I have several concerns with the current application that I will speak to at the hearing on 7/12.
But before the hearing begins, I wanted to draw your attention to UDC section 38.520.030 C. which
states: "Buildings....containing....units whose only solar access (windows) is from the applicable side of the
building (facing toward the side property line) must be set back from the applicable side or rear property lines at
least 15 feet."
I am too underwater to find the pictures, but feel safe in assuming some of the units in this proposal have
windows that face only South. It is my understanding that the current application has the building set just 5 feet
off the South property line.
If this is the case, the application would need to be granted a variance or departure in order to gain approval (or
a building permit).
I hope you will address this (among other things) in your deliberations.
