The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Building,
Wednesda.y afternoon, July 12th, 1950, at 1:00 o'clock F.M. Those being I-resent were Mayor Lowe, Commissioner
Secor, Commissioner Healy, City Manager Henderson and the Clerk when the following proceedings were had:
The minutes of' the last regular session were read, and it was moved by Commissioner Secor, seconded
by Corranissioner Hea.ly that the minutes be approved as read, and the motion was oarried by the following
Aye and No vote; thOSe voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those vating;
No, none.
Bids for Special Improvement Lighting District No. 361
The Manager st~ed this was the time and place set for the opening of bids for Special Improvement
Lighting District No. 361, on Main Street from Fourth Avenue to Ida Avenue. He presented the affidavit
of Fublication of the Notice to Bidders, and stated three bids have been filed.
Mr. F. L. Dye was present and stated his bid was submitted conditionally and the t he would like a
statement from the Commission regarding enforcing the penalty cl ause as stated :in the specifications should
the goverrunent "freeze" materials, and the contractor is unabl e to complete the contract. After considera-
tion, the Commission stated that under circumstances of this nature the penalty clause would not be en-
forced, and Mr. Dye stated he would submit his bid unconditionally. It was moved by Conunissioroer Healy,
seconded by Commissi on8r Secor that the bids be opened and read, and the motion was carried by the follow-
ing Aye and No v ote; those voting; Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those
voting No, none.
The following; bids were thereupon opened and read:

It was moved by Commissioner Healy, secanded by Commissioner Secor tha,t the bi ds be referred to the
Ci~ Engineer for tabulation and recommendations and the mation was carried by the following Aye and No
vote; those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none.

The Manager stated that he has audited these claims and finds them to be true and lawful claims against
The City of Bozeman and recommends that warrants be drawn for their payment. After examination of the claims
in deta.il by the City Commission, it Was moved by Commissioner Healy, seconded by Commissioner Secor that
the claims be approved and warrants drawn f'or their payment and the motion was carried by the following
Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; thos e voting
No, none.
Resolution for Furchase of Road Oil
The Manager stated that, in order to purchase needed road oil from the Montana Highway Commission, it
is required tha.t such purchase be authorized by resolution of the City Commission. He presented the follow-
ing resolution:

RESOLUTION
ViHEREAS THE CITY OF' BOZEMAN has immediate need for limited quanti ties of' road oil for use in making
emergency repairs on streets in Bozeman, and
WHEREAS, the City of Bozeman does not have proper facilities for procuring and storing quantities
of such oils in Bozeman, and
WHEREAS, the Montana State Highway Commission has quantities of road oil of the required types stored
in Bozeman from which it may be able to supply the immediate needs of the City of Bozeman at cost plus
handling charge.
NOW, THEREFORE. BE IT RESOLVED:
That an emergency does exist and the City Manager is hereby authorized to purchase from the
Montana State Highway Commission, from its stocks in storage in Bozeman, approximately 5000 gallons
of road oil as required for use in patching pavement in Bozeman during 1950.

Insurance Folicy to Replace Bond of Bozeman Canning Company
A communication from the Bozeman Canning Company asking permission to substitute a contingent liability
policy and property damage policy protecting the city from damage that might be caused by the dumping of
their sewage wastes into the city's sewe,ge system was presented and read. After discussion, it was moved
by Commissioner Healy, seconded by Commissioner Secor that permission be granted to the Bozeman Canning
Company to substitute a contingent liability and property damage insurance policy in place of a bond as
proposed in the agreement accepted on June 21, 1950, und the motion was carried by the following Aye
and No vote; those voting Aye being Mayor Lowe. Commissioner Secor and Commissioner Healy; those voting
No, none.
Purchase of Ignot Lead
The Manager asked authority to purch8se three tons of ignot lead for m.ak ing joints in sewer l:ipe. It
was moved by Commissioner Secor, seconded by Commissioner Healy that the City Manager be authorized to
purchase three tons of ignot lead, in the afproximete amount of $990.00 and the motion was carried by the
following Aye and No vote; those voting Aye being Mayor Lowe. Commissioner Secor and Commissioner Healy;
those voting No, none.
Le ft- Turns on Main Street Prahi bi ted
The Manager stated that, in line with the prof,osed revised traffic ordinance, left-turns will be
prohibited on Main Street at Willson Avenue, Black Avenue and. Tracy Avenue during busy hours. It was
moved by Conunissioner Healy, sec()nded by Commissioner Secor that the City Manager be authorized to issue
an emergency rsguletion to prohibit left-turns from Main Street at Black Avenue. Tracy Avenue and Willson
Avenue, and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Lowe,
Commissioner Secor and Commissioner Healy; those voting No, none.

Acceptance of ~ater Well at Airfort
A wri tten offer from the eAA giving to the City of Bozeman a water well and pump located at the
Galla tin Field was presented and read. A letter accepting the offer was read, subj ect to the acceptance
of the gift by the Board of County Commissioners.
