Bozeman, Montana
May 18th, 1945
The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Friday evening, May 18th, 1945, at 7:30 o'clock P.M. Those being
present were Mayor Healy, Commissiorer Busch, City Manager 1.c(.1Jinnell, City Attorney Aitken,
City Engineer Thorpe and the Clerk, when the following proceedings were had to-wit:
The minutes of the last regular session were read, and it was moved by Commissioner
Busch, seconded by Mayor Healy that the mlnutes be approved as read, and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Healy and Commis-
sioner Busch; those voting No, none.
Complaint -- Noise ON 'East Main
Mr. & Mrs. W. C. Kester, of the Kester Hotel, 440 East Main, appeared before the
Commission and stated that the noise and confusion from customers of the Eat-a-bite Cafe
across. the street from their hotel was so annoying that patrons of their hotel could not
sleep at night; that the people creating this nuisance did not seem to be customers of the
cafe but are .1ust uplaying aroundu, and the disturbance goes on all night. They reported
tha t when the police appear on the scene,. all is quiet, bu t th(, t after the police leave,
conditions are as bad as before.
The City Attorney reported thAt there has been complaint come to his office also
abolJ. t the noise here. After al2':eneral discussion of the problem, it was moved by Com-
missioner Busch~ seconded by Mayor Healy that the City Attorney be instructed to notify
the proprietor that unless the conditions complained of were improved the City License
for the operation of the establishment would be revoked, and the motion was carried by
the followinS7 Aye and No vote; those voting Aye being Ma yor Healy and Commie sioner Busch;
those voting No, none.
Courtesy Cards
Chief of Police Haas was present and presented copies of courtesy cards which are
being printed in connection with minor traffic violations by out-of-town cars.
Applications for City License
The following applications for City License were presented and read:

Dr. C. D. Pons
It was moved by Commissioner Busch, seconded by Mayor Healy that the applications be
approved and the licenses issued and the motion was carried by the following Aye and No
vote; those votin~ Aye being Mayor Healy, and Commissioner Busch; those votin~ No, none.
Bids for Garb8ge Disposal
The City Mana~er presented and read the form of advertisement for garbage disposal
bids for a 12-months period ending Jlme 30th, 1946. It was moved by Commissioner BuSCh,
seconded by Mayor Healy, that the Clerk be authorized to advertise for bids to be opened
June 8th, 1945, for garbage disposal during the above-mentioned period and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Healy and Commis-
sioner Busch; those voting No, none.
License Fee -- Arthur Bros. Circus
Wm. B. Longstreet, Contracting Agent for the Arthur Bros. Circus was present to in-
quire regarding the license fee for their curcus which proposes to show in Bozeman, July
1st, 1945. He stated that he would be willing to pay ~lOO per day for his 3-ring circus,

but the prescribed fee of $220.00 as set forth in the ordinance was really more than his
company could afford to pay.
After considerable discussion by the Commission, it was
moved by Commissioner Busch, seconded by Mayor Healy that the license fee for the three-
r:tngs Arthur Bros. Circus be set at $160.00 for one day, .July 1st, 1945, and the motion was
carried by the following Aye and No vote; those votin~ Aye being Mayor Healy and Commis-
sioner Busch; those voting No, none.
Bids for Carload Pipe
1he Manager stated that in order to have sufficient pipe available for water extensions
in the post-war program, bids should be called for a carload of additional water pipe and
fi ttings. It was moved by Commissioner Busch~ seconded by Mayor Healy that the Clerk be
authorized to advertise for a carload of eRst iron pipe and fittings, bids to be opened
June 15th, 1945, and the motion was carried by the followin~ Aye and No vote; those voting
Aye being Mpyor Healy and Commissioner Busch; those votin&r No, none.
Lease on Comnmnity Room Eytended
The Manager presented an applic r-1 tion form for the extension of the 1 ease on the
Communi ty Room in the Armory Buildinp used by the Agricultural Census Bureau, from May
1st, 1945 to June 30th, 1945. It was moved by Commissioner Busch, seconded by Mayor Healy
that the lease be extended as set forth in the application and the motion was carried by
the following Aye and No vote; those voting Aye being Mayor Healy and Commissioner Busch;
those voting No, none.
Telephone Agreement -- Forest Service
The agreement between The City of Bozeman and the U. S. Forest Service for the mutual
use of their telephone line in the Bozeman Creek Water Shed was presented and read. It
was moved by Commissioner Busch, seconded by Mayor Healy that the Mayor be authorized to
sign the agreement for the Clt~T of Bozeman and the motion waf'. c~rried by the following
Aye and No vote; those voting Aye being Mayor Healy and Commissioner &lsch; those voting
No, none.
Appointment -- Heackel to Adjustment Board
Mayor Healy announced the appointment of Mr. C. A. Haec]ml as a member of the Board
of Ad.1ustment, term to expire November 8th, 1947. It was moved by Commissioner busch,
seconded bv Mayor Healy that the appolntment be approved and the motion was carried by
the following Aye and No vote; those votini7 Aye belng Mayor Healy and Commissioner Busch;
those voting No, none.
