The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Friday evening, April 14th, 1944, at 7:30 o'clock P.M. Those being
present were Mayor Landoe, Commi8sioner Healy, Commissioner Lowe, City Attorney Aitken,
Cl ty Manager Q,uinnell, Director of Finance Walter Davis and the Clerk, when the following
proceedings were had to-wit:
The minutes of the last regular session were read, and it was moved by Commiffi1..oner Lowe,
seconded by Commissioner Healy that the minutes be approved as read, and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner
Healy and Commissioner Lowe; those voting No, none.
Ordinance No. 727 -- Railraod Easement
The Manager stated this was the time and place, set for final passage of the Ordinance
e;rantlng the Chica~!O, Milwau.kee, St. Paul and Pacific Railroad Company an ea~ement to cross
East Curtiss Street with a railway spur to serve the Gallatin Valley Seed (]ompany's ware-
house. He presented Ordinance No. 727, as provisionally passed at the meeting of April
7th, 1944, entitled:
AN ORDINANCE GRANTING SUB.TECT TO CERTAIN TERMS AND CONDITIONS, PERMISSION
TO CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD COMPANY, A CORPORATION
TO LAY AND CONSTRUCT A RAILROAD TRACK UPON, OVER AND ACROSS CURTISS STREET
IN THE CITY OF BOZEMAN.
It was moved by Commissioner Healy, seconded by Commissioner Lowe that the Ordinance
be finally passed and adopted and the motion was carried by the following Aye and No vote;
those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Lowe; those votIng
No, none.
Leave of Absence -- Commissioner Lowe
City Manager Q,uinnell read the written request of Commissioner Lowe for a leave of
absence as City Commissioner beginning April 17th, 1944 and continuinrr, for the duration of
the war or until he is discharged from military ~ervice.
Mayor Landoe and Commissioner
Healy expressed regret that the wars demand made Commissioner Lowe's action unavoidable.
It was, thereupon, moved by Commissioner Healy, seconded b" Mayor Landoe that the
leave of absence be granted to Commissioner Lowe and the motion was carried by the follow-
ing Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and those
voting No, none. Commissioner Lowe not voting.
Busch Named as City Commissloner
Mayor Landoe stated that the vacancy in the City Commission caused by Commis~ioner
Lowe being called into the armed services should be filled at this time. It was pointed
out that similar vacancies had, on former occasions been filled by the appointing the can-
didate having the next highest number of votes to the RuccesAful candidate at the last
election, but that this was not mandatory.
All Commis~ioners expressing their approval of the appo1.ntment of Paul Busch to fill
t1e office vacated by Commissioner Lowe, it was moved by Commissioner Healy, seconded by
Commissioner Lowe that Mr. A. G. Busch be named as City Comm~ssloner to hold office for
the unexpired term of W. G. Lowe, provided that should W. G. Lowe return before the ex'"
piration of the term for which he was elected he will be reinstated as Commissioner upon
his making applicntion for such reinstatement, and the motion was carried by the following
Aye and No vote; those voting Aye be~!_ ng Ma;ror Landoe. Commis s ioner Healy and Commis R ioner
Lowe; those voting No, none.

Commis:!.oner Lowe asked to be Excused, and Permission was Granted.
Applications for City Licenses
The followin~ applications for City Licenses were presented and read:
G. W. Harker
Bobcat Inn
Coffee Cottage
Bozeman Creamer;,
B-B Cafe
It was moved by Commissioner Healy, seconded by Mayor Landoe that the applications
be approved and the licenses issued and the motion was carried by the following Aye and
No vote; those voting Aye being Mayor Landoe, COMmissioner Healy; those voting No, none.
Reports
The following reports for the month of March were presented and read:
City Engineer
Nursery School
and the City Manager's Quarterly Report of Operating Costs.
It was moved by Commissioner Healy, seconded by Mayor Landoe that the reports be
accepted and ordered filed and the motion was carried by the following ~ye and No vote;
those voting Aye being Mayor Landoe and Commissioner Healy; those voting No, none.
Ad,journment
There being no further business to come before the CommiSSion at this time, it was
moved by Commissioner Healy, seconded by Mayor Landoe that the meeting adjournand the
motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe
and CommisAioner Healy; those votin~ No, none.
