The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, June 14, 1950, at 1:00 o'olook P. M. Those being present were Mayor
Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, City Attorney Lovelaoe and the
Clerk when the following proceedings were had:
The minutes of the last regular session were read, and it was moved by Commissioner Healy,
seconded by Commissioner Seoor, that the minutes be approved as read, and the motion was carried by
the following Aye and No vote: those voting .Aye being Mayor Lowe, Commissioner Secor and Commhsioner
Healy; those voting No, none.
Ambulance Service -- Opinion of City Attorney
The written opinion of the City Attorney relative to the City of Bozeman appropriating money for
the maintenanoe and operation of an ambulanoe was read, stating the City of Bozeman may appropriate
monies for the maintenance and operation of an ambulance.
Resolution No. 680 -- Joint Operation of an Ambulance
A joint resolution between the City of Bozeman and the County of Gallatin, agreeing to aid in
the support and maintenance of an ambulance for the City-County Health Unit, was presented and read,
entitled:

GALLATIN COUNTY, BOZJ!XAN, MONTANA, TO AID THE COUNTY AND CITY HEALTH PROGRAM AND TO sup-
PORT THE CARE AND MAINTENANCE OF .AN AMBULANCE, "FOR THE GALLATIN COUNTY HEALTH mnT.
It was moved by Commissioner Secor, seconded by Commissioner Healy, that the Resolution be passed
and adopted and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor
Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.
Report -- S. I. D. No. 349, 351, 353, 364, and 356
The written report of Mr. Soott Hart regarding his investigation of the condition of the paving
in Special Improvement Districts No. 349, 351, 353, 364, and 355, as requested at the last regular
meeting, was presented and read.
Offer to Sell Light Standards
S. I. D. No. 362
The written offer of the Montana Fower Company to sell to The City of Bozeman the install ed light
standards and two more standards to be installed in Special Improvement District No. 362 in the amount
of $4,074.60 was presented and read. It was moved by Commissioner Healy, seconded by Commissioner
Secor, that the offer be accepted and the Clerk of the City Commission be authorized to sell bonds of
Special Improvement District No. 362 for the payment to the Montana Power Company, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and
Commissioner Healy; those voting No, none.
Driveway -- 38-42 North Bozeman
The Manager stated that Mr. M. F. Sohauer has requested permission to in5tall a driveway to his
property at 38-42 North Bozeman from Bozeman Street. It was reported this would eliminate one parking
meter, and would also eliminate the driveway from Mendenhall Street onto this property and that the
sidewalk abutting this property would also be replaced. It was moved by Commissioner Healy, seconded
by Commissioner Lowe, that the request be granted and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Lowe, Commissioner Seoor and Commissioner Healy; those voting
No, none.
Bozeman Cannery to Use Sewage Plant for 1950
A communication from Mr. H. B. Foote, of the State Board of Health was read, stating that in the

opinion of the Board of Heal th the discharge of the Bozeman Canning Company wastes would not harmfully
effect the operation of the sewage treatment plant, under the oondi tions as they now exist, but this
oonclusion and recommendation apply for the season of 1950 only, and are not to be construed to apply
to any future years.
The application of the Bozeman Cannery to use the sewage plant facH ities this season was considered
together with the recommendations and conclusions of the State Board of Health, and it was pointed out
the packing season of 1950 will last approximately thirty days and under the present oircumstances there
is an emergency with the reorganization of the cannery, and it was decided that if the cannery is per-
mitted to use the present sewage facilities, the following conditions should be agreed to in writing.
1. That the cannery wastes be screened to remove all solids that can be removed by a 40
mesh screen,
2. That the screening process be adequately manned to prevent any solids from entering the
sewage system,
3. That the regular monthly sewage fee be paid with the monthly water bill,
4. Thut an indemnity bond be filed with a $10,000 minimum and a $50,000 maximum, to cover
any damage that might be caused by the emptying of the cannery wastes into the city's
treatment plant,
5. That any additional expense that might be incurred because of the treating of the cannery
wastes be paid by the cannery.
After further consideration, it was moved by Commissioner Healy, seconded by Commissioner Secor,
that provided the above conditions are agreed to in writing by the Bozeman Canning Company, that per-
mission to connect to the city's sewage system be granted for the packing season of 1950 only, and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner
Healy and Commissioner Seoor; those voting No, none.
Appointment -- Chaffin to Airport Board
Mayor Lowe announoed the appointment of Dean Chaffin as a member of the Gallatin Field Board for
a three year term ending July 30th, 1953. It was moved by Commissioner Healy, seoonded by Commissioner
Secor, that the appointment be approved and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Lowe, Commissioner Healy and Commissioner Secor) those voting No, none.
Report
The report of the Chief of Police for the month of May, 1950 was presented. It was moved by
Commissioner Secor, seconded by Commissioner Healy, that the report be accepted and ordered filed and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commis~
sioner Healy and Commissioner Secor) those voting No, none.
Request for Water to Recreation Area at Fairgrounds
The Manager reported a request has been made for adequate water facilities for the recreational
area at the Fairgrounds. After discussion, the matter was tabled for further information.
City Office to Close July 3rd, 1960
The matter of the City Offices being open on Monday, July 3rd, 1950 and the operating cre~
not working on that same day was discussed. It was moved by Commissioner Secor, seconded by Commis-
sioner Healy, that the City Office be closed July 3rd, 1950, and the operation crews have July 3rd off,
and that they be permitted to work two Saturdays afternoons to make up for that day, and the motion was
oarried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Healy and
Commissioner Secor; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Healy, seconded by Commissioner Secor, that the meeting adjourn and the motion was carried
