M. Those being present were Mayor Lowe, Commissioner Secor, Cormnissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: The minutes of the last regular session were read and it was moved by Commissioner liealy, seconded by Corrunissioner Secor, that the minutes be a:Pl~roved as read, and the motion was carried by the following; Aye end No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Absence of John McCrosson The Manager reported that John McCrosson, Fire Chief, has been absent from his dub es during the I~eriod of January 20th, 1951 through January 25th, 1951. due to illness in his family. He stated further it was not necessary to emrloy addi honal heIr during; his absence. It was thereupon moved by Commissioner Healy, seconded by Commissioner Secor, that the absence of Chief McCrosson be approved, that the time off not be cherged to vacation time or sick leave, a,nd that no deduction be made from his salary and the motion was carried by the followinG Aye and No vote: those voting Aye being Mayor Lowe, Conunissioner Secor antl Cotrl.."Ilissioner Healy; those voting No, none. Additional Farking Meters The matter of enlarging the pJ.rkinc meter area was discussed. City Business License The :natter of the fee for a. business license at the Babcock Grocery WaS discussed, end Mr. Vernon Koelzer of the Iacifi cHide & Fur was present to discuss the fee for junk de8~le rs. The Commiss ion stpted the license fee -in each case should be as :rrovided for in the license orcinance. Reports The following, reports were [iresented: Director of Finance for December, 1950 Librarian for Janu!\.ry, 1951 Sanitary lnsrector (Milk Count) for January, 1951. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the rerorts be accepted and ordered filed ,9nd the motion was carried by the followirj[; Aye and No vote: those voting Aye being Mayor Lowe, Corrunissi::mer Secor and Corrunissioner Healy; those votinE No, none. Additional Street Lights The Manager stated the following requents for street lights have been made: Fourth and VillF..rd South Church Avenue south of Story Street I I 1 483 It W8.S moved by Commissioner Secor, seconded by Commissioner Healy, that the City Manager be authorized to fla ce an order with the Montana Power Company for these two additional street lights, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Street Lighting Contraot A Street Lighting Contract between the Montana Power Company and The City of Bozeman in accordance I with present operation of street lights was presented. The City Attorney having examined and aprroved the contraot, it was moved by Commissioner Healy, seconded by Commissioner Secor, that the Mayor and the Clerk of the City Commission be authorized to sign the contract for The City of Bozeman, and tile motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Agreement -- Idaho :role for Logging The City Manager fresented and read a letter of agreement between The City of Bozeman and the Idaho Pole Company for tile logging of a portion of a section of land owned by the City of Bozeman and located near the south water shed. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the agreement be approved, and the City Manager autlorized to sign the agreement for The City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye beine; Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Resolution No. 703. Intention to Vacate Short Street The Manager stated the Ci ty Attorney, as instructed, has prepared a resol ution of intention to vacate Short Street between Fifth and Sixth Avenue; the alley in Block One and a portion of the alley in I Block 4, The Violett Addition. He presented Resolution No. 703, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN MONTANA, DECLARING IT TO BE TIlE INTEN- TION OF SAID CmlMISSION TO V AGATE SHORT STRE~~T BET'NEEK TEE WES'l' LINE OF NOHTH FIFTH AVENUE AND THE EAST LINE OF NORTH SIXTH AVENI'E, AND ALSO TIlE ALLEY IN BLOCK ONE OF TP..E VIOLETT ADDI- TION TO THE CITY OF BOZEMAN, AND ALSO THAT IART OF THE ALLEY IN BLOCK 4 OF-' THE VIOLETT ADDI- TION Tn THE CITY OF BOZEMAN SITT'ATE AND LYING BET'!JEEN LOTS 1 and 2 AND LOTS 17 AND l8 IN SAID BLOCK 4 OF THE SAID VIOLETT ADDITION TO BOZRMAN, MmnANA. It was mov-ed by Connnissioner Healy, seconded by Commissioner Secor, that the Resolution be FRssed and adopted and February 7th, 1951 be set as the date for public hearinG' and the motion was carried by the following Aye and No vote. those votin('; Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Amount of Bond for City Engineer The amount of bond for Dean Waldorf as City Engineer was discussed. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the amount of the bond be ~2.000.00, and the motion was carried by the following Aye and No 'Vote: those voting Aye being Mayor Lowe, Corrunissioner Secor and Commissioner Healy; those votill{; No, none. Zoning of Langohr's First Addition The zoning of Lang;ohr's First Addition was considered. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the City Attorney be instructed to l-repare an amendment to the 1 ZoninG Ordinance to include Langohr's First Addition in the "A" Residence District, and the motion was earried by the following Aye and No vote: those voting Aye beinG Mayor Lowe, Comrnissioner Secor and Commissioner Healy; those voting No, none. Irrigation to be Metered on Metered Services The Mana.ger ex}lained that, at the time water meters have been installed in some residential pro}?erties, the plumbinG has been arranged so the water used for irrigation does not go through the meter. He stated that, where this has been permitted, the water user has paid a flat rate for irrigation, but the slecial meter rate Frovided for irrigation thrOUGh the meter is complrable to the 484 irrigation fla.t rate. After discussion, the Corrunission sta.ted this fractice should be discontinued and, in cases where meters are install ed, all water used should go througb the meter. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Secor, seconded by Commissioner Healy, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and I.
