The Commission of' the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, June 21, 1950, at 1:00 o'clock P. M. Those being present were Mayor
Lowe, Commissioner Secor, Commissioner Healy, City Manager Henderson, Ci~ Attorney Lovelace and the
Clerk when the following proceedings were had;
The minutes of the last regular session were read, and it was moved by Commissioner Healy,
seoonded by Commissioner Secor, that the minutes be approved as read, and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner
Healy; those voting No, none.
Request for Water Line to Fair Grounds
H. T. Porter, representing a planning committee of the Bozeman Chamber of Commeroe, H. E. Anderson,
representing Gallatin County High School, and Homer Fisher, representing Gallatin Coun~ Fair Board, were
present to discuss the extension of a water main to serve the area within the Fairgrounds, now being
developed as an athletic and recreation area. Their proposal would involve the laying of approximately
1200 ft. of four inch water main at city expense. They presented a proposed agreement between the City
of Bozeman, Gallatin County Fair Board and Gallatin County High School relative to the develoFment,
operation and maintenance of the proposed recreation area.
After consideration of the cost of' the proposed water main and of the development of this area as
proposed in the agreement, the agreement was referred to the Ci~ Attorney for study and advice before
any action is taken.
Easement for Water Main on Property of T. B. Story in Northern Pacific Addition
Mr. T. B. Story was present to discuss a situation relative to the City's main line water main
where it crosses certain property owned by Mrs. Story in Northern Facific Addition. It appears that in
1930 there were certain streets and alleys vacated in Blocks 86, 87, 88, 89, 92, 93, 94, 97, 98 and 99
in Northern Facific Addition, that in return for vacating tl~se streets and alleys Gertrude Brown and
a Montana Flour Mills Company dedicated certain areas adjacent to these blocks along the city limits for
street purposes and that Katherine F. Story gave a conditional quit olaim deed to the City of Bozeman
to Lots 21 and 22, Block 98, the Southeast half of Lot 3 and Lots 4, 28, and 29, Blook 97, Northern
Pacific Addition to the City of Bozeman. This deed states that these lots are deeded for the purpose
of permitting the City to install and maintain its water main across them. Mr. Story. s contention is
that these lots should not have been deeded but that there should have been an easement given to the
City. He therefore requests ttat the lots be deeded back by the City by a quit claim deed, reserving
the rights for water ~in construction and maintenance by the City.
After discussion it was moved by Commissioner Healy, seconded by Commissioner Secor, that the City
Attorney examine the records and if there is no reason why the city should not give a quit claim deed
as requested, the City Attorney prepare such a deed to be presented at the next regular meeting and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner
Secor and Commissioner Healy; those voting No, none.
F~nal Passage of Ordinance No. 753
Ordinance No. 753 having laid over for ten days after first being introduced at the meeting of
June 7th, 1950. as required by law, was presented for final passage. It was moved by Commissioner
Healy, seconded by Commissioner Secor, that the Ordinance be passed and adopted and the motion was
carried by the fbllowing Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and
Commissioner Healy; those voting No, none.

The Manager presented a sohedule for fire insurance coverage for mobile vehicl es of the City of
Bozeman, showing the proposed value for insuranoe as compared with insurance carried at the present time.
After examination of the proposed sohedule, it was moved by Commissioner Healy, seconded by Commissioner
Secor, that the list of proposed values of motor vehicles for fire insurance be approved and the motion
was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and

Corrmdssioner Healy; those voting No, none.
Request to Establish a Propane Distribution Plant
The City Manager reported that a Union Distributing Company, Billings, Montana has made inquiry
regarding building a propane gas distributing plant on North Broadway. The proposed location is in
the Industrial Zone and a check of building and zoning regulations shows that there is nothing to prohibit
the oonstruotion of suoh a plant provided it complies with the Building Code.
Claims
The Claims Nos. 8773 and 8774 on the following funds were presented for payment:

The Manager approved the claims# and after examination of the olaims by the City Commission, it
was moved by Commissioner Secor, seoonded by Corrnnissioner Healy, that the olaims be approved and warrants
be drawn for their payment and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Lowe, Corrnnissioner Seoor and Commissioner Healy; those voting No, none.
Permission for Bozeman Canning Company to Use Sewer
The Manager presented and read the following letter, giving permission for the Bozeman Canning
Company to use the city's sewage system during the season of 1950 only:

Gentlemen:
Reference is made to your letter of May 31, 1960.
You submitted a fbrma1 request to the Mayor and City Commission of the City of
Bozeman for pennission to utilize the sewage system and sewage disposal plant
of the City of Bozeman for the handling of' your plant sewage for the 1950 oen...
ning season.
1. That this permission is granted for the 1950 canning season only,
or for the approximate period from July 25 to August 26, 1950.
and that under no ciroumstances may this be considered as a grant
of permission to use the sewage system and sewage disposal plant
of the City of Bozeman for any other period;
Your proposal and request, as set forth in the aforementioned letter, has been
considered by the City Commission and they have direoted me to advise you that
your request is, and the same may be hereby oonsidered to be, granted upon the
following conditions:
2. That your Company will construct its own sewage disposal system
for the disposal of its oannery wastes from and after the 1950
season;

3. That your Company will provide adequate screening of 40 mesh
screen to remove all solids from these wastes which can be removed
by screening, before or as they enter the sewage system of the
City of Bozeman, and will also prOVide, at its expense, a quali...
fied attendant to keep said screen or soreens olear when said
oannery wastes run into the sewage disposal sewage of the City of
Bozeman.
4. That your Company will pay to the City of Bozeman the regular
established water and sewage rental charges, and in addition will
pay to the City of Bozeman any and all additional expenses to
whioh the City of Bozeman is put in handling your Company's can...
nery wastes, including, but not limited to, the cost of additional
chemicals which must be added to the sewage.

6. That your Company will furnish to the City of Bozeman an indemnity
bond in form. satisfactory to the City of Bozeman, conditioned to
the effect that the City will be indemnified and held free and harm-
less of and from any and all liability which may arise out of or as
a result of the disposition of cannery waste through the sewage sys-
tem and sewage disposal plant of the City of Bozeman. said bond to
be in the limits of Ten Thousand and Fifty Thousand Dollars.
If these oonditions are satisfactory to your Company, will you please be so kind as to
address a letter to the Mayor and City Commission of the City of Bozeman acknowledging
the receipt of this letter and your acquiescence to the terms thereof? Upon the
receipt by the City of such letter from you, you may make the proper arrangements with
the City for utilizing the facilities of the City sewage system and sewage disposal
plant.

ing the points in question relative to the use of the sewer line for this season, be signed by the
Manager and mailed to the Bozeman Canning Compa~, and the motion was carried by the following Aye
and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those
voting No, none.
Bids for S. I. D. No. 361
Proposed quantities and work for the construction of Special Improvement Lighting District No.
361, on Main Street from Ida Avenue to Fourth Avenue were presented.
It was moved by Commissioner Secor, seoonded by Commissioner Healy, that the Clerk of the Com-
mission be authorized to advertise for bids to be opened July 12th, 1950, and the motion was carried
by the following Aye and No vote: those votine; Aye being Mayor Lowe, Commissioner Secor and Commis-
sioner Healy; those votine; No, none.
Adjournment
There being no further business to coma before the Commission at this time, it was moved by
Commissioner Secor, seconded by Commissioner Healy, that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor
and Commissioner Healy; those voting No, none.
