The Commission of The Oi ty of Bozeman met in regular session in the Commis sion Room,
City Hall Building, Friday evening, June 22nd, 1945, at 7:30 o'clock P.M. Those being
were Mayor Healy, Commissioner Sorenson, Commissioner Busch, City Manager Quinnell, City
A ttorney Aitken, Ci ty Engineer Thorpe and the Clerk, when the following proceedings were had:
The minutes of the last re~ular session were read, and it was moved by Commissioner
Busch, seconded by Commissioner Sorenson thAt the minutes be approved as read, and the
motion was carried by the followinR' Aye and No vote; those vo ting Aye being Mayor Healy,
Commis s ioner Busch and Commi ~sionAr Sorenson; those voting No ~ none.
Resolution No. 555 -- Liqtting ABseA8ment
The ManaR'er stated that this was the time and place set for the hearing of protests
to the fina 1 passage of the resolu ti on levying the asses smen t for s tree t liqh tinQ' dis tric ts
for the year 1945. He presented the affidavit of publication of the Notice, and Reso1u-
tion No. 555, entitled:
A RESOLUTION OF THE COMMISSION OF 'T'HF. CITY OF BOZEMAN, MONTANA, LEVYING AND
ASSESSTf\TG LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR
SPECIAL IMPROVEMENT LIGHTING DISTRICTS NUMBERS 100, 284, 288, 289, 290, 295,
AND 300 OF THE CITY OF BOZRMAN, PURSTTANT TO Tlffi PROVISIONS OF SECTION 5266

It was stated that no protests had been filed and no one was present to protest,
whereupon, it was moved by Coml1"issioner Busch, seconded by Commissioner Sorenson that the
Resolu tion be finally passed and adopted and the motion was cs rried by the following Aye
and No vote; those voting Aye being Mayor H"'aly, Commissioner Sorenson and Commissioner
Busch; those voting No, none.
Resolution No. 554 -- Sprinklin~ Assessment
The Mana'ter stated that this was the time and place set for hearing of protests to
the final adoption of the resolution levying the sprinkling district assessments for the
year 1945. He stated that no protests had been filed and no one was present to protest
and presented the affidavit of publication of the Notice and Resolution No. 554, entitled:

It was moved by Oommissi oner Sorenson, seconded by Commissioner Busch that the reso-
lution be finally passed and adopted and the motion was carried by the following Aye and
No vote; those voting Aye being Mayor Healy, Commissioner Busch and Commissioner Sorenson;
those voting No, none.
Applications for City Licenses
The following applications for City Licenses were presented and read:
J. w. Strachan for a business license
and the applications of the American Legion for a one-half year license to sell beer and
liquor at 225 East Main Street.

cations be approved and the licenses issued and the motion was carried by the following

Armory -- Roller Rink
A communication from the Montana Armory Board, stating they would have no objection
for using the Armory Drill Hall for a roller skating rink provided it is not objectional
to the present tenants; th8t the City pay for the additional lights and janitor service
and put the floor back in good condition after it is used for roller skating. The
Manager stated that he had asked Mr. Abelan, who is interested in renting the drill hall,
to talk with the custodian regarding the .janitor service, and after discussion by the
Commission, it was decided that if Mr. Abelan will arrange with the Armory Board to pay
for the 11~hts and janitor service, and furnish a-sufficient bond to cover the cost of
repairing any damage to the floor caused by the skates, he could rent the drill hall for
a roller skating rink at the regular price of $20.00 per day.
Acceptin~ u.s. Aid for Nursery School
The City Manager read the maintenance and operation agreement of the U. S. Government,
whereby they offer to contribtJte to the City for the maintenance and operation of the
Nursery School (Project 24M5) for the three months period ending September 30th, 1945.
The following resolution accepting the agreement of the U. S. Government was pre-
sented and read:
WHEREAS, there has been fi led wi th the Bureau of Communi ty Fac ili ties of
the Federal Works Agency in behalf of The City of Bozeman, Bozeman, Montana
(herein called the "Applicant"), an application for federal assistance under
the so-called Lanham Act, as amended, and the UNITED STATES OF AMERICA, ACt-
ing by and through the Commissioner of Community Facilities, has transmitted
to the Applicant for acceptance an Agreement of federal assistance in connec-
tion with the Project referred to in said application and described in said
Agreement; and
WHEREAS, said Agreement has been duly read in open meet'ng, fully consider-
ed in accordance with all pertinent rules of procedure and legal requirements,
and made a part of the Applicant's public records; and
WHRREAS, it is deemed advisable and in the public interest that said Arr7ee-
ment be accepted:
NOW, THEREFORE be it resolved by the City Commission of the Applicant that
the said Arrreement, a trlJe and correct copy of which, including the Terms and
Conditions, is hereto attached, be and the same hereby is accepted without
reservation or qualification.
Passed by the aforementioned governing body cf' the Applicant on the 22nd
day of June, 1945.
Approved on the 22nd day of June, 1945, by the City Manager of the Applicant.

