Bozeman, Montana April 7th, 1944 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Friday evening, April 7th, 1944, at 7:30 o'clock P.M. Those being present were Mayor Landoe, Commissioner He~ly, Commissioner Lowe, City Manager Quinnell, Director of Finance Walter Davis, City Attorney Aitken, City Engineer Thorpe and the Clerk, when the followin~ proceedings were had to-wit: The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded by Commissioner Lowe that the minutes be approved as read, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Com- missioner Healy and Commissioner Lowe; those voting No, none. 1 Application for City License The application of the Park Barber Shop for a City License was presented and read. It was moved by Commissioner Healy, seconded by Commissioner Lowe that the application .; be approved and the license issued and the motion was carried by the following Aye and No vote; those voting Aye being ~ayor Bandoe, Commissioner Healy and Commissioner Lowe; those voting No, none. Claims for the Month Claims Nos. 6161 to 6297 inclusive were presented on the various funds as follows: C sme tery Garbage General Library Park Water P. L. & P. Revolving To ta 1 $ 456.02 876.65 6,446.16 609.43 544.45 31,724.43 3.46 150.00 505.30 390.00 93.75 467.67 1,890.00 $ 44,217.32 I The Manager stated he has audited these claims and finds them to be true and lawful claims against The City of Bozeman, and recommends that warrants be drawn for their pay- ment, After examination of the claims in detail by the Commission, it was moved by Com- missioner Healy, seconded by Commissioner Lowe that warrants be drawn for their payment and the motion was CArried by the following Aye and No vote; those voting Aye being Mavor Landoe, Commissioner Healy and Commissioner Lowe; those voting No, none. Claims Nos. 83 to 96 inclusive in the amount of $725.45 for the operation of the Nursery School during March were presented. After examination of the claims by the Com- mission, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the claims be ordered paid, and the motion was carried by tJ-e following Aye and No vote; those vot- ting Aye being Mayor Landoe, Commissioner Healy and Commissioner Lowe; those voting No, none. Clai.m of A. N. Haas The claim of A. N. Haas, in the amount of $385.75, for salary as Police Officer durin~ the time of his suspension from November 20th, 1943 to January 30th, 1944, was 1 presented and read. From the discussion that followed, it was pointed out that there was no delay on the part of The City of B07.eman in h~ving the hearing before the Director of Public Safety, the tit was de termined from the evidence a t the hearing tha t the cha rges agains t Officer Haas were serious enmJt;rh to warrant his suspension until February 1, 1944, and that the 1 I ;1 115 Chief of Police was ,1uatified in suspendinp; the officer; but as shown in the conclusions of the Director of Public Safety, the charges were not Seri01JS enough to warrant his dis- missal. Attention was called to the fact the t suspension w1 th pay would be in effect the same as a vacation with pay and could not be considered a disciplinary measure; and also tha t only in case the evidence at the hearing had shown there was not sufficient reason for the suspension or that his suspension was unjustified would Officer Haas be entitled to draw his salary durin~ the time of"s~ch suspension. City Attorney Aitken stated that in view of the circumstances, it was his opinion the claim did constitute a lep;al obllp:ation of the City, whereupon, City Manager Quinnell recommended that the claim of Officer Haas be disallowed, and it was moved by Commissioner Healy, seconded by Comm:ts~ioner Lowe that the claim be disallowed and the motion was car- ried by the following Aye and Eo vote; those vo tine; Aye being 1\la yor Landoe, Commis sioner Healy and Commissioner Lowe; those voting No, none. Reports The following reports for the month of March, 1944 were presented and read: Police .Judge Police Chief Fire Chief Cashier Cemetery Board Water Collector Employment Officer Plumbing Inspector Director of Finance It was moved by Commissioner Lowe, seconded by Commissioner Healy that the reports be accepted and ordered filed and the motion was carried by the following aye and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Lowe; those voting No, none. Bonds -- Chief Embry and Officer Kinyon The bond of Roy Embry as Chief of Police in the amount of $2000.00 and the bond of Gail Kin,yon as Police Officer, in t he amount of $1000.00, were presented. The bonds were approved as to form by the City Attorney, whereupon, it was moved by Commissioner Healy, seconded by Commissioner Lowe that the bonds be approved and accepted and the motion was carried by the followin~ Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Lowe; those voting No, none. Resolution No. 538 Transferrlng SID Revolving Monies to General Fund The Ma.nager stated that the Resolution transferring sufficient money from the Special Improvement District Revolving Fund to the General Fund to cover 90% of the par value of bonds outstanding in SID No. 155 that constituted a general ob1io:ation of the City, and for the payment of which the City is liable, had been prepared. He presented and read Commission Resolution No. 538, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY 01" BOZEMAN, MONTANA, ORDERING MONEY TRANSFERRED FROM THE SPECIAL IMPROVEMENT DISTRICT REVOLVING FUND OF SAID CITY TO THE GENERAL FUND OF SAID CITY, It was moved by Commissioner Healy, seconded by Commissioner Lowe that the Resolution be passed and adopted and the motion was carried by the following Ayeand No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Lowe; those voting No,none. Ordinance No. 727 -- Railroad Spur on East Curtiss A pet! tion from the Trus tees of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company, requesting' an 8-?t-foot easement for their tracks across East Curtiss Street between South Wallace and the first alley west, to serve the Galla tin Valley Seed Company's ware- house was presented-and read. 1.1fl The matter having been discussed at former meetings of the Commis_slon, an Ordinance granting permission to the Milwaukee Railroad to lay and construct-a railroad track across Curtiss Street at the point and under the terms and conditions set forth in the said Ordinance was then presented and read, entitled: AN ORDINANCE GRANTING, SUB.JECT TO CERTAIN TERMS AND CONDITIONS, PERMISSION TO CHICAGO, MILWAUKBE, ST. PAT~ AND PACIFIC RAILROAD COMPANY, A CORPORATION, TO ALY AND CONSTRUCT A RAILROAD TRACK UPON, OVER AND ACROSS CURTISS STREET IN THE CITY OF BOZEMAN. It was moved by Commissioner Healy, seconded by Commiss1aner Lowe that the Ordi- nance be provisionally passed and April 14th, 1944 be set as the date for final passage and the motion was oarried by the following Aye and No vats; those votin~ Aye being Mayor Landoe, Commissioner Healy and Commissioner Lowe; those voting No, none. Police & Firemen Vacancy City Manager ~linnell announced that Walker T. Walker had been appointed to fill a vacanoy in the Fire Department caused by William Penttila being called for servioe in the Navy and that Archie Coleman would take the place of Robert Mullica, the police officer, who leaves for Army Service April 17th, 1944. Commissioner Lowe announced that he was also being called to the armed services on April 17th, 1944. Investwent CPC Funds The Direotor of Finance announced there was $4000.00 in the Cemetery Permanent Care Fund the t should be inves ted. It was moved by Commissioner Healy, seoonded by Commis?ioner Lowe that the Direotor of Finance be authorized to invest $4,000.00 of Cemetery Permanent Care Funds in Series G War Bonds and the motion was carried by the following Aye and No"vote; those voting Aye being Ma yor Landoe, Commis ~doner Lowe and. Commissioner Healy; those voting No, none.
