March 28, 1951 497 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday afternoon, March 28, 1951 at 1:00 o'clock P. M. Those being present were Mayor Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson and the Clerk when the following proceed- ings were had: The minutes of the last regular session were read and it was moved by Commissioner Healy, seconded by Commissioner Secor, tha.t the minutes be 8J;proved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner He&y; those voting No, none. Bids for Electrical Work at Library The Manager stated this was the time and place set for opening bids for a new lighting and wiring system at the Public Library. He presented the affidavit of publication of the Notice to Bidders, where- upon, it was moved by Commissioner Secor, seconded by Commissioner Healy, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commis.. sioner Secor and Commissioner Healy; those voting No, none. The following Bids were opened and read: Basic Sum Deduction for Alternate No. 1 Bozeman Electric F. 1. Dye Company, Inc. Shane Electric Company $2,972.00 2,9l6.00 2,490.82 $742.00 486.00 432.08 After consideration, it was decided by the City Commission to refer the bids to the Library Board for their recommendations before final action is taken. Water Damage to Kimm Property Mrs. Alice H. Kimm, 412 West Beall, appeared before the Commission relative to damage to the base- ment floor of her home. The damage was caused by water which ran from the street gutter, followed under- ground in a sewer ditch which was constructed several months ago, and built up pressure under the concrete floor which caused the floor to crack and break. Mrs. Kimm claimed that one reason why water ran under- ground through the sewer ditch was that the ditch had to be left open an unreasonable time last fall waiting; for inspection and consequently it was back-filled with frozen dirt. She asked that the City of Bozeman pa.y for the damag;e or replace the broken floor. After full consideration of all the oircumstances, the Commission informed Mrs. Kimm that the City of Bozeman could not assume responsibility for any of this damage. Vacation of fortion of North Sixth The Manager stated this Was the time and place set for the hearing of protests to the vacation of approximately 144 feet of North Sixth AVenue north of Durston Road. He presented the affidavit of publica- tion of the Notioe, and stated that no one is present to protest and no protests have been filed. It was thereupon, moved by Commissioner Healy, seconded by Commissioner Secor, that the City Attorney be instructed to prepare an ordinance vacating said portion of North Sixth Street. The Manager stated the City Attorney as instructed has prepared an ordinance vacating a portion of North Sixth Avenue. He presented Ordinance No. 758, entitled: .AN ORDINANCE OF TEE CI TY OF BOZEMAN, MONTANA, VACATING TRA T PORTION OF SIXTH AVENUE NORTH EXTENDING APPROXIMATELY 144 FEET NORTH FROM DURSTON ROAD AND BEING ALL THAT FORTION OF Sllm AVENUE NORTH INCLUDED IN SHONKWILER'S ADDIT ION TO BOZEMAN, MeN !ANA. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the ordinance be passed and adopted, and the motion Was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Leave of Absence - C. R. Cutting, Foliceman A letter from C. R. Cutting, addressed to the Chief of folice, was presented in which Officer Cutting 498 advised that he has been called to active duty in the U. S. Army and requesting that be given an extended leave of absence during his military service. It was moved qy Commissioner Secor, seconded by Commissioner Healy, that the requested leave of absence to Officer Cutting be granted and the motion was carried by the following Aye and No vote: those voting; Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Abatement of Tax S. I. D. No. 36l The Manager reported that, through an error in assessing the cost to property owners for Special Improvement Lighting District No. 361, the total assessment was $137.54 in excess of the amount actually assessed against property owners in the district. This error occurred through failure to deduct, from the total assessment, certain credits allowed to property owners for "conduit in place". Director of Finance Shadoan reports that the assessment as actually made to the property owners in the district is correct and recommended that tht total assessment made be reduced $l37.54 to rectify this error. It was moved by Commissioner Secor, seconded by Commissioner Healy, that, of the total assessment of cost in S. I. D. ~6l, as made by Resolution No. 694 on November 1, 1950, the sum of $137.54 be and is hereby abated and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Supplementary Report -- Re: Improvement in Water Supply A supplementary report from Morrison-Maierle Company was presented. This report was to give further information and bring up to date the engineering study and report which this company had previously made on the water supply and distribution system of Bozeman. The report was accepted and ordered filed as a part of the original report. Federal Aid Urban System for Highways in Bozeman A communication from the Montana state Highway Commission was read, asking the City Commission to adopt a resolution designating those parts of U. S. Highways No. 10 and No. 191 which are within the city limits of Bozeman as a part of the Federal Aid Urban System in Montana. After consideration it was decided that, before action is so taken, a conference should be arranged with the Chief Engineer of the Montana Highway Department to secure further information on the matter. Punch Board Ordinance The matter of a tax on punch boards was discussed. It was moved by Commissioner Secor, seconded by Commissioner Healy, that the City Attorney be instructed to prepare an ordinance levying a tax on punch boards as authorized by law passed by the 1951 legislature of the State of Montana and the City Manager be instructed to order stamps for use on punch boards as will be required by this ordinance and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Police Chief to Kansas City to get Folice Car The Manager reported that the Ford car, which is to be secured from Bill Wright, Inc., on a rental basis for use as a Folice car, will be ready for shipment from Kansas City, Mo., on or about April lO, 1951. Chief Haas recommends that it will be highly advantageous to have this car well broken in before it is put into service as a Police car and that driving it from Kansas City would be the best way in which to break it in. Bill Wright, Inc. have agreed to pay one half of the expense for a man to go to Kansas City and drive this car to Bozeman. It was moved by Commissioner Secor, seconded by Commissioner Healy, that, it being; in the public interest, Police Chief Haas be authorized to go to Kansas City on or about April lO, 1961 to drive this car home and that one half of his expenses be paid from the General FUnd, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. I I 1 Jetitions for Decontrol of Rent Two additional petitions for the decontrolling of rent in Bozeman were presented.
