The Commission of The iJity of Bozeman met in regular session in the Commission Room,
City Hall Building, Friday evening, Au:'Ust 4th, 1944, at 7:30 o'clock P"M. Those belng
presen t were Ma yor Landoe, Commis si oner Healy and the Clerk.
It was deemed advisable
to pos tpone the transaction of regula r city business owing to the absence of the City
Mana~er and City Attorney who were attending the annual meeting of the Montana Municipal
Lea~ue in Billings, as authorized by the City Commission, and no one appearing for the
trsnsac tlon of other bl1S in eBs, it was moved by Commie sioner Healy, se conded by Mayor
Landoe that the meeting be adlourned until Monday, Augu~t 7th, 1944, at 7:30 o'clock
P.M., and the motion was carried by the following hye and No vote; those voting
Aye being Ma';,or Landoe and Commissioner Healy; those voting No, none.

The Commission of The City of Bozeman met in an adjourned session in the Commission
Room, City Hall Building, Monday evening, August 7th, 1944 at 7:30 o'clock P.M. Those
being present were Mayor Landoe, Commi ssioner Healy, Commi sa ioner Busch, City NJanager
Quinnell, City Attorney Altken and the Clerk, when the following proceedlngs were had:
The minutes of the last regular session were read, and it was moved by Commissioner
Healy, seconded by I,jommiss:loner Busch thRt the minutes be approved as read, and the
motion was carried by the following ,t~ye and No vote; those voting Aye being Mayor
Landoe, Commissioner Healy and Commissioner Busch; those voting No, none.
Sidewalk on South Wl11son Ave
'lfr. Mark SWinp:le, 1211 South Willson, appeared before the Commis s ion and reque s ted
tha t sidewalks be cons true ted on the west side of Willson Avenue along the two blocks
directly north of his property. He stated that this same request has been made two or
three times before, but that it had always been ulrned down either because the walk on
the east side of the street was deemed sufficient or because materials were not avail-
able at the time. Mr. SWingle stated that the walk on the east side of the street is
badly in need of repair and that it is considerably lower than the parking, Which causes
quite a lot of water to stand there during wet weather, making it very disagreeable to
walk to town. Mr. Swingle also s ta ted thR. t five families wou.ld use the new walk if it
is constructed.
After considerable discussi.on, the City Manap-er was instructed to write to the
owners of lots abutt~ng the proposed walk notifying them of the contemplated improvement
and giving them an opportu.nity to appear before the Commismon and be heard in regard
to this matter before final action is taken on Mr. Sw~ngle's request.

and claims Nos. 144 to 156 In the amount of $670.00 for the Nursery School (Project 24M5)
were also presented. The Manager stated that he has audited these claims and finds them
to be true and lawful claims agalnst The City of Bozeman and recommends that warrants be
drawn for their payment. After examination of the claims in detail by the City Commission
it was moved by Commissioner Healy, seconded by Comwlssioner Busch thAt they be allowed
and warrants drawn for their payment and the motion was carried by the followin~ Aye and
No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner BUf.1ch;
those voting No, none.
Public Hear.:ng - - Ordinnnce No. 730
The Manager stated this was the time and place set for public hearing on Ordinance
No. 730, the annual appropriation ordinance. He presented and read the affidavit of pub-
lication of the Notice and as no one appeared for the hearing, the City Commission set
August 18th, 1944, as the date for final passage of Ordinance No~ 730, in accordance with
the requirements of Chapter 99, of the Montana Laws of 1941.

tions be approved and the licenses issued and the motion was carried by the following Aye

c.p.A. Annual Audit Report
Mr. C. E. Coulston, CPA appeared before the Commissior: and presented copies of his
reDort covering the annual audi t for the fiscal year ending .Tune 30th, 1944 for the infor-
mation of the Commissioners, and stated thAt he would appear at the next regular meeting
to answer any questions that the Commiflsio-r might care to ask relative to the said aurl1 t.
Traffic -- AII-Ni~ht Parking
The Manager reported tha t in talking wi th city officials a t the Municipal Lea~ue
Meeting in Billings. August 4th and 5th, he gained the irrpression that practically all
cities in the state kept cars off their maln streets after 2 A. r.1. in order that street
cleaninp: operations could be carried on wi thout interrlJption durlng the early mortling hours.
Ci ty A ttorney Aitken and Ci ty Manager Q'uinnell reported further the t numerous ma tters
of mutual interest to cities and towns ran~ing from suburan fire districts to ways and
means of securlng additional revenue were discussed at the meet~ng, which was well attended.

Request -- Street Psrade and Carnival License fee Waived
A communication from the Junior ChaTber of Corr.merce askinf the City to waive all license
fees for the street parade and cr:rnival to be had in connection with their annual Roundup
to be held September 3rd and 4th, was presented and read. The communication stated that
as this favor had been granted to the Junior Chamber in former years, it was hoped that
the City Commission would continue this helpful and generous policy.
It was moved by Comrnissi oner Healy, seconded by Commissi oner Busch, that the request
be granted provided the City is not put to any additional expense for policing the streets
or otherwise, in connection with the proposed carnival, street parade or roundup, and the
motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe,
Commissioner Healy and Commissioner BuSCh; those voting No, none.
Right-of-Way to Milwaukee Railway Co.
A petition from the Chicago, Milwaukee, St. Paul and Pacific RRilroad Company, asking
permission for trackage encroachment upon the alley in Block F; of Rouse's Second Addition
to The City of Bozeman, was presented and read.
City Attorney Aitken explained the railroad's request for this easement, and stated
that a Resollltion granti.ng the Milwaukee Railway the right to cross said alley had been
prepared. He then presented Rf"solution No. 544, entitled:
RESOLUTION GRANTING TO THE TRUSTEES OF C~IICAGO, MILWAUKEE, ST.PAUL AND
PACIFIC RAILROAD COMPANY, T'-jEIR SFCESSORS AND ASSIGNS, THE RIGHT AND PERMIT
TO CROSS THE ALLEY IN BLOCK F OF ROUSE'S (SECOND) ADDITION TOTHE CITY OF BOZEMAN
It was mOiTed by Commi1'lsloner Healy, seconded by Commissioner Busch that the resolu-
tlon be passed and adopted and the motion was carried by the following Aye and No vote;
those voting Aye.being Mayor Landoe, Commissioner Busch and Commissioner Healy; those
voting No, none.
Adjournment
