Bozeman, Montana June 23rd, 1944 The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Friday evening, June 23rd, 1944, at 7:30 o'clock P.M. Those being present were Mayor Landoe, Commissioner Healy, Commissioner Busch, City Manager Quinnell, City Attorney Aitken, City Engineer Thorpe and the Clerk, when the following proceed;.ngs were had to-wit: The minutesof the last regular session were read, and it was moved by Commissioner Healy, seconded by Commissioner Busch that the minutes be approved as read, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commis- sioner Healy and Commissioner Busch; those voting No, none. Misc. W & C 1944 Mr. H. E. Morris and Mr. P. C. Gaines appeared before the Commission to request that the order for the Amigo House Corporation to construct a new sidewalk on Lots 17 to 20; Block 35; Capitol Hill Addition, be extended until after the "Durationu. The gentlemen stated that the organization was not active at the present time, and that therefore their home on South Third has been boarded up and is an expense with no income. The Commission's attention was also called to the fact that only two houses to the south would be served by this walk and as there is very little traffic on thl$ street, the pavement could be used by pedestrians until such a time as the boys of the organization, most of whom are now serving with our armed forces, return. The walk could then be built as a post-war project. rather than at the present time when it was felt that the construction was not absolutely necessary. The gentlemen were informed by the Commission that the cost could be spread over a period of approximately five years and need not therefore be burdensome. After further consideration of this request, it was moved by CommiSSioner Healy, seconded by Commissioner Busch that the order as made May 26th, 1944 should stand, and the motion was carried by the following ~ye and No vote; those voting Aye being May'or Landoe, Com- missioner Healy and Commissioner Busch; those voting No, none. The Manager reported that the Northern Pacific Railway Company had made a request to replace their defective concrete sidewalk on Ida Avenue, that bas been ordered repaired, with a good cinder walk. It was moved by Commissioner Healy, seconded by Commissioner Busch that, as there is practically no travel over this sidewalk at the present time, the request be granted and perm1ssion given to use cinders for this improvement, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Busch and Commissioner Healy; those voting No, none. A request from Mrs. Nellie M. Barnes, owner of property at 511 North Wallace, asking an extension of time to repair sidewalk, was presented and read, stating it was her inten- tion to sell this property and if it was not Bold within a reasonable time, that she wonld repair the walk. It was decided to inform Mrs. 8arnes that she has until July 15th to make the necessary repairs or make arrange~ents to have the repair work done. A reouest from the H. B. McCaY estate, asking extention of time until September 1st, to make the sidewalk repairs at 526 East Main was presented and read. Its ta ted tha t this property has some heavy machinery on it and th9t this equipment is to be sold in the near future. It was furtr:er stated that as the heavy equipment will have to be moved over 140 the sidewalk it would probably be best to delay construction until after this was done to avoid damaging the new walk. It was moved by Commissbner Healy, seconded by Commis&oner Busch that an extension of time be granted in accordance with the request and the motion was carried by the follow- ing Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Busch and Commiss1ner Healy; those voting No, none. Sale of Beer in Grocery Stores Mr. Joe Hansford was present and stated that if granted permission to sell beer at the Safeway Store, of which he is manager, his company would do its best to abide by all rules and regulations. City Attorney Attken presented a written opinion regarding the sale of beer in Grocery Stores~ which was read. Mr. Aitken explained that the distinction between a "wholesaler" and "retailer" as made in the Montana Beer Act was adopted by the City of Bozeman for their Beer Ordinance, and that therefore, a wholesaler has to sell beer in quantities of at least two gallons, in the original package for consumption off the premises. While a retailer can sell beer in any type of container for comsumption on or off the premises. It was further explained that the present Ordinance does not limit the number of whole- salers, but does limit the number of retailers; and that in any case an application for the proper beer license should be presented to the Commismon for its consideration and allowance or disallowance. The request that the ordinance be amended so that beer could be retailed in grocery stores was carefully considered, and it was moved by Commissioner Busch, seconded by Com- missioner Healy tha t the issuing of another re tailer's license would be con trary to Or- dinance No. 6~1, and that as the present number of such licenses issued seemed adequate for the purpose, the City Commis s inn take no Be tion to further the sale of beer at this time, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Busch; those voting No, none. Report The report of the Bu:c,lding Inspector for the months of November and December, 1943, anf from January to June, 1944 was presented and read. It was moved by Commissioner Busch, seconded by Commissioner Healy that the report be accepted and ordered filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Busch; those voting No, none. Resolution No. 543 -- Snow Assessment The Manager stated that the Resolution levying the snow assessment for 1944, in the amount of $518.23, for removal of snow from sidewalks had been prepared. He presented and read Resolution No. 543, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CER TArN PROPERTIES IN THE CITY OF BOZEVAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF REMOVAL OF SNOW FOR THE YEAR 1943-1944 PURSUANT TO PROVISIONS OF ORDINANCE NO. 502, ENTITLED: "AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW FROM THE SIDEWALKS IN THE CI'rY OF BOZEMAN AND REPEALING ORDINANCE NO. 385, ENTITLED: 'AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW AND ICE, DIRT, FILTH AN:~' OTHER OBSTRUCTION FROM SIDEWALKS ON MAIN STREl1~T BET\lVEEN WALLACE AVENUE AND FOURTH AVENUE IN THE CITY OF BOZEMAN'" See Insert Page 141 Transfer of Funds -- Band to Park Fund The Manager stated that in order to provide better facilities for youth training guidance, money remaining in the Band Fund after proper allowances had been made for 1 1 1 1 I 1 141 musical entertainments and for Armory payments, should be transferred to the Park Fund for Recreational purposes, and that this transfer should be made before the end of the current fiscal year. Whereupon, it was moved by Commissioner Healy, seconded by Commissioner Busch that the sum of Four Thousand Dollars be and the same 1s hereby transferred from the Band ~lnd to the Park Fund for recreational purposes and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Landoe, Commissioner Healy and Commissioner Bu sch; those voting No, none.
