HomeMy WebLinkAbout1943-07-02 40 Bozeman, Montana July 2nd, 1943 The Co~mission of The City of Bozeman met in regular session in the Commission Room, City Hall Building, Friday evening, July 2nd, 1943, at 7:30 o'clock P.M. Those being present were Mayor Busch, Commissioner Sorenson, Commissioner Landoe, City Attorney Aitken, City Manager Quinnell, City Engineer Thorpe, Director of Finance Walter Davis and the Clerk, when the following proceedIngs were had to"'wi t: The minutes of the last regular session were read, and it was moved by Commissioner Sorenson, seoonded by Commissioner Landoe that the minutes be approved as read, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. Reports The following monthly reports for the month of June were presented and read: Cashier Librarian Fire Chief Water Collector Police Chief Police Judge and the semi-annual and annual report of the Fire Department. It was moved by Commissioner Landos, seconded by Commissioner ~orenson that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote; fuose voting Aye being Mayor Busch, Commissioner Sorenson and Commis~oner Landoe; those voting No, none. Amendment to Beer Ordinance The Manager read a ohange in the state law whereby retail establishments may not sell beer during the following hours: Sunda ys Week Days from 2 A. M. to 1 P. M. from 2 A. M. to 8. A. M. The matter was discussed and City Attorney Aitken was instructed to prepare an a~endment to the present Ordinance prohibiting the sale of beer in local establishments as follows: Sundays from 1 A. M. to 1 P. M. Week Days from 1 A. M~ to 8 A. M. Claims for the Month Claims No. 4807 to 4963 ino1usive were presented on the various funds as follows: Cemetery General Library Park Water Band Garbage War Bond Cemetery Suspense SID Fund SID Revolving Total $ 1,345.81 6,254.73 494.05 1,335.77 2,114.51 4,300.50 861.80 183.05 430.00 165.26 804.46 $ 18;a89.94 The Manager stated he has audited these claims and finds them to be true and lawful clafms against The Ci ty of Boo eman and recommends tha t warrants be drawn for their pay'" ment. After examination of the olaims in detail by the City Commission, it was moved by Commis sioner Landoe, seconded by Commissi or~er Sorenson tha t the claims be ,allowed and warrants drawn for their payment and the motion was carried b~;' the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. I .. .1 I I ,I' - - ~ . I 41 Bond -- Garbage Contract The 6f.ficial bond of J. S. Miles in the amount of $2,536.25, for the garbage hauling contract for the fiscal year ending June 30th, 1944 was presented. The bond was approved as to form by the City Attorney, whereupon, it was moved by Commissioner Sorenson, seconded by Commissioner Landos that the bond be accepted and filed and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. Airport -- Yearly Budget Deap Chaffin, Chairman of the Airport Board, appeared before the Commission and pre- sented a budget estimate for maintenance and operation of the Gallatin Airport as approved by the Airport Board, for the fiscal year ending, June 30th, 1944. After examination of the estimate in detail, it was moved by Commissioner Landoe, seconded by Commissioner Sorenson that the proposed budget estimate be approved and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. Resolution No. 529 -- L~ghting Assmt. -- Final Passage The Manager stated this was the time and place set for hearing protests to the final passage of the resolution levying the assessment for maintenance of the various street lighting districts for the year 1943. The Manager presented and read the affidavit of publication of the notice to property owners. As there was no one present to protest and no protests had been filed, it Was moved by Commissioner Landoe, Reconded by Com- missioner Sorenson that Resolution No. 529, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS NUMBERS 100, 284, 288, 289, 290, 295, AND 300 OF THE CITY OF BOZEMAN, PURSUANT TO THE PROVISIONS OF SECTION 5266 R. C. M. 1935. be finally passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson arid Commissioner Landoe; those voting No, none. W & C 1943. The City Engineer acting under the provisions of Section 5244 and 5039.64 R. C. M. 1935, and the provisions of Ordinance No. 561, relative to the construction of MISC. W&C without the formation of a special improvement district, having submitted his report and recommendations for 1943 in detail with reference to needed repairs, and the City Com- mission and City Manager having checked the report and made personal inspection as to the recommendations of the City Engineer, it was moved by Commissioner Sorenson, seconded by Commissioner Landoe that the report of the City Engineer covering the repair and/or in- stallation of Misc. W & C 1943, be and the same is hereby accepted, approved and adopted; that the defective sidewalks enumerated and descirbed in the said report be made before August 3rd, 1943; that said report of the City Engineer is hereby adopted and referred to and made a pnrt of this minute entry by such adoption and reference for the purpose of designating and identifying the streets and avenues on which such new installation and/or repairs are to be made; that the City Manager is hereby instructed to give, or cause to be given written notice to each owner or the agent of such owner, of the property along which such new installation and/or repair is to be made as required by law, and in 4~~ accordance with the provisions of Ordinance No. 561, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Com.mlAsloner Land08; those voting No, ,none. Nursery School The matter of the City Spons?ring the Beall Park Nursery School and applying for Lanham Act t'unds was discussed by the Commission. The Manager reported that Mrs. 'l'&11- man, school supervisor, was getting information from the various service organizations as to their monthly pledges for maintenance of the school and that satisfactory progress was being made in the matter of securing funds. The application to the Federal Government for The City of Bozeman to act as sponsor of the school was then presented and read. It was moved by Commissioner Sorenson, seconded by Commissioner Landoe that the ap- plication be signed and forwarded to the Federal Government for approval and the motion was carried by the following Aye and No vote; those voting Aye be.tng Mayor Busch, Com- missioner Landoe and Commissioner Sorenson; those voting No, none. Budge t 1943 The preliminary budget estimates for the fiscal year ending June 30th, 1944, were presented, read, and exp1ain8d by the City Manager. Copies were then presented to the Commission and the proposed budget estirrates were taken under advisement. Adjournment There being no further business to come before the Commission at this time, it was moved by Connnissl oner Landos, seconded by Commissior,er Sorenson that the meeting adjourn, and the motion was carried by the 1b11owing Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Commis~ oner Landoe; those voting No, nene.
