HomeMy WebLinkAbout1944-05-26 130 .Boz eman, Mon tana May 26th, 1944 The Commission of The City of Bozeman met in regular session in the, Commission Room, City Hall Building, Friday evening, May 26th, 1944, at 7:30 o'clock P.M. Those being present were Mayor Landoe, Commissioner Healy, Commissioner Busch, City Manager Quinnell, City Attorney Aitken, Director of Finance Walter Davis, City Engineer Thorpe and the Clerk when the following proceedings were had to-wit: The minutes of the last regular session were read, and it was moved by Commissioner Healy, seconded by Commissioner Busch that the minutes be approved as read, and the motion was carried, by the following Aye' and No ~te; those voting Aye being Mayor B'~, Com.. missioner Healy' and Commissioner Busc.h; those voting No, none. Resolution No. 539 ..- Sprinkling Assessment The Manager stated this was the time and place set for the hearing of protests to the final adoption of the Resolution levying the assessment for the street sprinkling districts for the year 1944. He presented and read affidavit of publication of the Nntice, and there was no one present to protest and no protests filed, he presented Resolution No. 539, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLA TIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1944, It was moved by Commissioner Busch, seconded by Commissioner Healy that the Resolu- tion be finally passed and adopted and the motion was carried by the following Aye an4 No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Busch; those voting No, none. Resolution No. 540 -. Lighting Assessment The Manager stated this was the time and place set for the final passage and adop- tion of the Resolution levying the lighting maintenance assessment for the year 1944. He presented the affidavit of publication of the Notice and stated there were no protests filed and no one present to protest. He presented Resolution No. 540, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CUrRENT COSTS FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS NUMBERS 100, 284, 288, 289, 290, 295, AND 300 OF THE CITY OF BOZEMAN, PURSt~NT TO THE PROVISIONS OF SECTION 5266, R.C.M. 1935. It was moved by Commissioner Healy, seconded by Commissioner Busch that the resolution be finally passed and adopted and the motion wa~ carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Busch and Commissioner Healy; those voting No, none. Resolution No. 541 -- Parking Maintenance Assessment The Manager stated this was the time and place set for the hearing of protests to the final adoption of the resolution levying the parking maintenance assessment for the year 1944. He presented the affidavit of publication of the Notice and stated that no pro- tests were filed and no one was present to protest. Ordinance No. 728 -- Curfew Ordinance The Manager stated that the City Attorney, as instructed, had prepared the Ordinance placing the responsibility for the action of minor children ~pon the parents and guardians and presented and read Ordinance No. 728, entitled: AN ORDINANCE OF THE CITY OF BOZEMAN TO REGULATE AND CONTROL THE PRESENCE OF MINORS UNDER THE AGE OF SIXTEEN YEARS IN PUBLIC PLACES WITHIN SAID CITY DURING CERTAIN HOURS: MAKING PARENTS AND OTHERS HAVING THE CONTROL OR SUPERVISION OF SUCH MINORS LIABLE FOR VIOLATIONS HEREOF BY SUCH MINORS: PROVIDING PENAL- TIES FOR VIOLATION HEREOF AND REPEALING ORDINANCE NO. 720 OF THE CITY OF BOZEMAN AND ALL OTHER ORDINANCES A1~ PARTS OF ORDINANCES IN CONFLICT HEREWITH. It was moved by Commissioner Healy, seconded by Commissioner Busch that the Ordinance be passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Busch; those votlng No, none. ~)rchase -- Police Uniforms The Manager reported that the uniforms of the Police Department needed to be replaced. The CommisSDn expressed approval, and the City Manager stated that he would invite local dealers to submit bids for these uniforms. Airport The City Attorney reported that in accordance with his inst~lctions from the City Commission, he had deposited an additional $610.61 with the Clerk of the Court for the sat- isfaction of the Brady Judgment, and that therefore t~e City's title to the Brady Tract which is a part of the Gallatin Airport Tract is now clear. Misc. W & C 1944. The City Engineer acting under the provisions of Section 5244 and 5039.64 R.C.M. 1935, and the provisions of Ordinance No. 561, relative to the construction of Misc. W & C without the formation of a special improvement district, having submitted his report and recommenda- tions for 1944 in detail with reference to needed sidewalk and curb repairs, and the City Commission having checked the report and made personal inspection of the defective side- walk and curb ~~ with the City Manager and City Engineer, it was moved by Commissioner Healy, seconded by Commissioner Busch that the ~eport of the City Engineer covering the repair and/or installation of Misc. W &: C 1944, be and the same is hereby accepted and approved, and the recommendations therein contained adopted; that the defective sidewalks and curbs enumerated and described in the said report be repaired or rebuilt before July 15th, 1944, that said report of the City Engineer is hereby referred to and made a part of this minute ent~y in the same manner and to the same effect as though herein set forth at length for the purpose designating and identifying the streets and avenues on which such new installation and/or repairs are to be made; that the City Manager is hereby instructed to give, or cause to be given, notice to each owner or the agent of such owner, of the property along which such new installation and/or repair is to be made as required by law, and in accordance wi th the provisions of Ordinance No. 561, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissi oner Healy 13~2 and Commissioner Busch; thOS& voting No, none.
