The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Friday evening, January 14th, 1944, at 7:30 o'clock P.M. Those being
present were Mayor Landoe, Commissioner Healy, Commissioner Lowe, City Manager Quinnell,
City Attorney Aitken, Director of Finance Walter Davis and the Clerk, when the following
proceedings were had to-wit:
The minutes of the last regular session were read, and it was moved by Commissioner
lowe, seconded by Commissioner Healy that the minutes be approved as read, end the motion
was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, CommiS-
sioner Healy and Commissioner Lowe; those voting No, none.
Mr. George Schraeder was present and upon being asked by the Mayor if he had any
business to present to the Commission stated that he had just come to listen to the
proceedings.
City License
Re Beauty Parlors
Miss Elsie Tinsley, local beauty operator and member of the State Board of Hair
Dressers appeared before the Commission and stated the state law regarding beauty opera-
tors provided too t no add! tional license could be charged for the prac tice or teachIng of
of beauty culture or cosmetology; that she had been advised by Mr. Hayden of the State
Board that it is her duty to uphold the state law and that therefore she should not pay
the Bozeman City License. She said that other cities in the state were not collecting a
city lioense fee from operators.
The City Attorney stated that he did not feel that the license ordinance of The City
of Bozeman conflicts with state law, and that if Miss Tinsley did not pay the city license
a test oase could be made of the Ordinance to determine if the state law does, in fact,
prohibit the City of Bozeman from colleoting a license from beauty operators.
Fire Insuranoe
Mr. P. C. Waite and Harry Stith of the Bozeman Insurance Association appeared before
the Commission to explain a new form of fire insuranoe policy for city buildings which
their association had prepared. Mr. Waite stated this new form had been approved by the
state Board of Fire Underwriters; that it was substantially the same as the old form with
a few minor changes which gave the city more coverage a t no addi tlonal cos t; that the
assooiation had thought it advisable to have the City's records that are not placed in
fire-proof vaults, covered by fire insurance and had suggested $1000 to cover this item.
They stated further thet some $3000 insurance which was given to agents no longer
operating in the City had expired January let, 1944, and ~OOt. they would like to have
this insurance distributed by the City Commission. It was also explained that the forms
had to be specially prepared but that they could either be printed or mimeographed.
The Commission felt that the amount of insuranoe on the records outside the fire-proof
vaults could best be decided by the City Manager and the Direotor of Finance, and after
further discussion, it was moved by Commissioner Healy, seconded by Commissioner Lowe,
that $2000of the expired insurance be awarded to o. B. VanHorn and J. D. Francis, that
$1000 be awarded to the Heidel Agency and that the new forms be printed at the City's
expense, and the motion was carried by the following Aye and No vote; those voting Aye

It was moved by Commissioner Lowe, seconded by qommissioner Healy that theapplica-
tions be approved and the licenses issued and the motion was oarried by the following
Aye and No vote; those voting Aye being Mayor Landoe, ~ommlss:!loner Healy and Commissioner
Lowe; those voting No, none.
Garbage -- Request to be classed as a Business--Residence Property
A written request from Mrs. Alta Myers, to have her property at 322 North Willson
classified as a Business-Residence property for garbage assessment was presented and read.
It was pointed out that the buslness operated at this address is the renting of three
one-room cabins, and that no City License is paid to operate a business at this location.
After further disoussion, it was moved by Commissioner Healy, seconded by Connnis-
sioner Lowe that the request be denied and the motion was carried by the following Aye
and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner
Lowe; those voting No, none.
Post-War Planning Board
The Manager read communications from the American Legion nominating H. H. Dokken to
represent their organization on the City's Post-War Planning Board, and also a oommuni-
oation form the Rotary Club nominating B. C,. Parker to represent their club on this Board.
Ordinance No. 726 -- Amending License Ordinance
The Manager stated that in line with the request for a reduction in the basic fee
for service stations selling gasoline the matter of whether or not the present basic
license fee of $20.00 for these places should be reduced should be determined at this time.

After discussion, it was moved by Commissioner Lowe, seconded by Commissioner Healy
that the basic license fee be reduced to $10.00 for service stations and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commis-
sioner Lowe and Commissioner Healy; those voting No, none.

Ordinance No. 726, amending the License Ordinance so as to reduce the basic license
fee for filling stations to $10.00 was presented and read, entitled:
AN ORDINANCE AMENDING PARAGRAPH "(e)" OF SUB+DIVISION "B"OF SECTION 1,
AND SECTION 8, OF ORDINANCE NO. 637 OF THE CITY OF BOZEMAN, ENTITLED:
"AN ORDINANCE REQUIRING THOSE ENGAGED IN CERTAIN OCCUPATIONS, INDUS...
TRIES, TRADES, PURSUITS AND PROFESSIONS IN THE CITY OF BOZEMAN TO PAY
A LICENSE IN AID OF THE POLICE REGULATIONS OF THE CITY OF BOZEMAN,
PROVIDING FOR THE GRANTING, REFUSAL, SUSPENSION AND REVOCATION OF
SUCH LICENSES, PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE AND
REPEALING ORDINANCES NUMBERED 494, 508, 529, 535, 554 AND 581 OF SAID

THE LICENSE FEE TO BE -PAID BY GASOLINE FILLING STATIONS AND TO MAKE DISCOUNT
OF LICENSE FEES AVAILABLE-ONLY IF PAID ON OR BEFORE THE 15th DAY OF MARCH OF
THE YEAR IN WHICH THEY ARE PAYABLE.
It was moved by Commissioner Healy, seconded by Commissioner Lowe that the Ordinance
be passed and adopted and the motion was carried by the following Aye and No vote; those
voting Aye being Mayor Eandoe, Commissioner Healy and Commissioner Lowe; those voting No,
none.
Report
The C1 ty Manager's quarterly report on opera t10nal expend 1 tures for the period
ending December 31st, 1943 was presented and read. It was moved by Commissioner Healy,
seconded by Commissioner Lowe that the report be aocepted and ordered filed and the motion
was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Com-
missioner Lowe and Commissioner Healy; those voting No, none.
Report -- Officer Haas' Hearing
Copies of City Manager Qu1nnell's canclluslons in the hearlngof the suspension of
Officer Haas by Chief of Police Embry, recommending that Officer Haas be reinstated in
the Department of Public Safety, and citing the charges made by the Chief of Police and
Officer Raaa' reply to these charges, as presented in the transcripts, were presented
to the Commission and read by the City Manager.
After hearing the report of City Manager Quinnell regarding the Haas hearing, it
was moved by Commissioner Healy, seconded by Commissioner Lowe that the City Manager be
commended on his just decision and the manner in Which the case was handled, and that
the City Commission 1s in full accord with the action of the City Manager, and the motion
was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Com-
missioner Lowe and Commissioner Healy; those voting No, none.

There being no further business to coma before the Commission at this time, it was
moved by Commissioner Healy, seconded by Commissioner Lowe that the meeting adjourn and
the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Landoe, Commissioner Lowe and Commissioner Healy; those voting No, none.
