SUBJECT: Unified Development Code (UDC) Update Public Hearing Cancellation
MEETING DATE: July 17, 2017

RECOMMENDATION: Staff recommends that the Commission cancel the public hearing.
The public hearing for the Unified Development Code (UDC) is noticed for Monday, July 17, 2017. The Zoning Commission and Planning Board held a public hearings on the draft
development code on Tuesday, July 11, 2017 and continued their deliberations to July 18, 2017. The Zoning Commission and Planning Boards are taking a thoughtful approach to their duties and a recommendation date is not known at this time.
Pursuant to 76-3-307, MCA, “In order to avail itself of the powers conferred by this part,
except 76-2-306, the city or town council or other legislative body shall appoint a commission, to be known as the zoning commission, to recommend the boundaries of the various original districts and appropriate regulations to be enforced therein. Such commission shall make a preliminary report and hold public hearings thereon before submitting its final report, and such
city or town council or other legislative body shall not hold its public hearings or take action
until it has received the final report of such commission.” Therefore, we regretfully recommend cancelling the public hearing at this time. Staff will re-notice the hearing when the Zoning Commission and Planning Board make their
recommendation to the City Commission.
