The Commission of The City of Bozeman met in re?ular session in the Commission Room,
City Hall Building, Friday eve~ln~, July 30th, 1943, at 7:30 o'clock P.M. Those being
present were Mayor Busch, Commissioner Sorenson, Commis~ion Landoe, City Attorney Aitken,
City Mana,p'er Qllinnell, Director of Finance Walter Davis, City Engineer Thorpe, and the
Clerk, when the following proceedings were had to-wit: Minutes of last session read. Motion
by Sorenson, seconded by Landoe tha t 'minutes be approved. Aye votes, Busch,Landoe,Sorenson.
Public Hearing -- Ordinance No. 721 -- Appropriation Ordinance
The Mana,p'er stated this was the time and place set for public hearing on the Budpet
Appropriation Ordinance No. 721, for the fiscal year ending June 30th, 1944. He presented
affidavi t of publica tion of the Notice, which was read.
A committee composed of Bud Lowe, E. A. Peterson, Louis True, Joe Han/JIf,drd, and Jerry
Vettel, from the Jr. Chamber of Commerce appeared to discuss the appropriation from the
Band Fund.
They stated that from the notice published in the Bozeman Chronicle, the general
public was lead to believe that the band fund appropriation of $3,157.03 was to be used
for band concerts durinJ:\ the comtnlJ, ye ar, whereas the bU(1get alloca tion for concerts is
only $1200.00 and $2021.20 is allocated for payments on the Armory Building.
The Com-
mittee maintained that the public should be more fully informed in regard to this division
of Band Fund expenditure. It was explained that the amount of $3,157.03 was the amount
of cash in the Band Fund available for appropria tion as s ta ted in the notice, and tha t
the advertisement was designed to bring the budget to the a ttention of the publiC as
required by law.
The Committee questioned the riF!ht of the Cit7T, under the 1939 Session Laws, to ex-
pend money from the Band Fund for payments on the Armory Building. The City Attorney
explained this law s ta ted money could be used from the Band Fund for recreational pur-'
poses, and to acquire, equip and maintain buildings for this purpose. It was further
expa1ined that the Drill Hall at the Armory was being used once a week by the U. S.
Army Air Corp stationed at the College and was available for free use for any non-
profit recreational or community activity for public benefit.
The committee also questioned the right of a former Commission to bind the present
and future Commissions for twenty years to make payments on the Armory. It was explained
that the former Commission had acted in accordance with public demand as expressed by
and through a number of local organizations including the bandsmen playing City concerts
at that time, and that The City of Bozeman had signed a contract with the Montana Armory
Board to make these quarterly payments of $505.30, along with a moral obligation.
The Commission called attention to Section 48, R. C. M. 1935, which provides that a
special levy may be made for "providing band concerts" and it was thought that the
money could not be used legally for the purchase of !llU1!l:1c, ins truments, or uniforms.
Steps leading up to the City's contracting to make payments for the Armory con-
struction were again reviewed for this Committee of wh:om some of them were present at
the meeting of June .25th, 1943, when the matter was explained in detail.
The Committee stated that the $1200.00 was not a sufficient amount with which to
carryon a yearly band program, but the City Commission could see no way that payments
for these band concerts could be increased in the present budget.

Application for City License
The application of Frances B. Haas, for a -?t-year city license was presented and read.
It was moved by Commissioner Landoe, seconded by Commissioner Sorenson that the applica-
tion be approved and the beauty parlor license issued and the motion was carried by the
following Aye and No vote; those voting Aye being Mayor Busch, Commissioner Sorenson and
Commissioner Landoe; those voting No, none.
Ordinance No. 724 -- Closing Hours for Beer Parlors
The Manager stated that in accordance wi th the ins truc tions of the Ci ty Commi ssion,
City Attorney Aitken had prepared an Ordinance amending the present Ordinance which changed
the hours when beer could not be sold at retail in the City to meet requirements of the
state law, as follows:

He presented and read Ordinance No.724, entitled:

BOZ1'~M.AN \'v'HICH REG1JLATES THR MANUFACTURE AND SALE OF' BEER WITHIN THE
CITY OF BOZgMAN, SO AS TO CHANGE THE HOURS DURING WHICH BESR MAY BE
SOLD AT RETAIL UNDER THE PROVISIONS OF SAID ORDINANCE NO. 641.
It was moved by Commissioner Landoe, seconded by Commissioner Sorenson that the
Ordinance be passed and adopted ann the motion was carried by the following Aye and No
vote; those voting Aye being Mayor BuSCh, 'Commis~loner Sorenson and Commi~sioner Landoe;
those voting No, none.
Reports
The annual report of the City Engineer was presented and read. It was moved b;T Com-
miAPiorer Sorenson, seconded by Commissioner Landoe, that the report be accepted and
ordered filed and the motion was carried by the following Aye and No vote; those voting
Aye bein~ Mayor 01sch, Commissioner Sorenson and Commissioner Landoe; those votinq No, none.

The Manager read a comrmmica tion from the Swanson Feed & Fuel Company askinrr for an
extension of one ye8r to repair their sidewalk, as Frank Swanson, the owner, is in the
arrned services. It was decided tha t they should be no tified tha t they will be parties
to any damap:e sui t shOD ld anyone be in,1ured on this defec ti ve walk.
Airport
The Manager stated he had an offer of $10.00 for the old granary 10cf1ted on the Airport
ground. It was agreed that the building should be sold for ~plO.OO provided that the Air-
port Board had no ob.1 ection; and provided further, tha t the purchaser clean up the prem-
ises after the removal of the bullding, including the area where the old barn was torn
down last spring.