Mayor Healy announced the appointment of Wm. H. Lovelace, to fill the unexpired term
of W. R. Plew, as a member of the Board of Adjustment. It was moved by Commissioner Busch
seconded by Commis s ioner Sorenson that the a ppointment be approved and the mo tion was
carried by the following Aye and No vote; those voting Aye being Mayor Healy, Comm1."sloner
Busch and Commissioner Sorenson; those voting No, none.

A communication from the Airport Board, asking that Don Bennett be reappointed as
a metrlber of the Alrport Foard was read. It was announced that as the present term of
Don Bennett does not expire until July 30th, 1945, the appointment would be made at a
la ter da te .
Ordinance No. 732 -- Police Reserve Board
Ordinance No. 732 prepared by the City Attorney in accordance with instructions by
the City Commissioners, settinp: up a Board of Trustees for the audit, administration,
control and disbursement of the Police Reserve Fund was presented and read, entitled:
AN ORDINANCE OF THE CITY OF BOZEMAN PROVIDING FOR THE AUDIT, ADMINISTRA-
TION, CONTROL AND DISBURSEMTI:NT OF ITS POLICE RESERVE FUND BY A BOARD OF
TRUSTEES PURSUANT TO THE STATUTES OF THE STATf'~ OF MONTANA IN SUCH CASE
MADE AND PROVIDED.

Extension of \/\[ater Mains
A communicat ion from Mr. Chas. W. COOk, Di8 trict Secretary of the Fire Underwri ters
sugfles ting for a pos t-war proQ'ram the enlarging and extension of wa ter mains wi thin the
City to provide more adequate fire protection, and also recommending the purchase of
addi tional fire fighting equipment for the Fire Depa rtment was presented and read.
The Ci ty Manager reported tho::: t wi th the completion of the Middle Creek Dam, a third
system of water supply would be available for the western part of the City and it was
thought that this addi tional supply would furnish adequa te fire pro tee tion to the west
side area, wi th a minimum of changes in the present pipinp- system.

Budget -- Year ending June 30th, 1946.
The Manaflsr presented budget estimate totals for the various department for the
fiscal year ending June 30th, 1946, and stated that further details of anticipated
revenues and estimated expenditures for the budget year would be presented at a later
meeting together with a compara ti ve sta tement of ac tual revenues and sxpendi tures in
former years.
Garbage Contract
The bid of J. S. Miles, in the amount of $12,445.00 for garbage disposal for a
period ending .June 30th, 1946 was discussed, and after careful consideration, it was
moved by Commiss1.oner Busch, seconded by Commis at oner Sorenson tha t the bid be accepted
and the City Attorney prepare the proper contract and the motion was carried by the fol-
lowing Aye and No vote; those voting Aye being Mavor Healy, Commi:"sioner Busch and Com-
missioner Sorenson; those voting No, none.
S.I.D. 338 -- Intention to Create
A map of a proposed sanitary sewer district to serve property owners in Blocks 1,
7, 8, 9, 10 of the West Side Addition was presented, together with the location of the
sewer and the district boundaries. After examination of the map as presented, it was
moved by Commissioner Sorenson, seconded by Commissioner Busch th~t the City Attorney
be instructed to prepare the resolution of intention to cres te the district and the mo-
tlon was carried by the following Aye and No'vote; those voting Aye being Mayor Healy,
Commissioner Sorenson and Commissioner Busch; those voting No, none.

Communlcc;, tion -- Jr. Chamber of Commerce
A conurru.nicatlon was presented from the Junior Chamber of Commerce requesting that the
license fee for their Roundup be waived; that permission to stage a street parade on Fri-
day, AUr;rust 3rd, 1945 be granted and that competitive attractions be prohibited from
sbowing in Boz eman for a period of one rnon th pri or to the Roundup. The communic a ti on
received favorable consideration except the Commission felt that official action pro-
hibiting competitive attractions mia:ht be inadvisable, and it was thoup"ht that such matters
could be taken care of as the occasion arises.
Resolution No. 556
Waintenance Assessment
The Manager stated that the resolution levying the assessment for the maintenance
of parkings for the year 1945 in the amount of $3,409.96 had been prepared. He presented
