The Commission of The City of Bozeman met in repular session in the Commission Room,
City Hall Building, Friday evening, September 22nd, 1944 at 7:30 o'clock P.M. Those being
present were Mayor Landoe, Commissioner Healy, Commissioner Busch; City Manager Quinnell,
City Attorney Aitken, Director of Finance Walter Davis, City Engineer Thorpe and the Clerk
when the following proceedings were had to-wit:
The minutes of the last reg1Jlar session were read, and it was moved by Commissioner
Healy, seconded b" Commissioner Busch th~\t the minutes be approved as read, and the motion
was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Com-
missioner Busch and COP'!mlssioner Healy; those voting No, none.
Resolution No. 546 -- Garbage Assessment
The Manager stated that the Resolution lev'ring the assessment for the collection and
disposal of garbage for the year 1944, in the amount of $10,884.13 had been prepared. He
presented and read Resolution No. 546, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA LEVYING
AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN
THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND
FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR 1944, TO
DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER
THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN, MONTANA.
It was moved by Commissioner Busch, seconded by Commissioner Healy that the Resolu-
tion be provisi~nally passed and September 29th, 1944, be set as the dAte for hearing pro-
tests and the motion was carried by the following Aye and No vote; those voting Aye being
Mayor Landoe, Commissioner Busch and Commissioner Healy; those voting No, none.
Resolu tion No. 547 -- Intention to Crea te SID No. 337..
The Manager stated that the City Attorney as instructed had prepared t~e Resolution
of Intention to create S. I. D. No. 337, for the construction of a sanitary sewer on Tam-
arack Street between Rouse and Church Avenues. He presented and read Resolution No. 547

IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DIS-
TRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NUMBER 337"
FOR THE PURPOSE OF INSTALLING A SANITARY SEWER ON EAST TAMARACK STREET IN SAID
CITY AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF SUCH INSTALLATION
AGAINST THE PROPERTY WITHIN SAID SPECIAL IMPROVEMENT DISTRICT SO CREATED AND
HEREIN DESCRIBED, ON THE FRONT FOOT BASIS, UNDER AND BY VIRTUE OF THE PROVI-
SIONS OF SECTIONS 5225 TO 5277, BOTH NUMBERS INCLUSIVE, REVISED CODES OF
MONTANA OF 1935 AND ANY AMENDMENTS THEREOF OR THERETO.

the motion was carried by the following Aye and No vote; those voting Aye be:tng Mayor

Resolution No. 548 -- Weed Assessment
The Manager stated that the Resolution levying the assessment for the removal of
weeds in the amount of $96.00 had been prepared. He presented and read Resolution No. 548,
entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZE1ffiN,LEVYING AND ASSESSING
A SPECIAL ASSESSMIENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN,
COTTNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF EXTERMINATION AND
REMOVAL OF NOXIOUS WEEDS FOR THE YEAR 1944 PURSUANT TO THE PROVISIONS OF ORDI-
NANCE NO. 428: "AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND
ABATEMENT OF CERTAIN NUISANCES."

It was moved by Commissioner Healy, seconded by Commissioner Busch that the Resolu-

Communication
A communication from the Junior Chamber of Commerce thanking the City Commission to~

the City's co-operation and help mJring their Fourth annual Roundup, was presented and read.
Springbrook Creek on Eleventh Avenue
,.
The Manager stated that a preliminary survey of the condition of Springbrook Creek
and Eleventh Avenue drainage had been made. It was stated that the present ditch on
Eleventh Avenue is apparently large enough to take care of the normal flow of the creek,
but it was thought that by replacing about 300 feet of the lO-inch tile that had been
found defective the normal flow from the spring that feeds this creek could be properly
taken care of as originally planned. This would rid the street of the present bog holes
caused by the leaking tile. It was thought, also, the t in order to take care of the
spring run off, an additional ditch could be constructed in the vicinity of Twelfth
AVenue to connect with the present channel north of the City.
It was also pointed out that at the time the Eleventh Avenue conduit was c.onstructed
Buser north of the City paid one-third of the construction cost; and it was decided that
before the City does any great amount of maintenance on this pipe line the City Attorney
should interview users of the water from Springbrook Creek to see what interest they
claim or have in the ditch with a view to securing their co-operation and sharing in
the cost of the proposed reconstruction.
Committee for V-Day Observance
The Mayor stated that with the approval of the City Commission he would appoint

the following on a committee to make plans for observance of the end of the war 1n Europe:
American Legion
Veterans of Foreign Wars
Chamber of Commerce
Ministerial Association
A. W. Coleman
Thad. Ely
Dean Chaffin
Walter C. Wampler
It was moved by Commissioner Busch, seconded by Commissioner Healy tm t the above-
named Committee be approved and tmt the Mayor also be a member of the Committee, em-
powered to act for the City Commission, and the motion was carried by the following dye
and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissiner
Busch; those voting No, none.
Ad10urnment
There being no further business to come before the Commission at this time, it was
moved by Commissioner Healy, seconded by Commissioner Busch that the meeting adjourn and
the motion was carried by the following Aye and No vote; those votin~ Aye being Mayor
Landoe, Commissioner Busch and Comml~sioner Healy; those voting No, none.
