The Commission of The City of Bozeman met in regular session in the Commission Room,
City Hall Building, Friday evening, November 12th, 1943, at 7:30 o'clock P.M. Those being
present were Oomm~ssioner Landoe, Commissioner Sorenson, City Attorney Aitken, City ruan-
ager Quinnell and the Clerk., when the following proceedings were had to-wi t:
The minutes of the last regular session were read, and it was moved by Commissioner
Sorenson, seconded by Commissioner Landoe that the minutes be approved as read, and the
motion was carried by the followin~ Aye and No vote; those voting Aye being Commissioner
Landoe and Commissioner Sorenson; those voting No, none.
Nursery School
Mrs. Lila Slaughter and Miss Hildreth Howells, of the Rotana Club, appeared before
the Commission for information regarding contributions to the Nursery School Fund by
other service organizations in the City. They wished to know if their organization was
contributing as much as or more than other similar clubs in the City, and stated that it
was the understanding of the club that they were being asked to give more than their
former contribution of one gallon of milk per day.
The City Mana~er read a list of the organizations donating and stated that a list
of all donations received bV the Nursery School for the current month would be mailed to
the Rotans Club immediately for the information of its members.
Heport
The report of the City Engineer for the month of October was presented and read. It
was moved by Commissioner Landoe, seconded by Commissioner Sorenson that the report be
accepted and ordered filed and the motion was carried by the followlnp: Aye alid }Jo vote;
those v::ting Aye being Commissioner Sorenson and Commissioner Landoe; those voting No, none.
Post-War Planning Board
A communication was read from the Business & Professional Women's Club stating they
had appointed Bess Fowler and Beatrice Freeman Davis as their representatives on the
City's Post-War Planning Board.
Sewers -- City's Liability for Sewer stoppage
The written opinion of the City Attorney as to claims for damages caused by clogged
sewers was presented and read, stating that unless negligence is proven on the part of
the Ci ty for not excercialng reaaonab1e care to ](sep the aewer clear of obstructions,
the City is not liable, and the. t to concede liabili ty would be to establish a dangerous
and expensive precedent. The City Attorney opinion cited authorities to show that a
municipal corpora tion is not an insurer of the condi tlon of its sewers; that where "there
is negligence of someone else in the improper use of the sewer the City is not liable
and that such stoppages of the sewers is a risk assumed by all who connect with and use
the City's sewerage system.
The opinion was ordered filed.
Armory -- Rentals
The Manager stated that Mr. Chastain of the Chastain-Hossenpflug Bible Lectures had
requested the use of the Drill Hall Staurday mornings for Sabbath School, without charge.
After discussion, it was decided that a charge should be made but ~n view of the
fact that a fee of $100.00 is now being paid by the Lecturers for the use of the Drill
Hall for five nights per week, a nominal fee of $2.50 should be charged them for the

two hours use on Sa turday monrings.
Ad.1ournment
There being no further bnsiness to come before the Commission at this time, it was
moved by Commissioner Landoe, seconded by Commissioner Sorenson that the meeting adjourn
and the motion was carried by the following rlye and No vote; those voting Aye being
CommiBsioner Landoe and Commissioner Sorenson; those voting No, none.
