M. Those being present were Mayor Lowe, Comrrdssioner Healy, Commissioner Secor, City Manager Henderson, City Attorney Lovelace and the Acting Clerk, when the following proceedings were had: '1'he minutes of the last regular session, and the special sess ion of July 31st, 1950, were read, and it was moved by Connnissioner Healy, seconded by Commissioner Secor, that the minutes be apFroved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting N~, none. rublic Hearing. Appropriation Ordinance No. 754 The Manager stated that th is is the time and place set for public hearing on the annual apI ropria- tion ordinance for the fiscal year ending June 30, 1951. He presented the affidavit of publication of the Notice of Public Hearing, and stated that no one was present to protest and no protests had been filed. It was moved by Commissioner Healy, seconded by Commissioner Secor, that the ordinance be published as provided by law, and that August 16, 1950 be set as the date for final passage, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Bond all.d Contraot S. I. D. No. 361 The bond and contract of the Yellowstone Electric Co., Billings, Montana, for construction and installation of improvements in Special Improvement Lighting District No. 361, were presented. The bond end contract were approved as to fonn by the City Attorney whereupon, it was moved by Commissioner Healy, seconded by Mayor Lowe, that the bond and contract be approved and the Mayor and the Clerk of the City Commission be authorized to sign them for the City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Change in Specifioations - S. I. D. No. 361 Inf~nnation has been received that delivery of stranded underground cable, sFecified for S. I. D. No. 361, cannot be made in less than sixty days. Immediate delivery can be secured on solid conductor cable for this installation. Motion was made by Commissioner Secor, seconded by Mayor Lowe, that the Ci ty Manager issue a change order in the specifications f'or S. 1. D. No. 361 to permit the use of solid c,mductor cable subj ect to the following ~ondi tions: 1. The cable will be of the same carrying caraci ty, with equal insulation, and of equal quality to the stranded cable specified. 2. The City of Bozeman will be given the benefit 01' any difference in price between the stranded ceble and the solid conductor cable authorized by this change. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Report on Street Improvements The Manager reported that widenine; of Babcock Street, between Black and Tracy, her been completed a.t a cost approximately 2/3 of the cost of that for widenint; the similar block between Tracy and Willson in 1949. Work on widening W. Mendenhall, between 3rd and 7th>> is ex! ected to be started within 30 days and it is estima,ted that costs can be further reduced on that project. The joint project between the MOntana Highway Con;miss ion and the City of' Bozeman for apr,lying; a seal and chip coat on Main Street paving; is scheduled for commencement on August 16, 1950. Resolution No. 681 - Assessment S. I. D. No. 358 The resolution levyinr; the assessment for Special Improvement District No. 358 in the amount of 416 $3.533.00 wa.s presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN. MONTANA. LEVYTIW AND ASSESSING A SPECIAL ASSESSMENT OF TAXES efON ALL THE PROFERTY IN Sp'l<X TAL IMPROVEMENT DISTRICT NO. 358, IN TIlE CITY OF BOZEMAN. COUNTY OF GALLATIN. STATE OF MONTANA. TO DEFRAY THE COST OF CONSTRUCTING .AND IiIfAKING THE IMFOOVEMENTS WITHIN SAID SPECIAL INfROVEMENT DISTRICT NO. 358. It was moved by Commissioner Healy. seconded by Commissioner Secor, that the resolution be Frovi- sionally passed and August 9th, 1950 be set as the date for hearing of protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Forest Service - Water Bill The City Manager Fres8nted a proposed contract agreement submitted by the U. S. Forest Service whereby they would be permitted to pey their monthly water bill annually at the end of the fiscal year. It was moved by Commissioner Healy, seconded by Co:mmi,ssioner Secor, that this proposal be apFroved and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Secor ~md Commissioner Healy; those voting No, none. Replat - Werre Froperty West Side Addition A plat of a proposed rearrangement of the Werre property in West Side Addition was presented. The plat was examined in detail and, there being no objection by any member of the Commission, the Manager stated that he would, as Director of Public Service, approve the plat as authorized by laws of the State of Montana Claims for the month Claims Nos. 9027 to 9262 inolusive were presented on the various funds as followlSl The Manager stated the. t he has Band . After examine.- tion of the olaims in detail by the Commission, it was moved by Commissioner Healy, seconded by Commissioner Secor, that the claims be approved and warrants drawn for their payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Reports The following reports for the month of July, 1960 were presentedl Librarian Water Collector Police Judge Building Inspeotor Fire Chief (monthly & annual) It was moved by Commissioner Seoor, seoonded by Commissioner Healy, that the reports be aooepted and ordered filed, and the motion was carried by the following Aye and No votel those voting Aye being Mayor Lowe, Commissioner Secor and Commissioner Healy; those voting No, none. Gas Heat . City Hall The matter of converting the City Hall heating system to gas fired, and the installation of auxiliary heat in the police Station and Fire Hall was discussed. The City Manager was instruoted to obtain all neoessary information, and to order the preparation of plana and specifioations for the work. 1 I 1 1 I 1 Water Main - North 7th Avenue At the request of Mr. Roy Houser, the matter of installing a water main on North Seventh Avenue, from Durston Road to the oity limits, was disoussed. The Manager was instruoted to have the City Engineer prepare an estimate of ooat of the projeot and to reoommend to Mr. Houser that he seoure other property owners to join with him in petitioning the City Comm1nion to establish a Speoial Improvement Distriot for the purpose of D1Bking this installation.
