The Commission of The Oi ty of Bozeman met in regular session ln the Commie sion Room,
City Hall Building, Frida;, evening, May 19th, 1944, at 7:30 o'clock P.M. ThoRe beinp'
present were Mayor Lanaoe, Commissioner Healy, Commissioner Bu~ch, City Manager Quinnell.
City Attorney Aitken, Director of Finance Walter Davis, City Engineer Thorpe and the
Clerk, when the followin~ proceedin~s were had to-wit:
The minutes of the last rep"lJlar session were read, and it was moved by Commissi0ner
Healy, seconded by Commissioner ~lsch that the minutes be approved as read, and the motion
was carried by the fo110winp: Aye and No Vo te; those voting Aye being Ma :Tor Landoe, Com-

Resolution No. 539 -- Sprinkling Assessment, 1944
The Manarrer stated that the Resolution levyinp: the sprinklina: diRtrict assessments
for the year 1944., in the amount of $1,246.10, had been prepareci. He presented Resolution
No. 539, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESS-
ING A SPECIAL ASSESSMENT OFTAXRS UPON ALL THE PROPEPTY IN STREET SPRINK-
LING DISTRICTS OF THE CITY OF BOZF,MAN, COUNTY OF GALLATIN, ST!\TE OF MONT-
ANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITH-

Resolution No. 540 -- Lighting Maintenance for 1944

amount of $2,555.35 for the various city lightinq; maintenance districts had been prepared.

and prepared by the Cit;T Enn:ineer. The Commispion necided to set Thursday, May 25th, 1944

Ariport -- Resolution No. 542
The Commission considered the matter of its conference with the Board of County
Commissioners of Gallatin C01mty wi th refernece to the proposal that the County pr11chase
a one-half interest in Calla tin Field -- the Airport property. The proposed resolution
[1;i ving effec t to the agreement, as amended by the Ci ty Attorney, pursuant to the in-
structions of the Commission, was read, and bein,cr found in accord with the understanding
reached wi th the C01mty Commis sioners, it was moved by Commis s ioner Busch, seconded by
Commissioner Healy that the Resolution, entitled:

Airport -- Payment of ,Judgement -- Slaughter House Tract.
The matter of aettlement of the 111d~ment in tne matter of what is known as the
condemnation of the Brady Tract as a part of Gallatin Field was brourht lip for consid-
eration in connection with the proDosed sale of a one-half interest in the Gallatin
Field propert~T to Galla tin County. The Ci t;T Attorney expalined the t the Commissioners
in the condemnation proceed:lngs had awarded the owners of the property $500.00 as its
value and this amount had been deposi ted wi th the Clerk of the District C011rt as the
law prOVides, and the City has been ever since and is now in possession of the property.
Its titlA to it has not, however, been confirmed by the reason that the owners of the
property appealed from the award of the Commissioners; and upon the trial of the appeal,
the 1ury had awarded. $980.00 al'1 the value of the property, and judgment had been entered
for tha t amount. But 'lpon motion of the Ci ty, the .1udQ'men t had been se t a side and a
new tria 1 ITran ted and the s i tUB tion stands thu sat the presen t time.
The Cit;T Attorney explained that this situation, with reference to the Slauo:hter

Honse Tract, mlrrht comnlicate the neroiations with the County; that there was no tell-
ing what a .1urv WOllld do upon a new trial as to increasing or decreas:1ng the award,
and in view of the whole si tue tion, he was of the opinion the tit would be wise to
pay the judgment as it stands, end the litigation, and ~et final and complete title to
the property involved. That in addition to the $500.00 on deposit with the Clerk of

the Court, it would take $610.61 to satisfy the .1udgment and clear the record.

After full discussion, it was moved by Commis1'l'ioner BU1'lch, seconded by Commis8ioner
H81'l1y that the recommendatiol1 of the City Attorney be adopted as the .1udp;ment of the Com..
mission; that the City Attorney be authorized to pay for the City, the additional sum of
$610.61, and that the Clerk of the Commission draw a warrant on the Airport Fund, in favor
of the City Attorney for th~t amount upon his presentation of a claim therefor, and the
motion was carried bv the followinp- Aye and No vote; those voting Aye being Mayor Landoe,
Commissioner Healy and COmmis"ioner Bu~ch; those votinp: No, none.
Airport -- Renewal of ACS Lease & Radio Range Contract
The Manager presented the request of the Federal Government to renew the contract
lease for the Radio Ran~e Facility on the Pondera Tract and tne lease for the Communica-
tion Station on the Airport. It was moved by Commissioner Healy, seconded by Commissioner
Busch that the contract and the lease be approved and renewed and the motion was carried
