HomeMy WebLinkAbout1943-07-23 4.fi Bozeman, Montana July 23rd, 1943 The Commission of The Ci ty of Bozeman met in regular session in the Connnission Room, City Hall Building, Friday evening, July 23rd, 1943, at 7:30 o'clock P.M. Those be~ng present were Mayor Busch, Commissioner Landoe, Commissioner Sorenson, City At- torney Aitken, City Manager Quinnell, Director of Finance Walter DaVis, City Engineer Thorpe, and the A~ing Clerk, when the following proceedings were had to-wit: The minutes of the last regular session were read, and it was moved by Commissioner Sorenson, seconded by Commissioner Landoe that the minutes be approved as read, and the motion was carried by the following Aye and No vote; those voting Ayebeing Mayor BuSCh, Commissioner Sorenson and Commissioner Lsndoe; those voting No, none. Repor ts The following annual reports were presented and read: Cemetery Board Water Collector Airport Board and the followin~ reports for the month of June were presented and read: City Engineer State Board of HAalth Water Analysis It was moved by Commissioner Sorenson, seconded by Commissioner Landoe tha t the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote; those votln~ Aye being Mayor Busch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. COmMlnication -- H. G. Klemme The City Manager read a letter from H. G. Klemme, who has a ranch on the Sour Dough Road, and who receives his domestic water supply from the Bozeman Creek Supply Main, stating that the water which he uses for domestic use, or the house water, goes thru a meter, but that the water Which he uses for milk cooling purposes has been piped in ahead of the meter. The City receives no revenue from this unmetered water, and the water superintendeT't felt that this "free water" business should be eliminated. It was pointed out that the amount water lJsed by Mr. Klemme without payment is very considerable 8ince tb"l hydran t is left running twenty-f01Jr a day durtng I8Urnmer months. Mr. Klemme s ta ted the t he had the right to use free wa ter through this line by virtue of a gentleman's agreement which he had with a former City Manager. City Attorney Ai tken read the following stipu1e tion cona tined in a deed from .J. !Iff. Bulen and wife to The City of Bozeman, filed with the County Clerk and Recorder, AU~lst, 21, 1917: "It is also agreed and understood tha t the gran tors herein are to have the privilege, whenever they so desire, of tapping the City water main at a point ad,jacent to their dwelling house located near the lands hereby conveyed. Said grantors shall pay the expenses incident to the tapping of said main and shall thereafter pay to the party of the second part the re~llar water rates charged by it to consumers of water from its water works system." The City Manager was instructed to inform Mr. Klemme that in accordance with this stipulation, water used by him from the Bozeman Creek Supply main nmst bA metered. Zoning -- Gallatin Farmer's Co. The City Manager read a communication from the Gallatin Farmer's Company, signed by Lester H. Todd requesting that Lots 17 and 18 of Block H. Rmlse's 1st Addition be- longing to G. L. Carlson and which they wished to use in connection with their present I I I I I I 47 propert~r as a wholesale and retail gasoline station be transferred from the residential district to the main business district. They also asked permission to erect bulk stor- age tanks on this property. The City Manager was instructed to refer the matter to W. R. Plew, Chairman of' the Ad,1ustment Board, for action. Ordinance No. 723 -- Forbidding Minors in Beer Parlors Ordinance No. 723, entitled: !tAN ORDINANCE FORBIDDING AND PROHIBITING THE PRESENCE OF MINORS IN ANY PLACE OPEN TO TFm GENERAL PUBLIC WITHIN THE CORPORATE LIMITS OF THE CITY OF BOZEMAN WHERE INTOXICATING LIQUOR IS SOLD BY THE DRINK FOR BEVERAGE PURPOSES AND CON- SUMPTION ON SUCH PLACE OR PREMISES AND PRESCRIBING PENALTIES FOR VIOLATION OF THIS ORDINANCE, It was introduced and read. It was moved by Commissioner Landoe, seconded by Commissioner Sorenson that the Ordinance be passed and adopted, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Landoe and Commisstoner Sorenson; those vo tinl2; No, none. Ordinance No. 721 -- Appropriation Ordinance Ordinance No. 721, entitled: "AN ORDTNANCE APPROPRIATING MONIES FOR THE SUPPORT AND MAINTENANCE, ETC., OF TH~ MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA FOR THE FISCAL YEar ENDING, JUNE 30th, 1944", was introduced and read. It wasmoved by Commissioner Landoe, seconded by CommiB~oner Sorenson that the Ordinance be provisionally passed; that July 30th, 1943 be designated as the date for public hear:tng on the measure and that AUp;tlflt 13th, 1943 be set as the date for final passage and approval, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. Ordinance No. 722 -- Salary Ordinance Ordinance No. 722, entitled: "AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA FIXING THE MONTHLY SALARY AND OFFICIAL BOND OF THE CITY MANAGER, THE HEADS OF THE DEPARTMENTS, AND THE EMPLOYEES OF THE CITY COMMISSION AS REQUIRED BY LAW", was introduced and read. After discussion, it was moved by Commissioner Sorenson, seconded by Commissioner Landoe the. t the fol1owin.rr salaries be paid during the fiscal year ending .Tune 30th, 1944 wi th officials bonds as .shown: Clty Manager -- $300 per month, official bond $2000.00, Police Jud.'te -- 75.00 per month, official bond $2000.00, City Attorney -- $185.00 per month, official bond not required, Director of Finance -- $220.00 per month, official $20,000.00, Clerk of the Commission -- $70.00 per month, official bond not required, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor ~lsch, Commissioner Sorenson and Commissioner Landoe; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Landoe, seconded by COmmissioner Sorenson that the meeting ad,journ and the motion was c~rrled by the following aye and No vote; those voting Aye being Mayor Busch, Commissioner ~orenson and Commissioner Landoe; those votin~ No, none.
