The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, April 4, 1961 at 1&00 otclock P. M. Those being present were Mayor Lowe,
Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelace and the Clerk
when the following proceedings were had:
The minutes of the last regular session were read and it was moved by Commissioner Healy, seconded
by Commissioner Secor, that the minutes be ~proved as read, and the motion was carried by the following
Aye and No vote: tl.ose voting Aye being Mayor Lowe, Commissioner Seco r and Commissioner Healy; those
voting No, none.
Bond & Contract for Rewiring Library
The Manager reported that the Library Board recommends acceptance of the bid of the Shane Electric
Company under alternate No. 1 of the plans and specifications for rewiring the Public Library. The bond
and contract of the Shane Electric Company, in the amount of $2,068.74 for this rewiring was presented.
The bond and contract were approved as to form by the City Attorney. It Was moved by Commissioner Healy,
seconded by Commdssioner Secor, that the bid of the Shane Electric Company in the amount of $2,068.74
be accepted, and the bond and contract be approved, and the Mayor and the Clerk of the Commission be
authorized to sign the contract for the City of Bozeman, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those
voting No, none.
Engineering flans for Sanitary Trunk Sewer
The matter of general improvements for the City were discussed, including improvements to the water
system, paving; districts, storm sewer districts and a sanitary trunk sewer to handle the now over-loaded
trunk sewer carrying the waste from the south and west part of the city. City Engineer Waldorf stated
that, in a small office as is maintained here, it would not be possible to plan such a trunk sewer and
have the plans ready for at least one year but, with additional engineering help, it might be planned for
this year. After discussion, it was moved by Commissioner Healy, seconded by Commissioner Secor, that the
Ci~ Manager negotiate with Morrison-Maierle Engineering Company of Helena, to get a proposal on doing
the necessary engineering work on this trunk sewer project and the motion was carried by the following
Aye and No vote: those voting; Aye being Mewor Lowe, Commissioner Secor and Commissioner Healy; those
voting No, none.
Conference with Highway Engineers
City Manager Henderson and Commissioner Healy reported on the conference with State Highway Engineers
Commissioners has been arranged for April 12, 1951.
held in Helena on Mondt'f, and stated another conference with the State Highway Commission and City

The Manager stated that he has audited these claims, and finds them to be true and lawful claims
against the City of Bozeman, and recommends that warrants be drawn for their payment. After examina-
tion of the claims in detail by the City Commission, it was moved ~ Commissioner Healy, seconded qy
Commissioner Secor, that the claims be approved and warrants drawn for their payment, and the motion
was carried by the following Aye and :No vote: those voting Aye being Mayor Lowe, Commissioner Secor
and Commissioner Healy; those voting No, none.
Repo rts
The following reports for the month of March, 1951 were presented:

and the report of the Director of Finance for the month of February, 1951.
It was moved by Corr~issioner Secor, seconded by Commissioner Healy, that the reports be accepted
and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No. none.
Federal Urban Aid System
The following Resolution was presented:
WHEREAS the Highway Commission of the State of Montana has recommended and requested
that those streets in the Ci~. of Bozeman which are now designated as part of the
Federal Aid Primary System should be transferred to the Federal Aid Urban System, and
WHEREAS the State Highway Commission represents that such transfer in designation of
these streets will in no way reduce their eligibility to participate in funds for con-
struction or maintenance from either the Federal Aid ~rimary System or the Federal Aid
Urban System, and
WHEREAS the change in designation as requested by the State Highway Commission will be
advantageous to the City of Bozeman
NOW THEREFORE BE IT RESOLVED, that those streets within the City of Bozeman which are
designated as part of the U. S. Federal Aid Primary System shall be and are hereby
transferred to and designated as part of the U. S.Federal Aid Urban System.
It was moved by Commissioner Healy, seoonded by Commissioner Secor, that the foregoing resolu-
tion be approved and adopted and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Punch Board Ordinance
The Manager stated the City Attorney as instructed has prepared an ordinance establishing a 2%
license tax on punoh boards in the city. He presented Ordinance No. 759, entitled:
ORDINANCE ESTABLISHING A LICENSE TAX BY THE CITY OF BOZEMAN ON TRADE STIMULATORS, PUNCH
BOARDS, PULL CARDS, ARTICLES AND SIMILAR DEVICES; FIXING THE AMOUNT OF SUCH TAX, PRESCRIB-
ING THE METHOD OF ADMINISTRATION THEREOF BY THE CITY, PRESCRIBING THE DISFOSITlON OF THE
REVENUE FROM SAlD TAX, MAKING VIOLATIO:N HEREOF OR PERMITTING MI:NORS TO PATRONIZE SUCH A
STIMULATOR OR ARTICLE A MISDEMEANOR, PROVIDING PEN.ALTIESFOR THE VIOLATION OF THIS ACT.
It was moved by Commissioner Secor, seconded by Commissioner Healy, that the Ordinance be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Communi cat ions
A communication from C. H. Brewer, Executive Secretary of the Montana Municipal League, was read
expressing appreciation to the Gallatin County members of the 32nd Legislative Assembly for their
assistance and co-operation during the past session.
A communication from E. K. Cheadle WaS read, stating he has resigned as the State Director of
Civilian Defense.
A communication from Captain Ousey, ORe instructor, was read stating May 19th, 1951 has been
designated as Armed Forces Day and requesting the City to participate in its observance.
City Manager to Butte
The Manager re~orted a meeting of a committee of the Montana Municipal League would be held in

Butte, April 6th, 1951 to make arrangements for the League's annual convention to be held in Bozeman
during May.

interest, the City Manager be authorized to attend this meeting, and his expenses be paid from the

There being no further business to come before the Commission at this time, it was moved by
Commissioner Secor, seconded by Commjssioner Healy, that the meeting adjourn and the motion was
