SUBJECT: Resolution 4831 – Allocation of Cash-in-Lieu of Parkland Dedication Funds to Oak Meadows Park Improvement Project MEETING DATE: July 17, 2017

RECOMMENDATION: Adopt Resolution 4831 to allocate $102,600 in cash-in-lieu of parkland
dedication funds for construction of improvements in Oak Meadows Park.
RECOMMENDED MOTION: In consideration of all public input and materials presented by
staff to date, I hereby adopt Resolution 4831 allocating $102,600 from the cash-in-lieu of
parkland dedication fund account for construction of improvements in Oak Meadows Park.
BACKGROUND: Section 38.27.030 (F.)(1.) of the Bozeman Municipal Code, (“Cash Donation in lieu of Land Dedication”) states: “The city shall use a cash donation for development or acquisition of parks to serve the development.” The plat for Oak Meadows subdivision includes a 2.2-acre public park and an additional $102,600 cash-in-lieu of parkland dedication was paid by Big River Development, Inc. (deposited 1/9/2007 per city Finance Department records) to make
up for the additional acreage expected at full buildout. The Homeowners Association (HOA) of Oak Meadows subdivision has submitted an application (Attachment A) for the use of $102,600 in cash-in-lieu of funds for development of the subdivision’s park. The proposal includes play equipment and site furnishings typically found in a neighborhood park. The total estimated cost of the project is $160,034. The Oak Meadows HOA is proposing to make up the difference with a
combination of cash and in-kind contributions.
The Parks Division will coordinate with the Oak Meadows HOA to oversee the project and all expenditures. The proposal includes purchase of play equipment and installation by volunteers. The items will be purchased by the city from a reputable manufacturer in accordance with the city purchasing policy. Daily on-site supervision will be provided by the manufacturer’s certified play
equipment installer. Several local contractors reside in the Oak Meadows subdivision and one of the contractors will serve as the HOA’s project manager. A license agreement with associated insurance requirements will be executed prior to construction.

UNRESOLVED ISSUES: None.
ALTERNATIVES: Per Commission.
FISCAL EFFECTS: An allocation of $102,600 to this project will leave a balance of $391,277
in the cash-in-lieu of parkland dedication account.

COMMISSION RESOLUTION NO. 4831
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING THE ALLOCATION OF CASH-IN-LIEU OF PARKLAND
DEDICATION FUNDS FOR IMPROVEMENTS TO OAK MEADOWS PARK
WHEREAS, the Oak Meadows Subdivision Homeowner Association has submitted an
application for the use of cash-in-lieu of parkland dedication funds for construction of a
playground and other improvements in Oak Meadows Park; and
WHEREAS, a cash-in-lieu of parkland dedication contribution of $102,600 was
received from Big River Development, Inc. to make up for a shortfall in parkland acreage required
to be dedicated with development of Oak Meadows subdivision;
WHEREAS, Section 38.27.030 (F.)(1.) of the Bozeman Municipal Code, (“Cash
Donation in lieu of Land Dedication”) states: “The city shall use a cash donation for development
or acquisition of parks to serve the development;” and
WHEREAS, the Recreation and Parks Advisory Board at their regular meeting of June
8, 2017 unanimously passed a motion recommending that Commission approve the allocation of
$102,600 from the cash-in-lieu of parkland dedication account to the Oak Meadows subdivision
park improvement project;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana,

Section 1 – Municipal Code Reference
In accordance with Section 38.27.030 (F.)(1.) of the Bozeman Municipal Code, the
cash-in-lieu of parkland dedication contribution provided by Big River Development, Inc. will
serve the Oak Meadows subdivision for which it was intended; and
Section 2 – Funding Authorization
The allocation of $102,600 from the cash-in-lieu of parkland dedication account is
hereby approved for the Oak Meadows subdivision park improvement project.
PASSED, ADOPTED, AND APPROVED by the City Commission of the City of
Bozeman, Montana, at a regular session thereof held on the 17th day of July, 2017.
