HomeMy WebLinkAbout1944-10-13 170 Bozeman, Montana October 13th, 1944 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Friday evening, October 13th, 1944, at 7:30 o'clock P.M. Those being present were Mayor Landoe, Commissioner Healy, Commissioner Busch, City Manager Quinnell, City Attorney Aitken, Director of Finance Walter Davis, City Engineer Thorpe and the Clerk, when the following proceed:Lngs were had to-wit: The minutes of the lagt regular session were read, and it was moved by Commissioner Healy, seconded by Commissioner Busch that the minutes be approved as read, and the motion was carried by the followin~ Aye and No vote; those voting Aye being Mayor Landoe, Com- missioner Busch and Commissioner Healy; those voting No, none. Public Hearing S.I.D. No. 337 The Manager stated this was the time and place set for the public hearing on the crnation of S. I. D. No. 337, sanitary sewer on Tamarack Street between Rouse and Church Avenues. He presented the affidavit of publimtion of the notice and the Clerk's mailing certifica te the t all property owners had been notified. There being no one present to protest a nd no protests filed, it was moved b;T Commissioner Healy, seconded by Commissioner Busch that the City Attorney be instructed to prepare the Resolution creating said S. I.D. No. 337, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Busch and Commissioner Healy; those voting No, none. Resolution No. 550 Creating SIn No. 337 The Manager stated that the City Attorney as instructed had prepared the Resolution creating S.T.D. No. 337, sanitary sewer on Tamar~ck Street between Rouse and Chruch Avenues. He presented Resolution No. 550, entitled: A RESOLUTION OF THE CITY CO~ffISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS "SPECIAL IM- PROVEMENT DIS TRICT NnMBER 337" OF SAID CITY, FOR THE PURPOSE OF IN- STALLING A SANITARY SEWER ON EAST TAMARACK STREET, PURSUANT TO COM- MISSION RESOLUTION NO. 547 PASSED AND ADOPTED ON THE 22ND DAY OF SEPTE!mER, 1944, DECLARING THE INTENTION OF SAID COMMISSION TO CREATE SAID SPECIAL IMPROVEMENT DISTRICT NUMBER 337 FOR THE PURPOSE AFORESAID.- It was moved by Commissioner Healy, seconded by Commissioner Busch that the Resolution be passed and adopted and November 3rd, 1944, be set for the date for the open+ng of bids for the said installAtion and the motion was carried by the followlng Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Busch and Commissioner Healy; those voting No, none. Reports The following reports were presented and read: Director of Finance's report for September City Manager's report on Operating Cost for lst Quarter. It was moved by Commissioner Busch, seconded by Commissioner Healy that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner BUSCh; those voting No, none. Abatement of Taxes. An application of Mrs. Josephine O'Connell for abatement of a $5.28 assessment for garbage removal from the west 22~ feet of Lot 14, 15 and east st feet of lot 16; Block H; Original Townsite was presented and read. It was pointed out that although the house , 1 I 1 1 I 1 1'71 had been occupied less than two montha during 1944 it had not been vacant for six consecu... ti ve mon ths durinp: tha t period, and tha t therefore ac cording to a rule adopted previous 1 y by the Commission, the applicant would not ordinarily be enti tIed to an adjustment; bu t upon it being shown that the premises had actually been vacant for more than three-fourths of the time during the past year, it was moved by Commissioner Healy, seconded by Commis- siemer Busch that one-half of the assessment arom~ to $2.64 be aba ted and the motion was carriAd by the following Aye and No vote; those voting Aye being Mayor Lan10e, Commis~ioner Busch and Commissioner Healy; those voting No, none. Airport -- Renewal of Hangar Lease A communication from the Lynch Flying Service accompanied by a check for $240.00 covering hangar site lease until July 1, 1945 was presented and read. It was pointed out that the present lease expired July 1, 1944 but that it could be renewed upon the request of the lessee or by both parties. It wasmoved by Commissioner Busch, seconded by Commissioner Healy that the lease be renewed until July 1, 1945 subject to the approval of the Airport Board and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Busch and Commissioner Healy; those voting No, none. Nursery School Offer of FSA The offer of the United States Goverrment to increase the present federal aid allotment of $10,612 to $14,094, for the purpose of helping to finance ~lrsery School Project 24M5 and to extend the operation of the school from October 30th, 1944 to ~lne 30th, 1945, was presented, together with the following resolution of acceptance of said offer: ACCEPTANCE OF THE OFFER OF THE UNITED STATES OF AMERICA WHEREAS, there has been filed with the Federal Works Agnecy in behalf of The City of Bozeman (herein called the t~Ownern), an application for Federal assistance under the War Public Works program, and the UNITED STATES OF AMERICA, acting by and. through the Federal Works Administrator, has transmitted to the owner an Offer of Federal assist- ance in cormec tion with the public works referred to in said applica tion and described in said Offer; and WIlliREAS, said Offer has been duly read in open meeting, fully considered in accord- ance wi th all pertinent rules or procedure and legal requirements, and made a part of the Owner's public records; and WHEREAS, it is deemed advisable and in the public interest that said Offer be accepted: NOW, THER~~ORE, Be it resolved by the City Commission of the Owner that the said Offer, a true and correc t copy of which, including the TerlI1..8 and Conditions, is hereto attached, be and the same hereby is accepted witlntreservation or qualification. Passed by the aforementioned governing body of the Owner on the 13th day of October, 1944. Approved on the 13th day of October, 1944, by the City Manager of the Owner.
