The Commission of The City of Bozeman met in regular session in the Commission Room,
Clty Hall Buildinp:, Friday evening, December 17th, 1943, at 7:30 o'clock P.M. Those belng
present were Mayor Busch, Commlssioner Landoe, Commissioner Sorenson, City Attorney Aitken,
City Mana~er Quinnell, Director of Finance Walter Davis, Commission9r-elect Lowe and the
Clerk, when the following proceedings were had to-wit:

The minutes of the last regular session were read, and it was moved by Commissioner
Sorenson, seconded by Commissioner Landoe that the minutes be approved as read, and the
motion was carried by the following Aye and No vote; those voting Aye being Mayor Busch,
Commissioner uorenson and Commissioner Landoe; those voting No, none.
Airport -- Rig:ht-of-Way on Slnu'c!hter H011se Tract
Mr. Earl Dawes appeared before the Commission in connection with an lrri~ation ditch
right-or-way easement given by him to The City of Bozeman in 1941, to facili ta te the
constr1Jction of the Airport at Belr:;rade. Mr. Dawes stated that the easement, a,ivinp: the
City the rip:ht to construct a ditch across a tract of land on the west side of the Air-
port, known as the t1Slau.a:hter Honse" or Brady -tract had been given by him at the l1rgent
request of, and without cost to,The City of Bozeman, in order to make it possible for the
City to continue with its airport construction program without interruption or delay.
He further stated that he was being sued for damap:es to this property in the amount of
$2500.00 plus interest and attorney's fees because of tbis easement,.and that he was
having to employ counsel at hIs own expense in connection with the matter. He felt that
the City should protect and assist him in this case as the easement was given solely to
protect the City's interest and without any thought of remuneration or personal gain for

himself.
The Commission, after discussion, stated they felt the City was morally obligated
to assist Mr. Dawes in this matter.
Applic8tion for City License
The application of Montgomery-Ward Company for a City License for 1944 was presented
and read. It wa s moved b'l! Commissioner Landoe, seconded by Commissioner Sorenson thl:1 t
the applica tion be approved and the license issued and the motion was carried by the
following Aye and Nn vote' those voting Aye bein~ Mayor BUSCh, Commissioner Sorenson and
Comm1.ssioner Landoe; those voting No, none.
Resolu tion No. 537 -- TrBnsferrirg Clearance F\md Bt'\l~lnce
The Mana7er stated that the Resolution transferring the balance in the S.I.~.
"Clearance Fund" to the S.LD. Revolving fund had been prepared. He presented and read
Rasoln tion No. 537, en ti tIed:
A RESOLUTION OF THE CITY COMMISSION ORDERING TRANSFERRED TO THE SPECIAL
IMPROVEMENT DISTRICT REVOLVING FUND ALL MONEY REMAINING IN, OR DERIVED
FROM THE FUNDS OF ANY SPECIAL IMPROVEMENT DISTRICT OF THE CITY OF BOZEMAN
CREATED PRIOR TO FEBRUARY 25th, 1929, AFTER ALL BONDS AND WARRANTS, OR
EITHER, ISSUED ON OR AGAINST SUCH FUNDS HAVE BEEN PAID.

It was moved by Commie sioner Sorenson, seconded by Commis sioner Landoe tha t the
Resolution be passed and adopted and the motion was carried by the following Aye and
No vote; those voting Aye being Mayor' Busch, Commissioner Sorenson and Commissioner
Landoe; tho~e voting No, none.

Investment of Funds
The Manager reported that the following fund balances were available for investment:
Cemetery Permanent Care
Police Reserve Fund
$ 8,000.00 in Series G War Bonds
1,998.00 in Series F War Bonds
The CommisRion agreed thqt these investments should be made as soon aspossible.
Parks -- Skatln? for the Season
The Manaller reported that the Recreation Board at its Meeting, December 2nd, had de-
cided JO carryon the skatiDO' program during the comlng season substantially in accordance
with the plan adopted for the season of 1942-1943.

moved by Commissioner Landoe, seconded by Commiflsioner Sorenson that the meeting adjourn,
and the motion was carried by the following Aye and No vote; those voting 1-l.ye being Mayor
Busch, go~~issioner Sorenson and Commissioner Landoe; those voting No, none.
