street. He pre- sented and read Resolution No. 564, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION 'OF SAID COMMISSION TO CREATE A SPECIAL D/.PROVEM1<::NT DIS- TRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS SPECIAL IMPRSVEMENT DISTRICT NUMBER 340, FOR THE INSTALLATION OF A SANITARY SEWER ON FIFTH AVENUE, NORTH IN SAID CITY AND DISTRICT, FROM THE PRESENT SEWER ON PEACH STREET SOUTH A SUFFI- CIENT DISTANCE TO SERVE ALL PROPERTY FRONTING OR ABUTTING ON SAID FIFTH AVENUE NORTH, SOUTH OF PEACH STREET AND NORTH OF A LINE PARALLEL WITH AND FIFTY FEET SOUTH OF THE SOUTH LINE OF WEST BEALL STREET. It was moved by Commissioner Sorenson, seconded by Commissioner Lowe that the Resolu- tion be passed and adopted and November 2nd, 1945 be set as the date for the hearing of protests and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy. Commissioner Sorenson and Commissioner Lowe; those voting No, none. Insurance on City Autos The insurance policy covering personal and property damage on the City's motor equip- ment was presented. The policy was approved as to form by the City Attorney, whereupon it was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the policy be accepted and approved and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Petition for Street Light A petition signed by 31 signers, requesting that a street light be installed on Black Avenue South midway between Story Street and Curtiss Street was presented and read. The Manager stated that he and the City Engineer would check into the matter during the coming week and report to the Commission at their next meeting. 280 Communicattions: Funds for Operation of Nursery School A communication from the Federal Works A[eDcy was read,. stating that recommendations had been made by the President to Congress for appropriation of funds to operate Nursery Schools until March 1st, 1946. Communication: Stop Street at Garfield A communication from Miss Bertha Clow requesting that Garfield Street be made an arterial street was presented and read. The Manager stated that this matter would be in- vestigated during the coming week. Proposed Platting of Karp's Addition A map showing the proposed platting of Karp's Addition to The City of Bozeman was I presented to the Commission for consideration. After examination of the plat, it was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the plat be approved subject to the approval of the abstract!bp- the City Attorney, and approval of the plat by the Dir- ector of Public Safety and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none. Resolu tion No. 561 Snow Assessment The Manager s ta ted th"t this was the time and place set for the hearing of protests for the levying of the assessment for the removal of snow in the business district for the year 1944-1945. He stated that no one was present to protest and no protests had been filed, and presented the affi~avit of publication of the Notice and Resolution No. 561, en ti tIed: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZ'f:EMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF REMOVAL OF SNOW FOR THE YEAR 1944-1945 PURSUANT TO PROVISIONS OF ORDINANCE NO. 502, ENTITLED: "AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW FROM THE SIDEWALKS IN THE CITY OF BOZEMAN AND REPEALING ORDINANCE NO. 385, ENTITLED: 'AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW AND ICE, DIRT, FILTH AND OTHER OBSTRUCTION FROM SIDEWALKS ON MAIN STREET BETWEEN WALLACE AVENUE AND FOURTH AVENUE IN THE CITY OF BOZEMAN'''. Resolution No. 562 ~- Garbage Assessment The Manager stated that this was the time and place set for the hearing of protests to the levying of the assessment for the removal of garbage for the year 1945. He stated that no one was present to protest and no protests had been filed. He presented the affi- davit of publication of the Notice and Resolution No. 562, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING AND ASSESSI~G A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR 1945 TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF OR- DINANCE NO. 696 OF TEE CITY OF BOZEMAN, MONTANA I It was moved by Commissioner Lowe, seconded by Commissioner Sorenson that the reso" lution be finally passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Healy, Commissioner Sorenson and Commissioner Lowe; those voting No, none.
