HomeMy WebLinkAbout1951-01-17 Bozeman, Montana January 17, 1951 477 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, January 17, 1951 at 1:00 o'clock P. M. Those being present were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Cle rk when the following proceedings were had: I The minutes of the last regular session were read and it was moved by Commissioner Healy, seconded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Hearing -- S. 1. D. No. 365 The Manager stated this was the time and place set for the hearing of protests to the creation of Special Improvement District No. 365, ornamental lighting on Eighth Avenue from Main Street to Harrison Street. He presented the affidavit of publication of the Notice, and the Clerk's Mailing Certificate that all property owners in the district have been notified. He stated that as of Saturday, January 13th, 1951, the final day for filing protests, a total of 46.37% of property was represented in protests filed, and that Monday morning, January 15th, 1951 an additional 8.83% of the property was represented in :protests, making a total protest of 55.2%. Inasmuch as the City Offices are closed on Saturday afternoon, it was considered that protests received on Monday should be accepted. It was thereupon moved by Commissioner Healy, seconded by Commissioner Secor, that the protests be sustained and the proposed district should not be established, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; I those voting No, none. Application for Beer License The application of Earl Tucker for a wholesale beer license was :presented. It was moved by Commiss ioner Secor, seconded by Commissioner Healy, that the an1ica lion be approved end the license issued and the motion was carried by the followinG Aye and No vote: those voting Aye being Mayor Lowe, Commiss ioner Secor and Commissioner HealJ'; those vOtiIllj No, none. AHJointment of Director and Assistant for Civilian Defense The Mayor, upon recommendation of the Civil Defense Advisory Council, announced the sp,pointment of M. E. Henderson as Director of Civil Defense. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the appointment be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those votinG No, none. The Mayor announced the appointment of Dean Waldorf as Assistant Director of Civil Defense. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the appointment be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. I Repol-ts The following reports were presented: Cemetery Board for the month of December, 1950 Flurnbing Inspector for the months of November and December, 1950 flumbing Inspector for the year 1950. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the reports be ecce:pted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Airport -- Amendment to Grant Agreement Victor Keisling, Airr,ort Engineer for the CM, appeared before the Commission in regard to an 478 amendment to Grant Agreement approved August 23, 1951. The following Resolution was introduced by Conunissioner Secor, seconded by Conunissioner Healy, read in full and considered and unanimously adopted: RESOLUTION AI'FROVING AND AUTHORIZING THE AMENDMENT OF A GRANT AGREEMENT HERETOFORE RECEIVED FROM THE ADMllJISTRATOR OF CIVIL AE.'RONAVTICS, AND EXECUTED FOR THE PURPOSE OF DE"IF.1..0FING THE GALLATIN FIELD AIRPORT AT BOZEMAN, MONTANA. Be it resolved by the City Conrrnission of Bozeman, Montana, Section 1. That the City of Bozeman, Montana, by and through its City Conunission and I. Gallatin County, Montane, by and through its Board of County COlJ;missioners, shall jointly wifuGallatin County, enter into an Amendment of Grant Agreement heretofore executed for the puq.ose of obtaining Federal Aid toward the develofment of the Gallatin Field Airport and that such Amendment shall be as set forth hereinbelow. Section 2. That the Mayor be, and he is hereby authorized and directed to execute seid Amendment to Grant Agreement in sextuplet on behalf of the City of Bozeman, and the Clerk of the Commission is hereby authorized and directed to impress the official sea.l of the City of Bozeman, Montana, thereon and to attest said execution. Section 3. That the Amendment to Grant Agreement referred to hereinabove shall be as follows: AMENDMENT TO GRANT AGREEMENT Gallatin Field Bozemanl Montana Froject No. 9-24-003-004 Contract No. C7ca-3982 WHEREAS, the Administrator of Civil Aeronautics has determined, that in the interest of the United States, the Grant Agreement between the Administrator of' Civil Aeronautics, acting for and on behalf of the United States, and the City of Bozeman, Montana, and the County of Gallatin, Montana, accepted by said City of Bozeman, Montana, and the County of Gallatinl Montana., on the 23rd day of August, 1950, should be amended as hereinafter provided: NOW, THEREFORE, WITNESSETH: I 'l'hat in consideration of' the benefits to accrue to the parties hereto, the Administrator of Civil Aeronautics, on behalf of the United States on the one part, and the City of Bozeman, Montana, and the County of Gallatin, Montana, on the other part, do hereby mutually agree tha t the said Grant Agreement be hereby amended by deleting the words "south end of N/S runway" and adding in lieu thereof the words "the apron" to the project description on Page 1 of said Grant Agreement so that the said project description will read as follows: "Repair and resurface NW/SE runway and the taxiway between the southeast end of the NW/SE runway and the ap ron." It is hereby further understood and agreed that the maximum amount of the oblig;a.tion of the United States payable under said Grant Agreement shall not be increased by this Amendment. IN WITNESS WHEREOF, the parties hereto have hereby caused this Amendment to said Grant Agree- ment to be duly executed this ~ day of January, 1951. While this would be a project on lands owned by the Milwaukee Railroad and Paul Dudley, which are outside the City Limits, proposed work would be to improve drainage conditions and safeguard 1 against floods in the Ci~. It waS, therefore, a project which should be undertaken jointly by the above owners and the City. The City Eneineer was instructed to investigate this matter and formulate plans under which the required work ce.n be carried on on a cooperative basis. Report on Committee Meetings of Montana Municipal League City Manager Henderson rerorted to the Commission on the meetings of the Executive and Legislative Committee of the Montana Municipal League which he attended in Helena. Adjournment There being; no further business to come before the Commission at this time, it was moved by Commissioner Healy, seconded by Commissioner Secor, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being; Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
