M. Those being present were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk when the following proceedings were had: I The minutes of the last regular session were read and it was moved by Commissioner Healy, seconded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Hearing -- Vacation of Short Street The Manager stated this was the time and place set for the hearing of protests to the vacation of Short Street between Fifth and Sixth Avenues, and the alley in Block One of The Violett Addition, and part of the alley in Block 4 of The Violett Addition. The affidavit of publicat ion of the Notice and the Acknowledgement of Service of the Notice to all abutting property owners was presented. The Manager stated no protests have been filed and no one is present to protest, whereupon, it was moved by Commissioner Healy, seconded by Commissioner Secor, that the City Attorney be instructed to prepare an ordinance vacating said street and alley, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Gas 1"'1 tter' s Certificates Continuation certificates of bonds as Gas Fitters of the Owenhouse Hardware Company and J. S. Budd were presented. The certificates were approved as to form by the City Attorney, whereupon, it was I moved by Commissioner Secor, seconded by Commissioner Healy, that the certificates be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Nmyor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Application for Beer License The application of the Park Coca-Cola Bottling Company for a wholesale beer license was presented. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the application be apfroved a.nd the license issued, and the motion was carried by the followin('; Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Closing flumbing Examiner's FUnd The ManegeI' reported the Flumbing Examiner's Fund ha.s become inactive. It was thereupon moved by Commissioner Healy, seconded by Commissioner Secor, that the Director of Finance be authorized to close the Plumbinf~ Examiner's Fund, and transfer the cash belance of ~1GO.15 to the General Fund, and the motion was carried by the following Aye and No vote: those voting Aye beint: Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Transplanting; of' Elk South of City Unofficial notice of the possibility of' transplantinG elk in the forest south of the city was dis- 1 cussed, and it was decided to take no action until official notice is received. Reports The following reports were presented: December, 1950 January, 1951 Cashier Sewage Plant Operator Cashier Fire Chief Sewage Plant Operator folice Judge It was moved by Conunissioner Healy, seconded by Conunissioner Secor, that the rel.,orts be accepted and ordered filed end the motion was ca.rried by the followio[; Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those votins No, none. 486 Subscription Agreement and Water Purchase Contract The Subscription Agreement and the Water furchase Contract for 1050 acre-feet of water in the Middle Creek Storage Froject were lresented. The agreement and contract were approved as to form by the City Attorney. It was moved by Commissioner Secor, seconded by Commissioner Healy. that the contract and agreement be approved and the Mayor and the Clerk of the Commission be authorized to sign them for the City of Bozeman, and the motion was carried by the following Aye and No votel those vot- ing Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Manager & Commission Authorized to go to Helena Legislative matters of interest to cities and towns Was discussed and it was moved by Commissioner Healy, seconded by Cownissioner Secor, that the City Manager and the City Commissioners be authorized to attend a public hearing in Helena, F'ebruary 9th, 1951, and their exrenses be paid from the General Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Claims for the Month Claims Nos. 316 to 537 inclusive were presented on the various funds as follows: Band Cemetery Cemetery Perm. Care Cemetery Suspense Garbage General Library Park Parking; Meter Plumbing Examiner's Police Reserve SDS Revenue Special Imp. District W-H Tax Water $ 6l 7 .30 546. 72 6,490.00 70.00 1,555.18 14,474.09 988.80 2,903.99 899.27 160.15 1,586.15 20,728.43 866.08 1,306.93 7,593.08 Total - - - $60,686.17 The Manager stated that he has audited these claims and finds them to be true and lawful claims against The City of Bozeman, and recommends that warrants be drawn for their payment. After examina- tion of the claims in detail by the City Commission, it was moved by pommissioner Secor, seconded by Commissioner Healy, that the claims be a.pproved and warrants drawn for their payment, and the motion was carried by the following; Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commiss ioner Secor. seconded by COllunissioner Healy, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Cornmis- sion6r Healy; those voting No, none.
